on the admission of pupils and other applicants to study in secondary schools established by the State
The Ministry of Education, Youth and Sports provides for Act No. 29 / 1984 Coll., on the System of Primary Schools, Secondary Schools and Higher Vocational Schools (Education Act), as amended by Act No. 171 / 1990 Coll. and Act No. 138 / 1995 Coll., and pursuant to § 13 (h) of the Czech National Council Act No. 564 / 1990 Coll., on State Administration and Self-Government in Education, as amended by Act No. 139 / 1995 Coll.:

ACCEPTANCE OF REQUESTS AND OTHER ADJUSTMENTS TO THE DETAILED STUDIES IN CENTRAL SCHOOL
§ 1
Login to daily study
(1) A student of a school in which he performs compulsory schooling (hereinafter referred to as "pupil") or another candidate (hereinafter referred to as "applicant") shall submit an application for study in a prescribed form (1) published in the Bulletin of the Ministry of Education, Youth and Sports of the Czech Republic (hereinafter referred to as "the application"), in which he may indicate not more than two secondary schools in the order of his interest, except for pupils applying to the first year of the eight or six-year-old gymnasium, or eight-year-old dance conservatory, who may mention only one secondary school.
(2) The applicant submits an application or two copies of the application, if two secondary schools, to the principal of the school in which he carries out compulsory schooling, by the end of February. The principal of the school shall send the application to the principal of the secondary school or to the directors of the secondary school which are indicated in the application by 15 March.
(3) The applicant shall submit an application or two copies of the application if he applies to two secondary schools, to the principal of the secondary school or to the directors of the secondary school which are listed in the application by 15 March.
(4) A student who is a compulsory school student in a foreign school and is a citizen of the Czech Republic will submit an application to the Director of the School in the Czech Republic in whose state it is conducted. 2)
(5) A citizen of the Czech Republic who has completed compulsory schooling in a foreign school or a foreigner, 3) who has completed or completed compulsory schooling in a foreign school, is considered to be a candidate for the purposes of applying for a study.
(6) A stranger who performs compulsory schooling in the Czech Republic is considered to be a pupil for the purposes of applying for studies. A stranger who has completed compulsory schooling in the Czech Republic is considered to be a candidate for the purposes of applying for study.
(7) The student or tenderer shall add to the application:
(a) a decision on a changed working capacity in the case of a changed working capacity;
(b) a medical certificate of disability and a recommendation of an appropriate procedure for carrying out the entrance examination if appropriate conditions for the examination are required (Section 4 (2));
(c) the recommendation of the pedagogical-psychological counselling and, where appropriate, the teaching centre (4) on the appropriate procedure for the entrance examination, in the case of a person with a proven specific learning disability;
(d) a document showing a residence permit on the territory of the Czech Republic, (3) in the case of foreigners;
(e) a certificate of equivalence of a certificate issued by a foreign school or a certificate of education provided by a novification clause according to a special regulation, 5) when a citizen of the Czech Republic or a stranger who has completed compulsory schooling in a foreign school,
(f) on the basis of a communication from the Director of the secondary school of the medical opinion, (6) in the field of study or teaching for which such assessment is necessary;
(g) an officially certified copy of the certificate of the last two years of the school in which compulsory schooling has been completed, unless the classification from those years on the application has been verified by that school; in the case of certificates issued in a non-Czech language, also their official translation into the Czech language,
(h) any other documents relating to the recruitment procedure, in particular documents relating to the educational attainment, 6a) results in professional competitions and publication activities; in the case of documents drawn up in a language other than the Czech language, their official translation into the Czech language.
(8) If a student or candidate applying for admission to the field of study or teaching is to prepare for a natural or legal person authorised to do business, the application shall be accompanied by a certificate of that fact.
Admission to study
§ 2
(1) The criteria for assessing the ability, knowledge, interests and medical fitness of a pupil or candidate shall be determined by the Director of a secondary school; the conditions of medical fitness of the pupil or candidate, if they are included in the teaching documentation of the relevant field of study or teaching, shall be assessed on the basis of the opinion of the physician. At the same time, when admitted to the first year of secondary school, the Director of the secondary school is based on valid teaching documents for schools in which compulsory schooling is carried out, in so far as it is not for admission to the superstructure study.
(2) Admission examinations for the schools referred to in the application, if established by the Director of the secondary school, shall take place on the first working day of the last full calendar week of April with five working days.
(3) Admission examinations for secondary schools referred to in the second place application, if established by the Director of the secondary school, shall take place not earlier than the first working day after 30 days after the deadline laid down in paragraph 2.
(4) In justified cases, the Director of the secondary school may decide to extend the duration of the admission examinations to working days immediately following the deadline set for the admission examinations.
(5) The replacement period for the entrance examination shall be determined by the Director of the secondary school only by the pupil or tenderer who, for duly substantiated serious reasons for the admission examinations, will not appear within the specified time limit and will excuse his non-participation in the secondary school no later than three days after the deadline set for the admission examinations.
(6) The invitation to take the entrance exam shall be sent by the principal of the secondary school to the student or tenderer no later than 14 days before the examination. The invitation shall include information on the requirements for the admission test, 7a) including the method of demonstrating talent, the criteria laid down in paragraph 1.
(7) If the Director of a secondary school decides not to take the entrance examinations, he shall inform the student, candidate or legal representative of the minor or tenderer without delay.
(8) If, except for pupils applying for the first years of the eight-year and six-year high school and the eight-year conservatory in the field of dance, 8) or the candidate is not admitted to study, he may submit an application to secondary schools which have not completed the envisaged conditions within the time limit set for admission to study under paragraph 2 or paragraph 3. In this case, the principal of the secondary school shall issue the application form at his request to the student or tenderer, or their legal representative, if they are minors.
(9) The Director of the secondary school shall, within the criteria laid down in paragraph 1, leave part of the places for the admission of pupils and tenderers within the time limit laid down in paragraph 3.
§ 3
The student or candidate admitted to study in the school referred to in the application in the first place shall not attend the entrance examinations in the secondary school referred to in the second place. The principal of the secondary school referred to in the application shall first inform the student or candidate of the principal of the secondary school referred to in the application in the second.
§ 4
Specific conditions for admission to study
(1) A pupil or tenderer who is a person with a changed working capacity and who is fit for the study of the chosen field of study or teaching shall be accepted in preference to other pupils or tenderers if he or she equally complies with the criteria for admission to study.
(2) The principal of the secondary school shall ensure appropriate conditions for pupils or applicants with disabilities to carry out the entrance examination if the entrance examination is held.
(3) If the application is accompanied by a recommendation from the pedagogical / psychological advisory or, where appropriate, a special teaching centre pursuant to § 1 (7) (c), this recommendation shall be taken into account in the entrance examination, if any.

