THE LAW
of 14 March 2006
on unilateral increase of rent from the apartment and amendment of Act No. 40 / 1964 Coll., Civil Code, as amended
Parliament has decided on this law of the Czech Republic:
TRANSITIONAL PROVISIONS
Save as otherwise provided in this law, its provisions shall also apply to legal relationships arising before the date on which it takes effect. However, the creation of such legal relations and claims arising from them before the date of entry into force of this Act shall be assessed in accordance with existing legislation.
EFFECTIVE
(1) This Law shall take effect on 31 March 2006.
(2) Part 1 of this Act expires on 31 December 2012.

Procedure for determining the monthly rental target values per m2 of floor area of the apartment and maximum monthly rental increments
The target value of the monthly rent for 1 m2 of floor space expressed in CZK / m2 is calculated according to the formula
CN = 1 / 12 * p * ZC,
where:
CN is the target value of the monthly rent per m2 of floor area,
ZC is the basic price per m2 of floor area,
p is the coefficient expressing the proportion of annual rent on the basic price of the apartment;
p has a value of:
(a) p = 0,026 for reduced-quality apartments located in the territory of Prague 1 as defined by the communication;
(b) p = 0,0325 for low-quality apartments situated in the territory of Prague 2 as defined by the communication;
(c) p = 0,041 for low-quality apartments located in the territory of Prague 6 as defined by the communication;
(d) p = 0,045 for all other apartments with reduced quality,
(e) p = 0,029 for other flats situated in the territory of Prague 1 as defined by the communication,
(f) p = 0,0365 for other flats situated in the territory of Prague 2 as defined by the communication,
(g) p = 0,046 for other flats situated in the territory of Prague 6 as defined by the communication,
(h) p = 0,05 for all other flats.
The maximum monthly rent increase expressed in% is calculated using the formula
MP = CN / AN4-k + 1-1 * 100,
where:
MP is the maximum monthly rent increase expressed in%,
CN is the target value of the monthly rent per m2 of floor area expressed in CZK / m2,
AN is the actual value of the monthly rent for 1 m2 of floor space expressed in CZK / m2,
k is the annual coefficient within the scope of Part One of the Act:
For the period 1 January 2007 to 31 December 2010, where unilateral increases in rent end on 31 December 2010,
k = 1 for the period 1 January 2007 to 31 December 2007, k = 2 for the period 1 January 2008 to 31 December 2008, k = 3 for the period 1 January 2009 to 31 December 2009, k = 4 for the period 1 January 2010 to 31 December 2010.
For the period 1 January 2007 to 31 December 2012, in cases where unilateral increases in rent end on 31 December 2012,
k = 1 for the period 1 January 2007 to 31 December 2007, k = 2 for the period 1 January 2008 to 31 December 2008, k = 3 for the period 1 January 2009 to 31 December 2009, k = 2 for the period 1 January 2010 to 31 December 2010, k = 3 for the period 1 January 2011 to 31 December 2011, k = 4 for the period 1 January 2012 to 31 December 2012.
