DECLARATION
of 21 December 2015
amending Decree No. 238 / 2011 Coll., laying down health requirements for swimming pools, saunas and sanitation limits for sand in outdoor playing areas, as amended by Decree No. 97 / 2014 Coll.
According to Article 108 (1) of Act No. 258 / 2000 Coll., on the Protection of Public Health and on the Amendment of Certain Related Acts, as amended by Act No. 274 / 2001 Coll., Act No. 274 / 2003 Coll., Act No. 392 / 2005 Coll., Act No. 222 / 2006 Coll., Act No. 151 / 2011 Coll. and Act No. 223 / 2013 Coll., ("the Act ') for the implementation of § 6c (2), § 6f (3) and § 18 (3) Act:
Decree No. 238 / 2011 Coll., laying down the hygiene requirements for swimming pools, saunas and sanitation limits of sand in sandboxes of outdoor playing areas, as amended by Decree No. 97 / 2014 Coll., is amended as follows:
1. At the end of § 24, the sentence "The frequency requirements are set out in Annex 9 to this Decree. 'is added.
2. In Annex 6, in the chapter on "WATER DANGEROUS ON COUPLING ', the sentence" Repeatedly exceeded the value for at least one of the microbiological indicators referred to in Section 9 (7)' is deleted.
3. Annex 9 shall read as follows:

Explanatory notes:
1. Control of indicators to be determined daily on the spot (pH, free chlorine or other disinfectant, bound chlorine, chlorites, chlorates, redox potential, temperature of water and air, transparency) or to be determined on the spot by means of a portable spectrophotometer and commercially manufactured sets (nitrates, opacity) may not be required by the operator to provide an authorised laboratory, accredited laboratory or laboratory holding a certificate of the proper functioning of the laboratory. The determination of these indicators shall be performed according to the manufacturer's instructions for measuring devices and the functionality of the measuring device shall be regularly verified. The operator shall perform, once a month for the holder of the certificate referred to in Article 6c (1) (a), the determination of the indicators free and bound chlorine, opacity, pH, nitrates, TOC, chlorites, chlorates, or ozone.
2. The frequency of opacity and nitrate controls may be reduced to once a month if the pool is discharged daily and infused with water.
3. Applies to swimming pools, swimming pools operated by persons providing care and swimming pools with a natural healing source with a water temperature up to 28 ° C. If aerosols such as bubble whirlpools, waterfalls, geysers, fountains, neck showers, etc., are not installed in the pool, an examination shall be carried out for the presence of legionel only in the water at the pool inflow.
4. Applies to bath pools, swimming pools operated by caregivers and pools with a natural healing source with water temperatures above 28 ° C. If aerosols such as bubble whirlpools, waterfalls, geysers, fountains, neck showers, etc., are not installed in the pool, an examination shall be carried out for the presence of legionel only in the water at the pool inflow.
5. In the case of continuous measurement of the disinfectant, pH, redox potential and automatic regulation of pH adjustment and dosing of the disinfectant, or in the case of a pool being discharged daily and infused with water, the frequency of control of microbiological indicators and TOC per month may be reduced in the case of 5 consecutive suitable microbiological findings.
6. Applies if aerosols such as bubble whirlpools, waterfalls, geysers, fountains, neck showers are installed in the pool In the case of continuous measurement of the disinfectant, pH and redox potential and automatic regulation of pH adjustment and dosing of the disinfectant, the frequency of control may be reduced to once monthly for 5 consecutive satisfactory microbiological findings.
7. This indicator is not mandatory, it is a recommended indicator which is an appropriate tool for the current monitoring of the load of pool water by organic substances (TOC) by operators, especially in the case of continuous measurement. The recommended A254 (1 cm) of pool water is equal to 0,02 above the filling water.
4. In Annex 10, Chapter "Water quality control in the pool ', including the title:
"Water quality control in the pool
1) Before commencing operation, the operator shall verify the temperature of water and air to meet the needs of children's age.
2) The pool operator regularly checks the quality of the water in the pool. The frequency and scope of the check depends on the type of swimming pool and the mode of operation.
3) In the case of portable vans and pools which are emptied, cleaned, rinsed and infused after each infant (child under 12 months) or group of infants, the temperature and transparency of the water after each start shall be checked. Only drinking water or hot water, made of drinking water, can be used for filling.
4) For other pools with recirculation or continuous replacement of water which are not emptied after each group of infants or toddlers (children over 12 months of age), the same water quality and control requirements as apply to bath pools in accordance with Annex 8, 9 and 11 (except for free chlorine, which should range from 0,2 to 0,4 mg / l).
5) Water samples for inspection shall be taken during operation, not earlier than 1 hour after its commencement. If the teaching hour lasts less than an hour, a sample shall be taken before its completion. ';

1) Sampling shall be carried out 20 cm above the water level of the pool; if not technically possible, at a height of 150 cm above the water level. The monitoring frequency shall be chosen by the pool operator on the basis of local conditions as appropriate (results of previous determinations, measured values of bound chlorine, seasons, etc.). ';
Efficacy
This decree shall take effect on the 15th day following its publication.
