Decree on the legal and financial formalities of pupils in military secondary schools

DECLARATION
of 25 March 2008
on the legal and financial formalities of pupils in military secondary schools
According to Section 166 of Act No. 221 / 1999 Coll., the Ministry of Defence provides:
§ 1
Subject matter
(1) This decree regulates the scope, amount and manner of providing the natural and financial essentials to students of military secondary schools who are not in active service and who are continuously preparing to serve as an occupational soldier.
(2) Natural essentials are provided in the form of catering, equipment and transport and accommodation.
(3) The cash requirements shall be provided in the form of a recurring monthly incentive allowance, a one-off half-yearly incentive allowance, one-off incentive remuneration or money compensation for non-provided natural needs.
Meals
§ 2
(1) The school provides the student with meals, which are paid by the Ministry of Defence at 60% of the financial value of the dietary allowance for pupils and food supplements. The student accounts for 40% of the financial value of the allowance for pupils and food supplements.
(2) In the cases provided for in Sections 3 (3) (b) and 4 (2), the Ministry of Defence shall pay the pupil in full the financial value of the dietary allowance for the pupil and food supplements.
(3) A student who does not pay his part in the payment of the meals referred to in paragraph 1 shall not receive the allowance.
(4) The training course shall be provided to the pupil from the day of taking up the school until the end of the education or the day of the occupation to the service of the professional soldier.
§ 3
(1) The meals of the pupil are provided by the main food and food supply. The main dish, which is breakfast, lunch or dinner, is made up of warm food, and if it cannot be secured, then the form
(a) cold meals; or
(b) food for separate or group preparation of the main meal.
(2) If the student cannot be provided with any form referred to in paragraph 1, the allowance in cash referred to in Article 5 (1) shall be paid.
(3) In the course of the course of the course of the course, there is no provision for a student to attend school or to stay in a non-educational youth home, except for a period of
(a) the pupil performs practical training to which he has been seconded by the school in the course of his or her education; or
(b) the student is sent by the school to participate in a sporting, cultural, social or professional interest event for the purpose of representing the school, an event organised by the Ministry of Defence or an event for gifted pupils.
(4) The first day of the unplanned absence of a pupil shall not be considered as the absence of a pupil at a school or youth home.
§ 4
Food intake for pupils and food supplements
(1) The main food and food must correspond to the diet levy for pupils and food supplements, their energy standards and nutritional values set out in Annex 1 to this decree and the average food consumption composition set out in Annex 2 to this decree.
(2) Where a pupil is conducting practical training at a military unit or facility (hereinafter referred to as the "military unit '), he shall be provided with a main meal or food equivalent to the diet levy to be prepared for the military unit.
(3) Where a student is conducting practical training with a military service, food supplements A and B listed in Annex 2 to this Decree shall also be provided for the diet provided for in paragraph 2, depending on the complexity of the practical teaching carried out; for the provision of food supplements according to part of the sentence in front of the semicolon, the conditions for the provision of food supplements A and B laid down in Sections 8 and 9 of Decree No. 209 / 2025 Coll., on the method of providing free food and equipment for professional soldiers, reserve soldiers and active reserve soldiers shall apply mutatis mutandis.
§ 5
Money compensation and cash compensation supplement
(1) Refund in money for the main food is the financial value of the types and quantities of each food corresponding to the diet levy for pupils and food supplements set out in Annex 1 to this Decree. A student who has paid his or her share of the diet referred to in Paragraph 2 (1) shall be paid in cash for each main meal to be issued at the rate of 60% of the financial value of the allowance for the pupil and the food supplements referred to in Paragraph 6 (1); at the same time as the allowance for the money, the student shall also be reimbursed by the student for the payment of the diet.
(2) A pupil who has been entitled to the provision of meals under Section 2 (2) but who has not been able to issue individual main meals shall be paid a cash refund equal to 100% of the financial value of the food levy for the pupil and food supplements under Section 6 (1).
(3) A supplement to the refund in money shall be paid to the pupil together with the refund in money if he participates in an action under Paragraph 3 (3) (b) and is not allowed to dine in a school or military unit.
(4) The amount of the allowance to be paid in cash is equal to the lowest amount of the allowance for the professional soldier per business way1). Of this amount, it is paid to be replaced in cash for breakfast 20%, for lunch 40% and for dinner 40%.
