GOVERNMENT REGULATION
of 10 March 2008
on the conditions for providing special prices to the publicly available telephone service
The Government mandates pursuant to Sections 38 (8) and 43 (5) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (the Act on Electronic Communications), as amended by Act No. 261 / 2007 Coll., hereinafter referred to as "the Act ':
A person with special social needs for the demonstration of disability referred to in Paragraph 43 (4) of the Act shall submit the following documents for inspection:
(a) in the case referred to in § 43 (4) (a) of the Act
1. the ZTP licence according to Act No. 100 / 1988 Coll., on Social Security, as effective until 31 December 2011, and the doctor's certificate of practical or complete deafness; the ZTP licence can be demonstrated by the disability only until its expiry date, but no later than 31 December 2015,
2. a decision to grant a level II exceptional benefit because of complete or practical deafness; or
3. a ZTP card with a symbol of the designation of a person with complete or practical deafness pursuant to § 34 (3) of Act No. 329 / 2011 Coll., on the provision of benefits to disabled persons and on the amendment of related laws, as amended by Act No. 313 / 2013 Coll.,
(b) in the case referred to in § 43 (4) (b) of the Act
1. the ZTP / P licence under Act No. 100 / 1988 Coll., as effective until 31 December 2011; the ZTP / P licence can be demonstrated by the disability only until its expiry but no later than 31 December 2015,
2. a decision to grant exceptional advantages in grade III; or
3. the ZTP / P licence pursuant to § 34 paragraph 4 of Act No. 329 / 2011 Coll.,
(c) in the case referred to in Article 43 (4) (c) of the Act, the notification or decision to grant a care allowance at the level of dependency II, III or IV; if the minor is a minor, the participant in whose personal care the minor is, shall provide proof that he is the parent of that person or the decision of the competent authority referred to in Article 7 (10) (a), (b), (d) or (e) of the State Social Support Act;
(d) in the case referred to in Article 43 (4) (d) of the Act, the documents referred to in (a) or (b) issued to the minor who is raised or personally cared for by the participant; the participant in whose personal care the minor is present evidence that he is the parent of that person or the decision of the competent authority pursuant to Article 7 (10) (a), (b), (d) or (e) of the State Social Support Act.
The amount of the price advantage for a person with special social needs shall be such that the loss of special prices providers shall not exceed CZK 200 per person, including value added tax per calendar month.
(1) The list of persons to whom the special price has been awarded includes:
(a) name, surname, date of birth, address of residence; in the case of a person receiving a special prize under personal care under Section 43 (4) (d) of the Act, the name, surname and date of birth of that minor shall also be indicated;
(b) the telephone number for which the special price is granted;
(c) the period of delivery of the specific price;
(d) the period of validity of the document referred to in Article 1, if indicated;
(e) the amount of the rebate granted on the basis of the selected special price for each monthly settlement period and for the calendar year in total;
(f) the price plan;
(g) information on the use of a publicly available telephone service provided by means of an Internet Protocol throughout the period of use of the price advantage, if any, for the price advantage for the price plan for the Internet access service.
(2) The universal service provider which provides special prices under Paragraph 38 (3) of the Act shall keep the lists referred to in paragraph 1 for at least 5 years.
Repeal
Government Decree No. 336 / 2006 Coll., on the conditions for providing special prices for publicly available telephone services, is hereby repealed.
Efficacy
This Regulation shall enter into force on 1 May 2008.
