on the Trade Agreement between the Czechoslovak Socialist Republic and the Republic of Perú
A Trade Agreement between the Czechoslovak Socialist Republic and the Republic of Perú was signed in Lima on 25 February 1977. The Agreement entered into force on 3 May 1978 on the basis of Article XIII thereof.
The Czech translation of the text of the Agreement is announced simultaneously.

TRADE AGREEMENT
between the Czechoslovak Socialist Republic and the Republic of Perú
The Government of the Czechoslovak Socialist Republic and the Government of the Republic of Perú, hereinafter referred to as the Contracting Parties, having regard to the bonds of friendship that unite both countries, and the mutual desire to consolidate their economic relations and to settle trade with each other in order to consolidate, increase and diversify such relations on the basis of equality and mutual benefit, have agreed to conclude the following trade agreement:
The Parties shall, in their trade relations, provide each other with treatment under the most-favoured-nation clause in accordance with Article I and other provisions of the General Agreement on Tariffs and Trade of which both countries are members.
The provisions of this Article shall not apply to advantages, exemptions and privileges granted by any of the Contracting Parties.
(a) neighbouring countries in order to facilitate border trade;
(b) third countries as a result of their membership in the areas of free trade, customs union or other economic integration groupings.
Taking into account the possibilities and needs of both countries' national economies as well as the need to ensure a stable supply of their economies, both Parties agree by all means available to support the respective undertakings or organisations of their countries in concluding contracts on the supply of goods and services in order to achieve a gradually more dynamic and balanced exchange of goods between the Czechoslovak Socialist Republic and the Republic of Perú.
The Parties agree to promote the conclusion of long-term trade contracts between the relevant undertakings or organisations of both countries.
Products exported under this Agreement shall be intended for internal consumption or processing in the importing country. The export of the goods shall be permitted only with the prior and explicit agreement of the competent authorities or organisations of the exporting country.
Trade transactions under this Agreement will take place between Czechoslovak organisations authorised to conduct foreign trade activities as independent legal entities on the one hand and Peruvian legal and natural persons on the other hand, taking into account world prices.
The Contracting Parties shall take the necessary measures, in accordance with their own rules and international agreements signed by the two Contracting Parties, to protect products originating in their territories from all forms of unfair competition from products originating in the other Contracting Party and to this end to prevent import and to prevent the manufacture, circulation or sale of products which would bear the mark, designation, inscription or any other sign, incorrectly indicating the origin, type or nature of the products.
In order to facilitate and enhance trade between them, both Parties will promote each other, within the framework of the laws and regulations in force in their countries, participation in fairs and exhibitions, whether permanent or occasional, and will provide the necessary support for the implementation of these actions.
The Contracting Parties shall, in accordance with their laws and regulations, provide each other with the necessary facilitation for:
(a) the importation of samples and goods without commercial value and commercial promotional materials;
(b) the importation of equipment intended for experiments, tests and scientific and technical research on the basis of pre-agreed programmes;
(c) the introduction into a tied circulation of goods intended for permanent or temporary fairs and exhibitions;
(d) the introduction into the coupled circulation of tools and equipment intended for assembly or repair;
(e) imports into the closed circulation of containers to be used in the course of trade.
The provisions of this Agreement shall not be construed as barriers to the adoption and implementation of measures intended to:
(a) the application of safety laws and regulations;
(b) regulating imports and exports of arms, ammunition and other war material;
(c) the protection of national assets of the value of artistic, historical and archaeological;
(d) the quality marking of products and sanitary standards.
All salaries between the Czechoslovak Socialist Republic and the Republic of Perú, related to this Agreement, will be made in freely convertible currencies.
In order to achieve the objectives of this Agreement, both Parties agree periodically to provide mutual information on their delivery options and purchasing requirements through their respective undertakings or organisations.
The Parties agree that the Joint Commission shall supervise compliance with the provisions of this Agreement.
This Agreement shall enter into force on the date of the exchange of notes confirming its approval under the applicable laws and regulations in force in each country.
This Agreement shall remain in force for a period of five years from the date of its entry into force and shall be automatically extended by one more year unless one of the Contracting Parties expressly denies it at least six months before the expiry of the relevant period of validity.
The termination of this Agreement shall not affect contracts concluded under it which remain in force until their fulfilment.
