DECLARATION
of 8 April 2025
to implement certain provisions of the Act on the Conditions for the trading of greenhouse gas emission allowances
The Ministry of the Environment ("the Ministry ') provides, pursuant to § 3 (8), § 4b (5), § 15a (7) and 8 of Act No. 383 / 2012 Coll., on the conditions for trading greenhouse gas emission allowances, as amended by Act No. 481 / 2024 Coll., (" the Act'):
Subject matter
This decree regulates
(a) the detailed details, form and data structure of the application form for a greenhouse gas permit, including the model of the emission monitoring plan;
(b) details of the details, form and data structure of the application form for authorisation to supply fuels;
(c) details of the application for a fuel use certificate for non-incineration processes and the requirements for evidence of the amount of historical fuel consumption;
(d) the formalities and models of declarations of honour for demonstrating the consumption of gaseous fuels for agricultural primary production or forest management.
Application form for greenhouse gas permit
(1) The detailed details and data structure of the application form for greenhouse gas permit pursuant to Article 3 of the Act are set out in Annex 1 to this Decree.
(2) The application form referred to in paragraph 1 shall be submitted electronically in xls / xlsx format.
(3) The Ministry publishes on its website a model plan for monitoring greenhouse gas emissions.
Application form for authorisation to supply fuels
(1) The detailed details and data structure of the application form for authorisation to supply fuels pursuant to Article 4b of the Act are set out in Annex 2 to this Decree. The application form shall be submitted electronically in xls / xlsx format.
(2) The applicant shall accompany the form referred to in paragraph 1 with a draft of the emission monitoring and reporting measures provided for in Article 4b (2) (c) of the Act processed in the electronic system available on the Ministry's website.
Application for certification of fuel use in non-incineration processes
(1) The application for certification of the use of fuel for non-incineration processes, other than general administrative requirements, contains:
(a) an indication of the quantity and type of fuel consumed in the non-incineration processes over the previous three years or, if this information is not available, an indication of the expected annual quantity and type of fuel consumed for that purpose; and
(b) a description of the purpose and manner of use of fuels for processes where they are not incinerated.
(2) Further details on the application for certification are set out in Annex 3 to this Order.
Model of declaration of honour for demonstrating gas consumption for agricultural primary production or forest management
(1) The model of the customer's honest declaration of consumption of gas at the place of business for agricultural primary production or forest management under the Forest Act for customers with consumption in the previous year below 63 MWh is set out in Annex 4 to this Decree.
(2) The model of the customer's honest declaration of gas consumption only for agricultural primary production or forest management under forest law in the previous year is set out in Annex 5 to this decree.
(3) The declaration of honour referred to in paragraph 1 or 2 shall be made by the customer by means of an electronic system for the provision of specified information operated by the gas dealer, if the supplier has informed the customers on his website of this form of declaration of honour.
Repeal
Decree No. 192 / 2013 Coll., on the establishment of applications for allowances for aircraft operators and the issue of greenhouse gas emissions permits, is hereby repealed.
Efficacy
This Decree shall take effect on the day following that of its publication.
