GOVERNMENT REGULATION
of 2 April 2025
amending Government Regulation No 189 / 2018 Coll., on the sustainability criteria for biofuels and the reduction of greenhouse gas emissions from fuel, as amended
The Government orders pursuant to § 19f paragraph 11 and § 19h paragraph 8 of Act No. 201 / 2012 Coll., on Air Protection, as amended by Act No. 382 / 2021 Coll. and Act No. 42 / 2025 Coll.:
Government Regulation No. 189 / 2018 Coll., on the sustainability criteria of biofuels and the reduction of greenhouse gas emissions from fuel, as amended by Government Regulation No. 492 / 2020 Coll. and Government Regulation No. 107 / 2022 Coll., is amended as follows:
1. footnote 1 shall read:
"(1) Directive 2009 / 30 / EC of the European Parliament and of the Council of 23 April 2009 amending Directive 98 / 70 / EC as regards the specification of petrol, diesel and gas oils, the introduction of a mechanism for monitoring and reducing greenhouse gas emissions and Council Directive 1999 / 32 / EC as regards the specification of fuel used by inland waterway vessels and repealing Directive 93 / 12 / EEC, as amended by Directive (EU) 2016 / 802 of the European Parliament and of the Council. Council Directive (EU) 2015 / 652 of 20 April 2015 laying down methods of calculation and reporting pursuant to Directive 98 / 70 / EC of the European Parliament and of the Council on the quality of petrol and diesel fuels. Directive (EU) 2015 / 1513 of the European Parliament and of the Council of 9 September 2015 amending Directive 98 / 70 / EC on the quality of petrol and diesel fuels and Directive 2009 / 28 / EC on the promotion of the use of energy from renewable sources, as amended by Directive (EU) 2018 / 2001 of the European Parliament and of the Council. Directive (EU) 2018 / 2001 of the European Parliament and of the Council of 11 December 2018 on the promotion of the use of energy from renewable sources, as amended by Commission Delegated Regulation (EU) 2022 / 759 and Commission Delegated Directive (EU) 2024 / 1405. ';
2. In Section 1, at the end of point (e), the words "and the list of raw materials for the production of advanced biofuels' are added.

Raw materials for the production of advanced biofuels and advanced biofuels
(1) The list of raw materials for the production of advanced biofuels is set out in Part A of Annex 4 to this Regulation.
(2) The list of raw materials for the production of advanced biofuels is set out in Part B of Annex 4 to this Regulation. "
4. Annex 4 shall read as follows:
"Annex No 4
RAW FOR THE PRODUCTION OF POTENTIAL AND COMPLETED BIOFUL
List of raw materials for advanced biofuels
(a) algae grown on land in water tanks or photobioreactors.
(b) Biomass contained in mixed municipal waste but not sorted domestic waste which falls within the recycling targets referred to in Article 11 (2) (a) of Directive 2008 / 98 / EC of the European Parliament and of the Council of 19 November 2008 on waste and repealing certain Directives.
(c) Biological waste from households which is subject to separate concentration of waste pursuant to Article 11 (1) (e) of the Waste Act.
(d) Biomass contained in industrial waste which is not suitable for use in the food or feed chain, including materials derived from retail and wholesale trade and the agri-food industry, as well as the fisheries and aquaculture sector, but not used kitchen oils and animal fats of category 1 or 2, as amended by Regulation (EC) No 1069 / 2009 of the European Parliament and of the Council.
(e) straw.
(f) manure and sludge from sewage treatment plants.
(g) Waste water from the palm oil mill and freckles of empty palm fruit.
(h) tall oil tar.
(i) Raw glycerin.
(j) Bagasa.
(k) Matolin and wine lees.
(l) Nuts.
(m) Breed.
(n) Maize ears free of grains.
(o) Biomass contained in waste and residues from forestry and timber industries such as bark, branches, non-commercial purgatory, leaves, needles, tree crowns, sawdust, shavings, black lye, brown lye, fibreboard sludge, lignin and tall oil.
(p) Other non-food cellulose pulp *).
(q) Other lignocellulose pulp * *), excluding sawdust and veneer wood.
(r) Glues from the distillation of alcohol.
s) Crude methanol from the sulphate production process of wood pulp.
(t) Temporary crops, such as intermediate crops and cover crops, which are grown on areas where the production of food and feed crops is limited to one harvest as a result of a short growing season and provided that their use does not create demand for additional land, as well as provided that the organic matter content of the soil is maintained when used to produce biofuels for the aviation sector.
(u) crops grown on strongly degraded soil, with the exception of food and feed crops, when used to produce biofuels for the aviation sector.
(v) Sinews.
*) Includes residues of food and feed crops (for example straw, corn husks, husks and pods), energy grasses with low starch content (for example, fillet, prosciutto, orchards, ratchet), forage and cover crops sown before sowing and after harvesting of the main crops, industrial residues (including residues of food and feed crops after extraction of vegetable oils, sugars, starches and proteins) and fibre from biological waste. Forage and cover crops means a mixture of grassland and low starch leguminous vegetables sown on grassland for the purpose of providing forage for livestock or arable land to improve its fertility to achieve higher yields for the main crops.
* *) For example, biomass originating from forests, energy wood and residues and waste from forestry and timber industries.
List of raw materials for advanced biofuels production
(a) Used cooking oil.
(b) Animal fats of category 1 or 2 pursuant to Regulation (EC) No 1069 / 2009 of the European Parliament and of the Council, as amended.
(c) damaged crops which are not suitable for use in the food or feed chain, except for substances which have been deliberately modified or contaminated to meet this definition.
(d) Communal waste water and derivatives other than sludge from sewage treatment plants.
(e) Crops grown on strongly degraded soil, with the exception of food and feed crops and raw materials listed in Part A of this Annex, unless used for the production of biofuels for the aviation sector.
(f) Temporary crops, such as intermediate crops and cover crops, with the exception of the raw materials listed in Part A of this Annex, which are grown on areas where the production of food and feed crops is restricted to one crop as a result of a short growing season and provided that their use does not create demand for additional land, as well as provided that the organic matter content of the soil is maintained, unless they are used for the production of biofuels for the aviation sector. ';
Efficacy
This Regulation shall enter into force on the first day of the calendar month following its publication.
