THE LAW

of 3 December 2003

amending Act No. 47 / 2002 Coll., on the Promotion of Small and Medium Enterprises and amending Act No. 2 / 1969 Coll., on the Establishment of Ministries and other Central Authorities of the Government of the Czech Republic, as amended

Parliament has decided on this law of the Czech Republic:

Čl. I

Act No. 47 / 2002 Coll., on the promotion of small and medium-sized enterprises and amending Act No. 2 / 1969 Coll., on the establishment of ministries and other central bodies of the Czech Government, as amended, is amended as follows:

1. the following Section 4a is inserted after Section 4, including footnotes 3a) to 3c):

„§ 4a

(1) The CzechInvest Enterprise and Investment Support Agency (hereinafter referred to as "the Agency") is hereby established as a state-owned contribution organisation. The Agency shall have the right to manage the property of the State and shall be governed by special laws in its activities. 3a) The Agency is subordinate to the Ministry of Industry and Trade (hereinafter referred to as the Ministry).

(2) The statutory body of the Agency shall be the Director-General appointed and removed by the Minister for Industry and Trade. The closer conditions of the Agency's activities and its organisational arrangements shall be laid down in the Statute approved by the Minister for Industry and Trade.

(3) The Agency shall carry out business support tasks by:

(a) provide support to small and medium-sized enterprises under this Act;

(b) provide support to entrepreneurs on the basis of programmes approved by the Government under a special law, 3b)

(d) carry out other business support tasks.

(4) The Agency also provides support to entrepreneurs from European Union funds.

3a) Act No. 219 / 2000 Coll., on the property of the Czech Republic and its representation in legal relations, as amended. Act No. 218 / 2000 Coll., on budgetary rules and amending certain related laws (budgetary rules), as amended.

3b) For example, Act No. 218 / 2000 Coll.

3c) Act No. 72 / 2000 Coll., on investment incentives and amending certain laws (Act on investment incentives), as amended. '.

2. In Article 5 (1), the words "Ministry of Industry and Trade (" Ministry ')' are replaced by the words "Ministry '.

3. in Article 5 (2) (a), "Agency for the Development of Enterprise, Czech Agency for Foreign Investment CzechInvest" shall be replaced by "Agency."

Čl. II

Transitional provisions

1. The CzechInvest Enterprise and Investment Support Agency established by this Act is the legal successor of the Czech Agency for Foreign Investment CzechInvest, a state contribution organization which is repealed by the date of application of this Act.

2. On the date of the entry into force of this Act, the CzechInvest Enterprise and Investment Support Agency becomes competent to manage all the assets of the State with which CzechInvest was responsible at that date.

3. The State Contribution Organization of the Agency for the Development of Enterprise and the Agency for the Development of Industry of the Czech Republic CzechIndustry is repealed on the date of entry into force of this Act. The right to manage the property of the State, as well as other rights and obligations, including the employment or other similar relationships of the state contribution organisations referred to in the first sentence, shall be transferred to the CzechInvest Enterprise and Investment Support Agency on the date of application of this Act.

This Act shall take effect on the day of its publication.
