DECLARATION
Federal Ministry of General Engineering, Federal Ministry of Steel and Heavy Engineering and Federal Ministry of Electrical Engineering

amending and supplementing Decree No. 135 / 1964 Coll., issuing the basic conditions for the supply of engineering products, as amended by Decree No. 57 / 1972 Coll.
The Federal Ministry of General Engineering, the Federal Ministry of Steel and Heavy Engineering and the Federal Ministry of Electrical Engineering, in agreement with the participating ministries, provides, pursuant to § 392 (1) of Economic Code No. 109 / 1964 Coll., as amended by No. 37 / 1971 Coll.:
Čl. I
The Decree of the Ministries of General Engineering and Heavy Engineering No. 135 / 1964 Coll., issuing the basic conditions for the supply of engineering products, as amended by Decree No 57 / 1972 Coll., is amended as follows:
1. Paragraph 1 (1) (a) reads as follows:
"(a) engineering products and spare parts for them,"
2. The following Section 11a is inserted after Section 11:
„§ 11a
Spare parts
(1) The supplier is obliged to conclude a contract on the delivery of the necessary spare parts in the appropriate quantity and product range for the products he has supplied in due time.
(2) For the purposes referred to in paragraph 1, organisations shall, as a general rule, conclude contracts for the preparation of supplies.
(3) The obligation to supply spare parts shall continue for as long as it is normal and efficient to repair products; where that period is not fixed or agreed, this obligation shall continue for a period of 10 years from the end of the manufacture of the product for which the spare parts are intended.
(4) The obligation referred to in paragraph 1 may also be fulfilled by the supplier by ensuring that spare parts are supplied by another supplier.
(5) Import gestor1) is not obliged to conclude a contract for the supply of spare parts, unless the foreign exchange cover is released to cover costs abroad, 2) without which the supply of spare parts cannot be effected. '
(3) Paragraph 34f (2) is deleted.

This Decree shall take effect on 1 January 1982.
