of 21 March 2006
laying down principles for the definition of an emergency planning zone and on the scope and manner of drawing up an external emergency plan
According to Article 19 (4) of Act No. 59 / 2006 Coll., on the prevention of major accidents caused by selected hazardous chemicals or chemical preparations and amending Act No. 258 / 2000 Coll., on the Protection of Public Health and on the amendment of certain related acts, as amended, and Act No. 320 / 2002 Coll., on the amendment and repeal of certain acts in connection with the cessation of the activities of district offices, as amended, (Act on the Prevention of Major Accidents):
§ 1
Basic concepts
For the purposes of this decree:
(a) the reference number of the number assigned to the dangerous substance or to the sources of risk for the purpose of determining parameter R;
(b) parameter R minimum radius for setting the starting limit (§ 2 (3)).
Principles for defining an emergency planning zone
§ 2
(1) The emergency planning zone (1) is defined as the area bounded by the external boundary of the emergency planning zone (hereinafter referred to as "external borders"), with the exception of the territory for which the internal emergency plan is being processed.
(2) The external border is defined from the default border as the resulting boundary of the emergency planning zone set out in Section 4.
(3) The starting limit is the threshold for the determination of the external boundary of the emergency planning zone as set out in Annex 1 to this Decree.
§ 3
(1) The default limit is determined
(a) as a circle centred on the smallest circle inscribed around the floor projection of the building or equipment2), the specimen of which appears in Figures 1 and 2 of Annex 1 to this Regulation, the basis for its determination being the parameter R established in accordance with Annex 1 to this Regulation;
(b) using the highest parameter R, where the source of risk includes various hazardous substances (3),
(c) by increasing the parameter R with the radius of the smallest circle inscribed around the floor projection of the source of risk if this radius is greater than or equal to 1 / 5 of the parameter R; the pattern is shown in Figure 3 of Annex 1 to this Decree; or
(d) as the boundaries of the unification of more than one ground plan, determined in accordance with points (a) to (c), where one or more operators are located in the territory of the establishment or establishment for which the operator (4) processes an internal emergency plan, several sources of risk; the model is shown in Figure 4 of Annex 1 to this Decree.
(2) If the starting limit is equal to or less than the area of the area of the building or installation for which the operator processes the internal emergency plan, the emergency planning zone shall not be determined.
(3) If, in view of the characteristics, quantities and effects of a dangerous substance which do not correspond to the data contained in the table part of Annex 1 to this Decree, the starting limit cannot be determined in accordance with the procedure laid down in paragraph 2, the starting limit may be set in another equally reliable manner.
§ 4
(1) The external borders are adjusted at the resulting border according to local urban, field, demographic or climate conditions, or other factors of interest, taking into account the possibility of domino effect5).
(2) The emergency planning zone is indicated in the map base on a scale appropriate to the purpose of using the map base.
Scope and method of drawing up the external emergency plan
§ 5
(1) The scope and manner of drawing up the external emergency plan are set out in Annex 2 to this Decree.
(2) The basis for drawing up the external emergency plan is in particular:
(a) a demarcated emergency planning zone;
(b) the supporting documents drawn up by the operator of the building or installation included in Group B, in particular the security report6) and the written supporting documents of the operator 7);
(c) the supporting documents provided by the public authorities concerned; and
(d) the comments of the public, the public authorities concerned and the municipalities concerned on its proposal.
§ 6
Efficacy
This Decree shall take effect on 1 June 2006.

Method of determining parameter R and patterns of methods of establishing default limit using parameter R
I. Method of determining parameter R
(a) List of activities and an overview of the types of hazardous chemicals, their quantities and location
Information shall be collected on all facilities with hazardous substances (8), routes and modes of transport of dangerous substances. The activities presenting an increase in risk for the population (examples in Table 2) shall be identified with further information needed for their classification by physical, chemical, technical and technological characteristics and conditions; a list of dangerous substances and dangerous activities, hereinafter referred to as "the list ', shall be drawn up after their classification. This is based on the operator's documentation - supporting documentation for the establishment of the emergency planning zone and for the processing of the external emergency plan, safety reports (in particular risk analysis) and the internal emergency plan.
(b) Assessment of quantities of substances
An estimate of the maximum amount of dangerous substances or dangerous substances that may be involved in a major accident in real conditions shall be made for each installation. It is based on the design dimensions of individual parts of the technological nodes and the greatest load capacity or volume of service trucks, tankers, railway wagons etc. If the installation has sufficient physical or effective separation between storage tanks of dangerous substances, only the maximum quantity in the largest tank shall be considered when estimating the leakage quantity. The distance between tanks avoiding domino effects caused by fire, explosion or collapse of any part of the equipment under consideration shall be considered as physical separation. The existence of separate sinks on individual tanks with sufficient distance between the edge of the pit and other tanks or the use of automatic safety fittings on connected tanks' pipelines or mechanical barrier between tanks shall be considered as effective separation. The use of open connection between tanks or the use of manually operated fittings is not considered to be sufficient physical or effective separation. The estimated maximum quantities shall be added to the list of individual hazardous substances.