ALLOCATION AND ACCESS TO A STUDY AT EMPLOYMENT OR INTRODUCTION STUDIES
§ 5
(1) A candidate who has completed compulsory schooling may apply to study at work9).
(2) A secondary school pupil or a candidate who has received a secondary vocational education in the field of teaching provided for by the special legislation10a may apply to the extension studies10). A secondary school pupil admitted to a secondary school shall submit proof of successful completion of the final examination before starting the studies. The applicant shall attach to the application proof of successful completion of the final examination.
(3) The application for study at work or for extension studies shall be submitted on the prescribed form, (1) with the annexes referred to in § 1 (7) and (8) to the principal of the secondary school, which shall appear in the application, by 20 March.
(4) If the Director of a secondary school decides to take an entrance exam for the study at work or for the extension study, he shall proceed in accordance with Sections 2, 4 and 6.

§ 6
(1) The application for admission to a higher secondary school shall be submitted by the student or candidate to the principal of the secondary school to which he / she applies, using form (1) of the applications with annexes referred to in Sections 1 (7) and (8).
(2) The term, duration, content and form of the examination and the year to which the pupil or tenderer will be classified shall be determined by the Director of the secondary school to which the pupil or tenderer applies. The acceptance test shall be based on the content of the corresponding part of the teaching documents of the relevant study or teaching sector.

COMMON AND FINAL PROVISIONS
§ 7
(1) The principal of a secondary school with a stranger who has received a previous education at a foreign school and who attaches to the application the document or certificate referred to in § 1 (7) (d) and (e) shall verify the knowledge of the Czech language by interview.
(2) The order of admission and non-admission of pupils or tenderers and the criteria for the assessment of the entrance examination shall be published by the Director of the secondary school within five days of the date of the entrance examination in the school building in writing, including, where appropriate, electronic form, in a manner consistent with a specific legislation. 12)
(3) The number of vacancies for appeal procedures shall be determined by the Director of the secondary school.
§ 8
(1) The Director of the Secondary School shall forward to the Regional Office, together with the criteria under which he followed the admission procedure to the secondary school.
(2) If the Regional Office accepts an appeal against a decision not to accept a pupil or a candidate to the school referred to in the first place, it shall also inform the Director of the secondary school, which the student or tenderer indicated in the second place in the application.
(3) In the event that the Regional Office does not comply with the appeal against a decision not to accept a pupil or a candidate to study, it shall inform the pupil or tenderer or, where appropriate, his legal representative of secondary schools in its territory which did not fill the intended conditions of pupils or tenderers in the admission procedure for secondary school studies. The Regional Authority, based on the documents provided by the directors of the relevant secondary schools, after the deadline laid down in Section 2 (3), publishes information on the vacancies in secondary schools within the area.
(4) If the student or tenderer or, where applicable, his legal representative does not appeal to a decision not to accept a study or is not accepted at the time of the appeal, the principal of the secondary school shall return the application, including the annexes required under § 1 (7) and (8) of the pupil or tenderer or, where applicable, his legal representative only if he so requests.

This decree applies to the admission of pupils and other applicants to study in secondary schools also established by the county, as well as secondary schools established by municipalities pursuant to § 14 (7) of Act No. 564 / 1990 Coll., as amended by Act No. 132 / 2000 Coll. and Act No. 284 / 2002 Coll.
§ 10
This decree shall take effect on the day of its publication.
