on the conditions for the rational use of mineral deposits
The Government of the Slovak Socialist Republic orders the implementation of the Slovak National Council Act No. 42 / 1972 Coll., on the organisation and extension of supervision of the State Mining Administration (hereinafter referred to as "the Act"):
(1) Organisations which conquer deposits of non-reserved minerals which have not been decided to be suitable for industrial quarrying (hereinafter referred to as "the bearing"), or, where appropriate, for the acquisition of minerals, shall also modify or improve, (1) are obliged to use those deposits rationally and safely. The rational use shall mean economic and, where possible, full mining of bearings, subject to the following conditions:
(a) the acquisition focus on the use of all verified or qualified estimated deposits of the bearing in the designated territory, 2)
(b) the extraction process shall be determined on the basis of known geological data, mine technical conditions of the bearing and the physical mechanical properties of the minerals in such a way as to enable the use of those reserves of bearing minerals which are temporarily not intended for mining for technological, technical or other reasons; while respecting the requirements of safety of operations, its personnel and its surroundings, as well as the requirements of environmental protection, the agricultural and forestry fund and other important interests of the company,
(c) to carry out the cover of the surface layers of the soil to the extent necessary and well in advance of conquest;
(d) hide material to be stored only in designated places so as not to restrict the use of bearing stocks intended for conquest and may be used economically for reclamation or other purposes; proceed equally with the storage of waste material after treatment or processing of the recovered minerals,
(e) in determining the length of the mining activity, the walls, the cutting, the grades, etc. (hereinafter referred to as the "mining element"), ensure that, in the planned mining range, the extraction of even lower quality parts of the bearing is possible;
(f) to determine the width, height, direction and inclination of the mining activity with regard to the physicomechanical properties of minerals; the stability of the mining industry, the safety of operations, its personnel and its surroundings, as well as the use of suitable mining and loading machinery and transport equipment, 3)
(g) to carry out the shredding, storage and handling of explosives in accordance with the specified conquest procedure, in compliance with the special explosives regulations, 4)
(h) to take the bearing substantially from top to bottom and along the whole length of the mining ethic; Conquering from water to perform evenly and to a specified depth;
(i) if the obtained minerals are also treated or treated, their proper use by appropriate technological processes shall be ensured where there is no unnecessary loss or degradation of the mineral;
(j) to store completed, prepared or processed minerals separately by type and quality.
(2) In the mining of the bearing, such a process is not permitted by which the bearing is degraded or reduced or makes it more difficult to use, in particular, the extraction of the bearing only on quality parts, the creation of overhang or rock slides by undermining, deburring or other disruption of the mining ethic. Nor is a procedure in which the agricultural and forestry land fund is destroyed or otherwise degraded is permitted.
(1) In order to ensure the rational use of the bearing, the organisation carrying out the work referred to in Article 1 (1) (hereinafter referred to as "mining work") is obliged to draw up a plan for the use of the bearing which is mandatory for the execution of such work.
(2) The plan for the use of the bearing contains in particular:
(a) the procedure and method for carrying out mining operations with data on ensuring the conditions of rational use of the bearing in accordance with Section 1;
(b) details of the issue and conditions of the territorial decision and the permit of mining works, (5) other decisions, if any, in accordance with special rules, (6)
(c) a semi-rapid and educational situation with a ratio of 1: 500 and 1: 1000 respectively, and characteristic bearing cuts with the determination of the extraction stages and the indication of the conquest process.
(3) If this requires ensuring rational use of the bearing or other serious reasons, the organisation shall develop a change to the plan for the use of the bearing.
(4) The plan for the use of the bearing and, where appropriate, its amendment, shall be submitted by the organisation to the competent district mining office for the purpose of carrying out state professional supervision before the start of mining operations. If the mining work started before the application of this Regulation, the organisation shall submit a plan for the use of the bearing to the Regional Mining Authority within 3 months of its effectiveness.
(5) The Circular Mining Authority may, where justified, waive the submission of certain data or parts of the bearing exploitation plan (paragraph 2) and provide for another deadline for submission (paragraph 4).
(1) The organisation is required to keep documentation on the mining work, their control and guidance. The documentation shall regularly record and record the extraction process, the quantity and type of minerals obtained, the important mining geological and other operating data, as well as the findings, commands and measures concerning the use of the bearing.
(2) The recording of the condition and movement of the bearing stock is carried out according to specific regulations. 7)
The authorities of the State Mining Administration, in the framework of state professional supervision, shall check how the organisations fulfil the obligations imposed on them by this Regulation, in particular how they ensure the conditions of rational use of the bearing referred to in Article 1 in the plans for the use of bearings and how they comply with them in the implementation of mining work.
This Regulation shall enter into force on 1 July 1978.
