amending Act No. 115 / 2000 Coll., on the granting of compensation for damage caused by selected specially protected animals, as amended
Parliament has decided on this law of the Czech Republic:
Amendment of the Act on compensation for damage caused by selected specially protected animals
Act No. 115 / 2000 Coll., on the granting of compensation for damage caused by selected specially protected animals, as amended by Act No. 476 / 2001 Coll., Act No. 320 / 2002 Coll., Act No. 130 / 2006 Coll., Act No. 227 / 2009 Coll. and Act No. 197 / 2017 Coll., is amended as follows:
1. In Article 1 (1), the words "and compensation for damage caused in 2018, 2019 and 2020 by cormorants (Phalacrocorax carbo L.) on fish 'shall be inserted after the brackets.
2. in paragraph 2, point (b) is replaced by the following:
3. In Article 5 (1), the sentence "In the event of damage to fish caused by a cormorant in 2018, 2019 and 2020, compliance with the condition that the animal was specifically protected under a specific legislation at the time of the damage is not required. 'is added at the end of paragraph.
4. In Article 7, the following paragraph 5 is added:
"(5) In the event of damage to fish caused by a large cormorant, the compensation shall be granted on the basis of an assessment referred to in paragraph 4, amounting to:
(a) 100% of the evidence of damage caused in 2018 and 2019;
(b) 80% of the proven damage if it is caused in 2020. ';
Transitional provision
In the event of damage to a cormorant fish during the period from 1 January 2018 to the date of entry into force of this Act, the injured party shall submit a request for compensation to the competent authority no later than 6 months after the date of entry into force of this Act.
Efficacy
This Act shall take effect on the day of its publication.
