Decree of the Government of the Czechoslovak Socialist Republic on the compulsory deposit in the opening of buildings in 1990

on a compulsory deposit at the start of construction in 1990
In order to regulate the expansion process in order to avoid undesirable inflationary tendencies by the Government of the Czechoslovak Socialist Republic on the basis of § 32 (2) and to implement § 28 (2) of Act No. 67 / 1989 Coll., on National Economic Planning, and to implement § 62 (4) of Act No. 50 / 1976 Coll., on Territorial Planning and Construction Regulations (Construction Act), it provides:
§ 1
(1) A socialist organisation (hereinafter referred to as the "organisation") which is to be authorised for the start of the construction operation cannot start this construction in 1990 unless it has sufficient financial resources in the development fund and has put sufficient funds into a special account for such construction at the bank or savings bank.
(2) The construction permit may not be issued to the organisation for the construction envisaged for the start in 1990 unless the organisation has sufficient financial resources in the development fund and does not demonstrate, in the building procedure for the issue of the building permit, a statement from the bank or the savings bank that it has deposited sufficient funds into a special account for such construction with the bank or savings bank.
§ 2
(1) Sufficient financial resources and sufficient funds under Article 1 are:
(a) for investments of up to 5 million CZK, 50% of the budget costs;
(b) for investments above 5 million CZK of budget costs, 2,5 million CZK and 25% of the amount by which the budget costs exceed 5 million CZK, but not more than 100 million CZK;
(c) for investments for which a State budget subsidy has been approved or a loan with a bank or a savings bank has been agreed, the basis for calculating the subsidy and the amount of the agreed loan shall be reduced when calculating the sufficient financial resources referred to in points (a) and (b).
(2) The budgetary costs referred to in paragraph 1 are those referred to in Titles II to IX of the general budgets1).
§ 3
The assigned funds referred to in Article 1 may be used by the organisation only to finance the construction for which it has assigned them.
§ 4
Paragraph 1 does not apply to buildings
(a) up to 500 000.
(b) in budgetary and contribution organisations;
(c) namely listed in Annex C III / 16 to the National Plan of the Czech and Slovak Federal Republic for 1990 - Environmental Investment Programme.
§ 5
(1) Where the competent central government authorities and national committees, as part of their audit activity (2), find that the organisation did not comply with the conditions laid down in paragraphs 1 and 3 at the time of the start of the construction in 1990, they shall propose the imposition of an economic fine for failure to comply with or failure to comply with the binding state output.3)
(2) The procedure for imposing the economic fines referred to in paragraph 1 and the amount thereof shall be governed by the economic law.4)
§ 6
This Regulation shall enter into force on 10 January 1990.