(c) Assignment of reference numbers to hazardous substances, sources of risk
In the list referred to in point (b), taking into account their type and known physical conditions, all hazardous substances shall be assigned a reference number in accordance with Table 1 and it shall be verified that they comply with the reference number of the same substance assessed at the same time as the type of activity and the nature of the technology referred to in Table 2 and, where appropriate, the reference number obtained taking into account the type and description of the substance in relation to the type of activity referred to in Table 4. Where a single reference number cannot be clearly assigned from Tables 1, 2 and 4 to the assessed source of risk or activity or to a dangerous substance, two or more possible reference numbers shall be entered in the list and the next procedure shall be carried out according to all those numbers.
(d) Toxicity class and alternative determination
The toxicity class means the property of a dangerous substance defined by the calculation of the calculation number (a) in Table 1a and the calculation number (b) in Table 1b of Annex 1 to this Decree. If the toxicity of a dangerous substance not listed in Table 1 is assessed, its toxicity class for the purpose of this procedure may be determined according to the following auxiliary rules and using Tables 1a to 1c:
1. If the saturated vapour pressure is less than 0,1 MPa at 20 ° C, the substance shall be considered a liquid.
2. If the saturated vapour pressure is greater than 0,1 MPa at 20 ° C, the substance is considered to be a gas.
3. From the sum of the calculation number (a) derived from the LC50 according to Table 1 and the calculation number (b) derived from the physical properties according to Table 1b, the requested toxicity class is obtained using Table 1c.
(e) List reduction
Dangerous activities which do not pose a direct threat to the damage to the population due to the distance of populated areas may be excluded from the list. The list reduction shall be carried out in accordance with the criteria set out in Table 3.
(f) Repeating or stopping the method of determination
If, following a reduction in the list, it is clear that there is a source of risk in the area under consideration with a single isolated installation without any link to other hazardous activities, the area of the territory under consideration will increase twice and a new list will be established; If this is not appropriate because there is no additional source of risk in the territory thus enlarged, the next procedure shall be terminated. Further progress shall be made in accordance with Section 3.
g) Assignment of R parameters to list items
The corresponding R parameters shall be assigned to each reference number included in the list using Tables 4 and 4a or Table 4b and the known quantity of substances in tonnes estimated in accordance with point (b). If Table 4a contains a capital letter X instead of the numerical value of the parameter, the combination of the substance and its quantity, which in practice does not exist or cannot exist. However, if such a value is achieved, parameter R corresponding to twice the nearest quantified value of parameter R of the same substance or expert estimate shall be used. If the table contains a symbol (-), the effects of the substance are negligible.
(h) Determination of parameter R
If a single R value has been assigned to an item in the list, the R value shall be considered as the determined value of the R parameter according to § 3 (1) (a). Where more than one reference number has been assigned to one substance or hazardous activity in accordance with point (c) of this procedure and thus has been obtained for one entry in the list of multiple R values, for the purposes of Paragraph 3 (1) (a) of this Decree, the largest of these values shall be determined as the R parameter.

Scope and method of drawing up the external emergency plan
The external emergency plan contains a text and graphic section. The text section contains information and operational information and plans for specific activities. The graphical part is used for displaying basic information in the text section and contains maps 9), graphs, diagrams, deployment of forces and means, deployment methods and so on.
The territory of the emergency planning zone may be divided into two or more sectors and their sections for the purpose of addressing a major accident of a risk source. Depending on the direction or manner of spreading the effects of the leaking hazardous substance and the monitoring results, the protective measures provided for in the external emergency plan shall be applied in these sectors (their sections). The relevant measures shall be processed according to the specific characteristics of the hazardous substance and the scenarios for its action outside the risk source of the accident for each sector. In the immediate vicinity of the source of risk or near the point of penetration of the substance into the water stream, and similarly, appropriate and pre-determined measures, regardless of the extent of the spread of hazardous substances in the accident and the results of the monitoring of the situation ("emergency measures'), will generally be applied. The precise course of sectoral borders will be adapted to local urban, terrain, demographic and climate conditions, or other factors of interest.
Safeguard measures shall be planned in the form of specific action plans for the relevant parts of the emergency planning zones, their selection and the way in which they are processed shall be chosen in proportion to the size of the zone and the nature of the threat.
