of 21 March 2013
amending Act No. 361 / 2000 Coll., on road traffic and amending certain laws (Road Traffic Act), as amended
Parliament has decided on this law of the Czech Republic:
Amendment of the Road Traffic Act
Act No. 361 / 2000 Coll., on the operation of roads and on amendments to certain laws (Act on Road Traffic), as amended by Act No. 60 / 2001 Coll., Act No. 478 / 2001 Coll., Act No. 62 / 2002 Coll., Act No. 311 / 2002 Coll., Act No. 133 / 2002 Coll., Act No. 436 / 2003 Coll., Act No. 264 / 2008 Coll., Act No. 480 / 2005 Coll., Act No. 170 / 2007 Coll., Act No. 215 / 2007 Coll., Act No. 374 / 2007 Coll., Act No. 264 / 2006 Coll., Act No. 264 / 2006 Coll., Act No. 342 / 2006 Coll.
1. In Paragraph 87 (3), "60, 'is deleted.
2. Paragraph 87a (3) reads as follows:
"(3) A traffic psychological examination shall be submitted to the person requesting the return of a driving licence which has been revoked as a result of:
(a) reaching a total of 12 points in the driver score,
(b) the court-ordered penalty for the prohibition of activities involving the prohibition of driving;
(c) a penalty imposed by the administrative authority to prohibit the operation of motor vehicles where such a penalty has been imposed for at least 6 months; or
(d) conditional suspension of the application for punishment or suspension of a criminal prosecution during whose probationary period it has undertaken to refrain from driving motor vehicles. ";
3. Paragraph 87a (7) reads:
"(7) The cost of the transport psychological examination of the persons referred to in paragraph 1 shall be borne by the employer for persons in the employment relationship. For persons referred to in paragraph 1 who are not in an employment relationship, and for persons referred to in paragraph 3, the costs of the transport psychological examination shall be borne by such persons. ';
4. In Paragraph 102, the following paragraph 6 is added:
"(6) The applicant must demonstrate medical fitness if he requests the return of a driving licence which he has lost as a result of
(a) the court-ordered penalty for the prohibition of activities involving the prohibition of driving;
(b) a penalty imposed by the administrative authority to prohibit the operation of motor vehicles where such a penalty has been imposed for at least 6 months; or
(c) conditional suspension of the application for punishment or suspension of a criminal prosecution during whose probationary period he has undertaken to refrain from driving motor vehicles. "
5. In Article 137 (3), "§ 88 (7) 'is replaced by" § 88 (6)';
Efficacy
That law shall take effect on the first day of the third calendar month following its publication.
