on the adoption of crisis measures
Following the Government Resolution No. 957 of 30 September 2020, the Government, in accordance with Articles 5 and 6 of Constitutional Act No. 110 / 1998 Coll., on the Security of the Czech Republic, declared emergency status for the territory of the Czech Republic because of a health threat related to the detection of coronavirus / referred to as SARS CoV-2 / in the territory of the Czech Republic and, within the meaning of § 5 (a) to (e) and § 6 of Act No. 240 / 2000 Coll., on crisis management and on the amendment of certain laws (Crisis Act), as amended, for the resolution of a crisis situation, the adoption of emergency measures, by virtue of § 5 (c) to (e) and § 6 (b).
This Regulation shall be binding in its entirety and directly applicable in all Member States.
1. for all health service providers, it limits the visits of patients to medical facilities in places where emergency bed care is provided, so that the visit can only be granted under the following conditions:
- the person visiting the patient during the visit uses personal respiratory protection devices, at least an FFP2 or KN95 class respirator without an exhalation valve, except:
- children under the age of two,
- children between two and 15 years of age if they have another respiratory protective device (nose, mouth) which prevents the spread of droplets,
- the visit takes a maximum of 30 minutes, except for visits to hospital and other patients in the terminal stage of incurable disease,
- a maximum of two persons shall attend the visit at one time,
and with respect to other regime measures of the provider,
2. for all health service providers, it limits the visits of patients to health care facilities in places where long-term or subsequent bed care is provided, so that the visit can only be granted on condition that the person visiting the patient undergoes a POC test prior to the start of the visit for SARS CoV-2 antigen, with negative results; This requirement shall not apply to persons who have undergone a RT-PCR test or a POC test for the presence of SARS CoV-2 virus antigen at least 48 hours prior to the start of the visit, with negative results and evidence of this, and persons who have undergone COVID-19 disease 90 days before the date of the visit and who will provide evidence of it; a person visiting a patient who meets any of the above conditions may make a visit provided that, during the visit, he / she uses personal respiratory protection devices, at least an FFP2 or KN95 class respirator without an exhaling valve [except for children under two years of age who may not have a respiratory protection device, and except for children between two and 15 years of age, if they have another respiratory protection device (nose, mouth) which prevents the spread of droplets] and while complying with the other regime measures of the provider,
3. For all health service providers, the presence of a third party at childbirth in a healthcare establishment shall be limited in such a way that the presence of a third person at childbirth may be permitted only if the following conditions are met:
(a) the third person is the second parent of the child or of a person living with a common household parent;
(b) the birth will take place in a separate delivery room or box with its own bathroom,
(c) third-party contact with other mothers shall be restricted;
d) the third person shall be subjected to temperature measurements before entering the birthing room or box, the third person shall have a body temperature below 37,0 ° C and at the same time no symptoms of COVID-19 disease;
(e) the third person uses the surgical mask as a minimum respiratory protection (the use of improvised or cloth is not sufficient),
4. for all providers of social services in the establishment of homes for seniors and homes with a special regime and for all relief social services in residence form (pursuant to § 44, 49 and 50 of Act No. 108 / 2006 Coll., on Social Services), the user's visits are limited so that the visit can be accepted only on condition that the person visiting the user is subjected to a POC test prior to the start of the POC test for the presence of SARS CoV-2 antigen, with a negative result; This requirement shall not apply to persons who have undergone a RT-PCR test or a POC test for the presence of SARS CoV-2 virus antigen at least 48 hours prior to the start of the visit, with negative results and evidence of this, and persons who have undergone COVID-19 disease 90 days before the date of the visit and who will provide evidence of it; a person visiting a user who fulfils any of the above conditions may make a visit provided that, during the period of the visit, he uses personal respiratory protection devices, at least an FFP2 or KN95 class respirator without an exhaling valve (except for children under two years of age who may not have a respiratory protection device, and with the exception of children between two and 15 years of age, if they have another respiratory protection device (nose, mouth) which prevents the spread of droplets) and while complying with the other regime measures of the provider; in the case of visits to users in the terminal stage of the incurable disease, the visit may be granted provided that the person visiting the user complies with the provider's regime measures.
