Constitutional Law on the State Defence Council

CONSTRUCTION LAW
of 31 January 1969
on the State Defence Council
The Federal Assembly of the Czechoslovak Socialist Republic decided on this constitutional law:
§ 2
A State Defence Council is hereby established.
§ 3
(1) The Council of State Defence sets out the guidelines for the preparation and organisation of the defence of the Czechoslovak Socialist Republic and makes provision for this. To that end
(a) determine the basic concept of the construction of the CSSR and, in particular, the construction of the armed forces;
b) approves the basic arrangements for the preparation of state bodies and economies in the Czech and Slovak Federal Republic in the event of war;
(c) propose to the government, after consulting the competent central authorities, the basic proportion of the economic security of the construction of the CSSR defence system, while ensuring that the defence funds are spent economically and effectively;
(d) approve the basic concept of the CSSR's operational defence plan;
(e) propose to the competent constitutional authorities the measures necessary to manage the State in the event of war;
(f) draw conclusions from the military political evaluation of international relations and on this basis propose to the competent constitutional bodies international legal security in the interests of defence of the CSSR, or other measures resulting from the international obligations of the CSSR;
(g) in cases of threat to the CSSR, the external enemy shall take measures to increase the state's preparedness for defence before declaring war or denouncing war;
(h) decide during the war on measures relating to the conduct of the war.
(2) In order to implement its decisions pursuant to paragraph 1, the State Defence Council shall be entitled to lay down binding tasks for federal ministries, federal committees and other federal central authorities of the state administration and the Councils of Defence of the Republics.
(3) State Defence Council
(a) report to the Federal Assembly on the preparation and state of defence of the CSSR and on its major measures and recommends to it the measures it considers necessary and effective;
(b) may require from the competent authorities reports and proposals on the preparation and organisation of the CSSR defence.
§ 4
(1) In the event of a sudden attack on the CSSR by an external enemy that will prevent the activities of the Bureau of the Federal Assembly or the Government of the CSSR for a certain period of time, the Defence Council of the State shall take the necessary and urgent measures to defend those authorities. At the same time, the State Defence Council shall determine how they are to be declared.
(2) If the Federal Assembly, its Bureau or the Government of the CSSR does not agree at its next meeting to a measure of the State Defence Council issued pursuant to paragraph 1, such measure shall cease to apply.
§ 5
(1) The State Defence Council is composed of the President, the Vice-President and a further 4 to 8 members.
(2) The President, Vice-President and other members of the Defence Council of the State is hereby appointed and dismissed by the President of the Czechoslovak Socialist Republic.
(3) The President of the Czechoslovak Socialist Republic will call off the President, Vice-President and other members of the State Defence Council, if proposed by a House of the Federal Assembly; Article 43 (2) and (3) of the Constitutional Law on the Czechoslovak Federation shall apply mutatis mutandis to the vote on the proposal.
(4) Meetings of the State Defence Council shall be attended by the Chairs of the Defence and Security Committees of the House of People and the House of Nations of the Federal Assembly.
§ 6
The State Defence Council and its members shall be responsible for their duties to the Federal Assembly.
§ 7
(1) The President of the State Defence Council directs the work of the State Defence Council. It shall have the right to attend meetings of the Government and to express its views in terms of State defence on the proposals under discussion.
(2) The Secretary of the Defence Council of the State is the Director of the Defence and Security Department of the Office of the Government of the Czech and Slovak Federal Republic and the Secretariat is the Ministry of Defence and Security of the Government of the Czech and Slovak Federal Republic.
§ 8
The President of the Czechoslovak Socialist Republic, as Commander-in-Chief of the Armed Forces, has the right to request, attend and preside over the meetings of the Defence Council of the State. It also has the right to propose to the State Defence Council appropriate measures to defend the CSSR, to request and discuss reports from the President of the State Defence Council and its individual members, which tasks should be addressed.
§ 9
(1) The Czech Socialist Republic establishes the Council of Defence of the Czech Republic and the Slovak Socialist Republic establishes the Council of Defence of the SSR.
(2) The President, Vice-President and other members of the Defence Council of the Republic shall be appointed and removed by the President of the State Defence Council.
(3) The Council of Defence of the Czech Socialist Republic and its members are also accountable to the Czech National Council for their duties. The Defence Council of the Slovak Socialist Republic and its members are also accountable to the Slovak National Council for their duties. The President of the State Defence Council shall remove the President, Vice-President and members of the Defence Council of the Republic, if proposed by the National Council.
(4) The Council of Defence of the Czech Republic and the Council of Defence of the Slovak Republic are entitled to lay down binding tasks to the ministries and other central authorities of the Republics and the Defence Councils established in the Republics.
§ 10
(1) The Defence Council of the Czech Republic and the Defence Council of the Slovak Republic are established in Prague, Bratislava and in districts and cities.
(2) The President, the Vice-President and the other members of these Councils shall be appointed and removed by the Chairman of the Defence Council of the Republic concerned.
§ 11
The powers of the federal authorities, the Councils of Defence of the Republics and the Councils of Defence referred to in Article 10 (1), as well as those of the other authorities of the Republics and of the relevant territorial authorities of the State in the provision of defence tasks shall be governed by the Federal Assembly Act. The approval of this law shall be carried out in accordance with Article 42 (1) of Constitutional Act No. 143 / 1968 Coll., on the Czechoslovak Federation.
§ 12
(1) In order to defend and prepare the Czechoslovak Socialist Republic, the State authorities designated by the Federal Assembly Act, if it is urgently necessary and to the extent necessary, may require any synergy and means of action and impose restrictions and benefits.
(2) Organisations designated by the Federal Assembly Act are required to conduct preparations for their activities during the war and are responsible for carrying out defence tasks in peace and war.
(3) The conditions and scope of the obligations referred to in paragraphs 1 and 2 are laid down in the Federal Assembly Act.
§ 13
This Act shall take effect on 1 March 1969.