§ 6
Energy, nutrition and financial value of the diet for pupils and food supplements
(1) The financial value of the food levy for pupils and food supplements is calculated by multiplying their average consumption patterns by kilograms per person per day in accordance with Annex 2 to this Decree by their average consumer prices per kilogram. The average consumer price is the average price of a food certified by a market survey carried out by the Ministry of Defence for the Czech Republic. The school director shall publish the financial value of the subsistence allowance for pupils and food supplements on the school's website.
(2) The financial value of the food levy for pupils and food supplements will only be increased in the case of an increase of more than 2% in the average annual consumer price index published by the Czech Statistical Office for the calendar year. In this case, the financial value of the food levy for pupils and food supplements will be increased by the average annual inflation rate published by the Czech Statistical Office.
(3) The financial value of the dietary levy for pupils and food supplements shall be adjusted from the first day of the second month following the finding of the difference referred to in paragraph 2.
(4) The financial value of the subsistence allowance for a student is increased by 10% on days of preparation in groups of up to 25 persons. The financial value of the subsistence allowance for a student in a military school affected by a natural disaster or other serious life, health or the environment may be increased by up to 20%.
(5) The monthly average consumption of energy and nutritional value of dietary doses, food supplements and their financial value in the days on which free meals are provided shall correspond to the values laid down in this Decree for individual food levies and food supplements, with the annual average consumption of these values not exceeding 10% above or 3% below the specified value.
§ 7
Security of equipment and free services
(1) The equipment shall be secured by the issue of components of military uniforms and free service security or money replacement. Free services are laundry, dry cleaning, treatment, repair and maintenance of military equipment ("care of military uniforms') and hair treatment.
(2) The following military uniforms are issued to the pupil:
(a) uniform field green printing,
(b) uniform field green printing,
(c) uniform,
(d) walking uniform,
(e) uniform working clothes; and
(f) exercise uniform.
(3) The training requirements shall be granted to the pupil from the date of taking up school until the date of completion of the education or the day of employment to the service of the professional soldier.
(4) On the day of completion of the training or the day of occupation, the student is obliged to return to the service of the professional soldier the part of the military uniform issued, unless the school director determines that their return is not useful or economical.
(5) The care of military uniforms referred to in paragraph 1 shall be provided as necessary and possible at the place of performance of the study tasks in the form of:
(a) security of services;
(b) the supply of consumables; or
(c) security of assets for the care of military equipment.
(6) The care of military uniforms is not ensured during the period of major holidays, except for the days on which the student participates in the actions referred to in Article 3 (3) (b).
§ 9
Military uniform at funeral
If a student dies, he will go to his funeral to tell the narrator the service uniform without a hat and shoes. If the school is the publisher of the funeral, an extra set of laundry will be issued.
§ 11
Replacement of military uniform components
(1) The components of military uniforms issued pursuant to Paragraph 7 (2) shall vary depending on the time of use of the component of the military uniform, after which the maintenance of its utility characteristics is guaranteed.
(2) Compensation for lost or refunded parts of military uniforms necessary for the performance of study tasks may be made at the request of the pupil, provided that the application has been approved by the school director.
§ 11a
Refund in cash
(1) Refund in money is paid to the pupil for:
(a) the initial acquisition or replacement of parts of military uniforms not provided for;
(b) unsecured care of issued military uniforms.
(2) Paragraph 15 and 16 of Decree No. 209 / 2025 Coll., on the method of providing free meals and equipment for professional soldiers, advance-paid soldiers and active reserve soldiers shall apply to the payment of the refund referred to in paragraph 1 and its amount, mutatis mutandis.
§ 12
Provision of free transport and reimbursement of travel expenses in cash
(1) Free transport (hereinafter referred to as "transport") for educational and educational actions referred to in Article 3 (3) (b) is provided by the service authority (2).
(2) Where the transport is not secured in accordance with paragraph 1, compensation shall be granted for the proven cost of the journey in cash (hereinafter referred to as "compensation for the journey ').
(3) The student is entitled to reimbursement of travel expenses as a professional soldier on a business journey (13).
§ 14
Transport to medical facilities
The student shall be granted the carriage or reimbursement of travel expenses, as referred to in Article 12 (3), for a journey from the school to the health establishment of the health service provider designated by the medical professional of the medical establishment of the military health service provider and back, provided that such travel is directly related to the provision of urgent or acute health care or planned healthcare (14) for changes in the health status resulting from or directly related to the education of the pupil.
