of 24 May 1995
amending and supplementing Act No. 303 / 1993 Coll., on the abolition of the State Tobacco Monopoly and on related measures, as amended by Act No. 45 / 1994 Coll. and Act No. 40 / 1995 Coll.
Parliament has decided on this law of the Czech Republic:
Act No. 303 / 1993 Coll., on the abolition of the state tobacco monopoly and on the related measures, as amended by Act No. 45 / 1994 Coll. and Act No. 40 / 1995 Coll., is amended as follows:
1.
Conditions for processing tobacco, production, storage and sale of tobacco products
That law provides for certain conditions for the processing of tobacco, the production, storage and sale of tobacco products, including the imposition of penalties for infringements of the obligations laid down. '.
2. In Article 4 (1), the word "store 'shall be inserted after the word" import 2)'.
3. the following paragraph 6 is added to Article 4:
"(6) Part selling of cigarettes from open unit packs intended for direct consumption or without such packages is prohibited."
4. Article 7 (2) reads as follows:
"(2) The authorities referred to in Article 8 (1) and (5) shall impose a fine on a natural or legal person who sells non-labelled cigarettes pursuant to Article 4 (1) or who stores non-labelled cigarettes pursuant to Article 4 (1) in excess of 200 head.
(a) up to CZK 100,000 for first finding of sale or storage,
(b) up to 500 000 CZK in the case of re-establishing sales or storage. "
5. In Article 7, the following paragraph 3 is inserted after paragraph 2:
"(3) The authorities referred to in § 8 (1) and (5) shall impose a fine on a natural or legal person who infringes the prohibition set out in § 4 (6):
(a) in the amount of CZK 10,000 at the first finding of a breach of this prohibition,
(b) in the amount of CZK 50 000 in the event of a redetection of a breach of this prohibition. "
Paragraphs 6, 7 and 8 shall be renumbered paragraphs 5, 6 and 7.
6. Article 8 (1) reads as follows:
"(1) Where the Czech Agricultural and Food Inspection or the Czech Trade Inspection (hereinafter referred to as the" Inspection ") is found to be selling cigarettes which are not marked in accordance with Section 4 (1) (hereinafter referred to as" unmarked cigarettes "), or where unmarked cigarettes are stored in quantities of more than 200 units, they shall, in addition to the fine referred to in Section 7 (2), also charge the forfeiture of those unmarked cigarettes or decide to prevent or prevent them from any finding of such storage or sale. At the same time, it shall communicate its findings to the competent trade office. ';
7. In Article 8 (2), the words "if necessary 'shall be deleted.
8. In Paragraph 8 (5), the words "and municipal police13 'are deleted, including footnote 13). The comma before the words" Police of the Czech Republic 12)' is replaced by "a '.
9. Paragraph 8 shall be added to paragraph 10:
"(10) For the purposes of this Act, the storage of unlabelled cigarettes shall be understood as being stored in premises intended for that purpose (warehouses), in means of transport, including in transport, offices or other non-residential premises and in sales places, including stalls and similar sales. ';
This Act shall take effect on the day of its publication.