The external emergency plan shall be divided into:
A. Information
The information part contains:
(a) identification of the operator, description of the objects or equipment, identification of the source of risk;
(b) the characteristics of the territory of the emergency planning zone, in particular geographical, demographic, climatic, hydrogeological and infrastructure description;
(c) the definition of the emergency planning zone;
(d) housing units in the emergency planning zone, including an overview of the population;
(e) a description of the organisation structure of emergency preparedness in the emergency planning zone, including an indication of the competence of its constituents;
(f) the supporting documents transmitted to the Regional Authority by the operator in a specified manner;
(g) the list and characteristics of the major accident effects considered by the processed risk analysis, including a description of their expected impacts (e.g. domino effect);
(h) basic information on the effect of a dangerous substance on the human organism and the initial simple diagnostic method for detecting the impact;
(i) a list of all internal emergency plans of the risk managers.
For the processing of the parts referred to in points (b) to (d), the emergency plan of the countries10 shall be used.
B. Operational part
The operational part shall provide an overview of the measures prepared, which shall be carried out after having been informed of the suspected or the occurrence of an accident by the operator. It shall develop the solutions to the individual measures, depending on the expected situation and its expected time sequence, including agreements on the security tasks of individual administrations in implementing urgent measures. The implementation of individual measures shall be ensured according to the plans for specific activities, depending on the nature of the accident.
The operational part contains:
(a) the tasks of the competent administrative authorities, the components of the integrated rescue system and, where appropriate, the other administrative authorities concerned, including the tasks, forces and resources of other natural and legal persons in an accident;
(b) the way in which a major accident is coordinated;
(c) criteria for the possible announcement of corresponding emergency situations where the external emergency plan is clearly insufficient;
(d) means of ensuring information flows in the management of rescue and disposal operations;
(e) the principles of action in extending or extending the impact of an accident outside the emergency planning zone and the system of connection and cooperation of the administrations concerned.
C. Plans for specific activities
In particular, a plan shall be drawn up for specific activities to carry out rescue and disposal operations in the emergency planning zone:
(a) notification,
(b) warning of the population;
(c) the cover of the population;
(d) rescue and disposal operations;
(e) evacuation of persons;
(f) individual protection of the population;
(g) decontamination;
(h) monitoring;
(i) regulation of movement of persons and vehicles
(j) trauma;
(k) veterinary measures;
(l) preventing the distribution and consumption of food, feed and water contaminated by a dangerous substance;
(m) preventive measures to prevent or limit the domino effect of the accident;
(n) mass death measures;
(o) measures to minimise impacts on environmental quality;
(p) ensuring public order and security;
(q) communication with the public and mass information means;
(r) the management of waste arising from a major accident.
Notification
A notification plan shall be drawn up for the purpose of notification containing:
(a) the names and names of the ingredients concerned, addresses and means of contact to:
1. operational centres operating within the territory of the region;
2. the relevant authorised staff of the Regional Office, the extended municipal authority concerned and the municipal office concerned, whose administrative districts are the premises of the operator;
3. the relevant staff of the other components of the integrated rescue system,
4. other regional or municipal authorities operating in the emergency planning zone and the operational centres concerned on their territory, or, where appropriate, other regional or municipal authorities concerned by the planned measures;
5. Other territorial administrations concerned,
6. the national central administrative offices and operational centres concerned,
7. legal persons and business natural persons in the emergency planning zone
(b) the necessary extract from the operator's notification system or a description of the means of notification provided by the operator.
The notification plan shall specify, for each intervening component of the integrated rescue system and authorised personnel of regional and other administrative authorities, the essential activities carried out after the notification (e.g. alarm announcement, collection security).
Population warning
A population warning plan shall be prepared for the purpose of warning the population, based on evidence of an operator-guaranteed warning, and shall include:
(a) the chosen way of warning the population, including the provision of emergency information;
(b) ensuring the implementation of the chosen method by organisational and technical mechanisms;
(c) an alternative way of warning the population.
Hiding the population
For cover purposes, the principles for cover shall be developed, which include:
(a) ways of using the protective properties of buildings in the emergency planning zone;
(b) principles for the behaviour of the population in hiding.
Rescue and disposal operations
For the purpose of the occupation of pre-determined forces and means, an alert plan for the integrated rescue system of the county (11) shall be used.
A deployment plan shall be drawn up for the deployment of pre-determined forces and resources, which shall include in particular:
(a) specific possible deployment;
(b) the tasks performed;
(c) the procedure for managing the intervention;
(d) material, technical and medical security of the components of the integrated rescue system.
Evacuation of persons
An evacuation plan shall be prepared for the evacuation of persons in the event of a major accident. The evacuation plan shall include in particular:
(a) a list of the forces and means to ensure evacuation;
(b) the manner in which they are informed, equipment, preparation and occupation;