§ 16
Accommodation
(1) The student is provided with free accommodation in a youth home. If it is not possible to provide accommodation in a youth home, accommodation in another military accommodation facility or another operator's accommodation facility shall be provided; This does not apply if a pupil has been expelled from a youth home under Section 31 (2) of the Education Act.
(2) The accommodation referred to in paragraph 1 shall be granted in accordance with the internal rules of the youth home from the date of taking up school during the period of education or the day of occupation to the service of the professional soldier.
(3) Except for the days following the teaching day, accommodation referred to in paragraph 1 shall not be granted for:
(a) stays and trips outside the school place;
(b) school holidays;
(c) free days declared by the school director; or
(d) working days.
(4) The provisions of paragraph 3 (b) to (d) do not apply where a student participates in an action under § 3 (3) (b).
(5) For the period of practical training with the military department, the student is granted free accommodation by the military department.
§ 17
Incentive contribution
(1) A student who fulfils the conditions laid down in paragraph 2 is entitled to an incentive allowance. The incentive allowance shall be granted on a monthly or semi-annual basis.
(2) A monthly incentive contribution shall be granted by the school to the pupil in the calendar month in which he attended the course, depending on his study results in the preceding semester, provided that:
(a) the pupil has been classified from all subjects;
b) the pupil's behaviour has been assessed at a level 1 - very good,
(c) the student is not required to receive educational measures from a class teacher, school director or youth home director for breach of the obligations laid down in the school or internal rules of the youth home; and
(d) the pupil's absence from teaching has been excused in accordance with the school rules.
(3) The monthly incentive allowance is paid monthly for the period of school education
a) 3,000 CZK if the assessment of the results of the pupil's education in any subject is not higher than the classification level of benefit 3 - good and the average of the classification levels of benefit is not higher than 1.50,
b) CZK 2,000 if the assessment of the results of the pupil's education in any subject is not higher than the classification level of benefit 3 - good and the average of the classification levels of benefit is not higher than 2,00; or
c) 1000 CZK, if the assessment of student education results in any subject is not higher than the classification level of benefit 3 - good and the average of classification levels of benefit is not higher than 2.50.
(4) A half-yearly incentive allowance shall be granted by the school to the pupil in the half-year in which he attended the course, depending on his study results in the previous half-year, provided that the pupil has fulfilled the conditions laid down in points (a) to (d) of paragraph 2.
(5) The half-yearly incentive allowance shall be paid on a half-yearly basis, not later than 15 days after the end of the half-year referred to in paragraph 4, at the rate of CZK 3 000 if the assessment of the student's education results in any subject is not higher than the classification level of benefit 2 - commendable and the average of the classification levels of benefit is not higher than 1,50.
(6) In the case of a monthly incentive allowance, compliance with the conditions laid down in paragraph 2 (a) and (b) shall be determined for the preceding half-year of school education; compliance with the conditions laid down in paragraph 2 (c) and (d) shall be established for the preceding calendar month in which the teaching took place. In the case of a half-year incentive allowance, compliance with the conditions laid down in points (a) to (d) of paragraph 2 shall be determined for the previous half-year of school education.
(7) Where a pupil has been assigned a educational measure of a class teacher, school director or youth home manager for breach of the obligations laid down in the school rules or internal rules of the youth home, the school shall not grant him a monthly incentive allowance for a period of 3 calendar months for which he would otherwise be responsible, starting from the calendar month following the month in which the education measure became an obstacle to the provision of the monthly incentive allowance.
§ 17a
Incentive remuneration
(1) In order to achieve language competence according to NATO STANAG 6001, the school will provide the student with an incentive fee of
a) CZK 3,000 for the level of language competence SLP 2222, SLP 3333 and SLP 4444 from the English language, or
b) CZK 1,500 for the level of language competence SLP 1111, SLP 2222, SLP 3333 and SLP 4444 from other foreign languages established by the framework or school curriculum.
(2) The incentive remuneration referred to in paragraph 1 shall be granted to the pupil in the calendar month following the month in which the pupil reaches the specified level of linguistic competence.
§ 18
Refunds for actions abroad
When a pupil is involved in an event as referred to in § 3 (3) (b) which takes place abroad, the pupil shall be compensated as a professional soldier on a foreign business trip (5).
§ 19
Repeal
Decree No. 269 / 1999 Coll., on the scope, amount and manner of provision of natural and financial requirements for students of military secondary schools who are not in active service and who are continuously studying to perform the service of an occupational soldier, is hereby repealed.
§ 20
Efficacy
This Decree shall take effect on 1 April 2008.
