ORDER
GOVERNMENTS OF THE CZECH REPUBLIC
of 26 February 2021
on the security and organisation of the provision of social services for the duration of the emergency situation
Following the Government Resolution No. 196 of 26 February 2021, by which the Government, in accordance with Article 5 and 6 of Constitutional Act No. 110 / 1998 Coll., on the Security of the Czech Republic, declared emergency status in accordance with Article 5 and Article 5 (a) to (e) and Article 6 of Act No. 240 / 2000 Coll., on health threats related to the detection of coronavirus / known as SARS CoV-2 / in the territory of the Czech Republic, a decision on the adoption of emergency measures within the meaning of § 5 (c) and (e) of the Crisis Act.
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
I. Orders
1. to social service providers to limit the provision of social services so that they do not have to fulfil the obligation under § 88 (f) of Act No. 108 / 2006 Coll., on Social Services, as amended,
2. to provide social services to social service providers to the extent necessary to ensure the protection of the life and health of persons, including the provision of essential activities which do not relate to a registered type of social service, provided that personal and material technical security permits the provider for the duration of the emergency situation;
3. to all persons (user, employees of the provider and other persons present) during the provision of social services in field form at the place of residence or in the place of temporary accommodation a ban on movement and residence without respiratory protection (nose, mouth), which is a respirator or similar device (always without an exhalation valve) meeting at least all technical conditions and requirements (for the product), including a filtration efficiency of at least 95% according to the relevant standards (e.g. FFP2 / KN95), a medical face mask or equivalent device fulfilling at least all technical conditions and requirements (for the product) of the ČSN EN 14683 + AC standard, which prevents the spread of drops;
4. inform all interested persons, users or their loved ones of the relevant social service providers in field form of the occurrence of clinical signs of COVID-19, or of the ordered quarantine, or of the detected disease of COVID-19 with the candidate, client or loved one, immediately upon detection,
5. social service providers which have been granted a registration for the provision of social services pursuant to § 63 of Act No. 108 / 2006 Coll., on social services, as amended, (dormitory), to provide also essential activities as required by the clients, to the extent necessary under § 57 of Act No. 108 / 2006 Coll., on social services, as amended, provided that adequate personnel and material technical security is provided, for the duration of the emergency situation;
II. requires the Minister for Labour and Social Affairs to inform and methodically guide social service providers, regions and the capital of Prague in the process of providing care under point I. of this provision, to lead them methodically in their implementation and to manage the provision of social services for the duration of the emergency situation.
