on inspections of the public order of national committees
The Government of the Czech Socialist Republic orders pursuant to § 6 paragraph 5 of Act No. 69 / 1967 Coll., on National Committees, as amended by the Act of the Czech National Council No. 146 / 1971 Coll.:
The National Committee of the City of Prague, the National Committee of the City of Brno, the National Committee of the City of Ostrava, the National Committee of the City of Pilsen and the Municipal National Committees of the First and Second Categories (Sections 10 (3) and (4) of the Act), as well as the Municipal National Committees of the Municipality of Brno, the National Committee of the City of Ostrava, the National Committee of the City of Plzeň and the National Committees of the City of Plzeň, may be set up to ensure local public order matters within their respective public order inspections of the National Committee ("inspections'). Other municipal national committees, as well as local national committees, may do so only with the agreement of the Regional National Committee after the observations of the District National Committee.
Inspections
1. carry out the tasks assigned to it by the National Committee in the security of local public order matters within its territory within the limits of its competence and competence and taking into account the powers and responsibilities of the inspection members;
2. examines and ascertains how citizens and organisations, within the national committee, maintain the rules of public policy, the implementation of which is the responsibility of the national committee, in particular:
- monitor and control compliance with purity and hygiene in the streets and other public areas, in generally accessible buildings, parks, orchards, etc.,
- protects against damage and destruction of public-service equipment,
- check that citizens or organisations have prescribed permits to carry out works, field and orchards, excavations in public spaces and use public spaces to the extent permitted and the manner in which construction facilities are carried out or other activities requiring authorisation,
- monitor the proper lighting of public spaces,
- monitor the state and proper maintenance (cleaning) of public walkways and public roads,
- controls spa and leisure facilities and autocamping as regards compliance with order and cleanliness,
- supervise compliance with restrictions on the administration of alcoholic beverages, in particular young persons, drunk persons and drivers,
- supervise compliance with the ban on visiting theatrical and film performances by minors,
- oversee the correct labelling of hazardous sites and the timely disposal of generally hazardous disorders and defects,
- oversee compliance with opening and closing hours in shops and premises and whether shops, establishments, sales stands, etc., are not unduly closed,
- monitor the proper use of the national flag, national emblem and city emblem and colours;
3. Prevents acts establishing offences in the field of public order protection and helps to eliminate their causes;
4. Announces to the National Committee the offences detected in the performance of its duties.
(1) An inspection worker can become a Czechoslovak national over 21 years old, committed to a socialist social establishment, upstanding and physical and mentally competent for the tasks of an inspection worker.
(2) The inspection staff may carry out their duties only after the promise has been made.
(3) The promise is:
"I promise in my honour and conscience that as a member of the public order inspection of the National Committee, I will actively contribute to the protection of public order. In my work, I will respect laws and other laws, maintain state and professional secrecy and carry out consistently and accurately the orders and instructions of my superiors and perform a conscientious and proper service."
(4) The National Committee may establish uniform and rank for inspection staff according to uniform principles established by the Ministry of Interior.
(5) When carrying out the tasks, inspection staff shall be identified externally on the left-hand sleeve of the inspection. The tape is blue, 105 mm wide, with yellow letters "IVP" of height 35 mm and width 20 mm and bearing a round stamp of the national committee. The sleeve tape of the inspection need not be externally marked by inspection staff wearing the uniform.
(6) In carrying out their duties, inspection staff shall be public officials.
(7) The pay ratios of inspection staff are governed by a specific regulation.
(1) The inspection may be divided into the organisational units.
(2) The organisation and activity of the inspection, its control, the duties of the inspectors, the relations of the inspection to the authorities of the national committee and its cooperation with other bodies shall be governed by the rules of organisation to be issued by the national committee.
(3) The model organisation rules of inspections shall be issued by the Ministry of the Interior.
(1) In the performance of their tasks, inspection staff shall be authorised to:
(a) to invite a citizen who violates public policy to refrain from such action;
(b) to warn at the place of a citizen who has violated public policy;
(c) to call on a citizen who has violated public policy to prove his identity and, if he does not prove it in a credible manner and the matter cannot be handled on the spot in a block procedure, to bring him to the National Committee or, where appropriate, to the Department of National Security,
(d) require explanations from anyone who can help to clarify the facts necessary to establish an infringement to ensure evidence;
(e) impose and collect fines in block proceedings for offences detected in the course of the service.
(2) The inspection staff shall apply primarily the means of education and prevention in the performance of their tasks. They only perform the procedure if it is strictly necessary and a successful outcome can be expected, always in a manner proportionate to the situation.
Inspection personnel shall be required:
(a) maintain laws and other laws in the performance of tasks, comply conscientiously with the orders and instructions of the superiors; to act with discretion and politeness and to respect the proper seriousness, honor and dignity of citizens and their own,
(b) report without delay to its directly superior the defects and deficiencies which threaten or impede the performance of the activity and the imminent damage;
(c) action if damage is imminent and urgent action is needed to prevent it; need not do so if they are prevented by an important circumstance or would put themselves or other persons at serious risk;
(d) maintain confidentiality regarding the facts which they have learned in connection with the performance of their tasks and which require, in the general interest or in the interests of the interested parties, that they remain secret from unauthorised persons, unless they are expressly exempt from this obligation by the national committee.
The Head of Inspection shall cooperate with the relevant Public Security Territories in ensuring the protection of public policy in the area of the National Committee, in particular in the joint discussion and resolution of issues on this section. In accordance with the guidelines of the National Committee, they shall also cooperate with other authorities, in particular the competent authorities, in the field of air quality protection *) and in the field of sanitary services. * *)
(1) Everyone is obliged to follow the instructions and calls of the staff to the inspections they issue in the performance of their tasks.
(2) The inspection staff shall, when carrying out their duties, demonstrate upon request by means of an inspection document issued by the National Committee in accordance with the model established by the Ministry of Interior.
National committees which have already set up an inspection before the application of this Regulation shall adjust its organisation and activity in accordance with this Regulation no later than 6 months after its publication.
This Government Regulation shall enter into force on the day of its publication.
