DECLARATION
of 22 March 2012
on minimum staff security requirements for health services
The Ministry of Health provides, pursuant to § 120 of Act No. 372 / 2011 Coll., on health services and the conditions for their provision (Health Services Act), for the implementation of § 11 (4) of the Health Services Act:
(1) Minimum Personnel Security Requirements ("Personnel Security")
(a) outpatient care is laid down in Annex 1 to this Decree;
(b) day care is laid down in Annex 2 to this Decree;
(c) bed care is laid down in Annex 3 to this Decree;
(d) medical care is laid down in Annex 4 to this Decree;
(e) health transport services are set out in Annex 5 to this Decree;
(f) medical emergency services are set out in Annex 6 to this Decree;
(g) the transport of patients with urgent care is laid down in Annex 7 to this Decree;
(h) home care and nursing care in social services establishments are set out in Annex 8 to this Decree;
(i) the alcohol and toxic containment services are set out in Annex 9 to this Decree;
(j) the urgent income is set out in Annex 10 to this decree;
(k) mental health centres are set out in Annex 11 to this Decree.
(2) This decree is without prejudice to the requirements for staff security of health services laid down by other legislation1).
(1) The provider who is entitled to provide health services on the date of entry into force of this Decree must comply with the requirements for the staffing of the services provided by this Order
(a) within 12 months of the date of entry into force of this Directive, if the provider referred to in Section 121 (1) of the Health Services Act is concerned,
(b) within 9 months of the date on which it takes effect, if the provider referred to in Section 122 (1) of the Health Services Act is concerned.
(2) A health service provider authorised to provide health services on the basis of a decision given in a procedure under Section 121 (6) of the Health Services Act must comply with the requirements for the personnel security of the services provided by that decree within 12 months of the date of the acquisition of the legal authority of that decision.
(3) The health service provider referred to in paragraph 1 or 2 shall comply, until the requirements for the personnel security of the services provided laid down in this Decree, with the requirements for staff security laid down in Decree No. 134 / 1998 Coll., as effective until 31 December 2011.
This Decree shall take effect on 1 April 2012.

Staff requirements for outpatient care
Staff requirements for outpatient care according to the fields of doctors and dentists and non-medical medical professions
A. Common requirements
1. Personnel care is determined according to the individual expertise of healthcare professionals and other professionals, type and field of care provided. The safety of health professionals and other professionals beyond the requirements laid down shall depend on the type and volume of healthcare provided, the field and spectrum of performance and activities carried out to ensure the quality, safety and availability of health care.
2. Where outpatient health care is provided exclusively to children, it shall be provided by doctors with specialised competence, specific competence or specialised competence and personnel of non-medical health professions with professional competence, specialised competence or specific competence in the fields of childcare as well as care provided to adults in the relevant fields in accordance with provisions I.B.1. and I.B.2. of this Annex. The provisions of the first sentence shall not apply to staff provision of outpatient care in fields in which specialised competence, specific competence or specialised competence of doctors and proficiency, specialised competence or specific competence of non-medical healthcare professionals are not regulated by other legislation (2).
3. Where, in the framework of outpatient care referred to in Part I.B.1. of this Annex, nursing care is provided under another legislation3), this care shall be provided by a general nurse or a medical assistant in an allowance corresponding to the scope of these activities, unless otherwise provided for in Part I.B..
4. The general nurse with specialised competence or specific professional competence shall, in the framework of outpatient care referred to in Part I.B.1. of this Annex, provide nursing care and other activities in accordance with other legislation4) in a period commensurate with the scope of these activities, provided they are carried out and are not otherwise provided for in Part I.B..
5. For the purposes of Part I.B. of this Annex, the availability of advice and assistance by telephone or by electronic means shall be understood to mean the availability of advice and assistance by the healthcare professional, if requested, always physical presence depending on the urgency of the performance and the clinical condition of the patient, unless otherwise specified in Part I.B..
B. Specific requirements
1. Outpatient care by health care fields - medical fields
1.1. Allergology and Clinical Immunology
(a) an allergist and a clinical immunologist; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.2. Algesiology
(a) an algeziologist, a physician with special professional or specialised competence in palliative medicine, anaesthesiologist or intensifier; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.2.1. Stationary care - Algeziology
(a) an algeziologist, a physician with special professional or specialised competence in palliative medicine, anaesthesiologist or intensifier; and
(b) a nurse qualified to pursue a profession without professional supervision; or
(c) a nurse for intensive care, provided that activities are carried out under another legislation (5).
1.3. Anesthesiology and Intensive Medicine
(a) an anesthesiologist or intensifier; and
(b) intensive care nurse, provided that activities are carried out under another legislation (5).
1.4. Angiology
(a) an angiologist; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.5. Vascular Surgery
(a) vascular surgeon; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.6. Dermatoenerology
(a) dermatoserologist; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.6.1. Stationary care - dermatoenerology
(a) dermatoserologist; and
(b) general nurse or medical assistant.
1.7. Children's Medicine
(a) a pediatrician; and
(b) a child nurse, general nurse or medical assistant, provided that nursing care is provided.
1.8. Diabetes
(a) a diabetic or endocrinologist and a diabetic, and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.9. Adolescent Medicine
(a) a young doctor; and
(b) a child nurse, general nurse or medical assistant, provided that nursing care is provided.
1.10. Endocrinology
(a) an endocrinologist or an endocrinologist and a diabetic; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.11. Foniatria
(a) a phonographer; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.12. Gastroenterology
(a) gastroenterologist; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.13. Geriatrics
(a) geriatr; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.13.1. Stationary care - geriatrics
(a) geriatr;
(b) general nurse or medical assistant,
(c) a nurse or an orderly; and
d) ergotherapist or other professional - working therapist - availability.
1.14. Gerontopsychiatry
(a) gerontopsychiatrist; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.15. Gynecology and obstetrics
(a) gynecologist and obstetrician,
(b) a midwife, general nurse or medical assistant, provided that nursing care is provided; and
(c) a midwife who is fit to pursue a profession without professional supervision, provided that she is provided with advisory and nursing activities in her own social environment.
1.15.1. Perinatology and fetomaternal medicine
(a) a doctor with a specific professional or specialised competence in perinatology and fetomaternal medicine or gynecologist and an obstetrician certified by the Institute of Postgraduate Education in Health issued before 2009 on compliance with the requirements of the training programme in perinatology and fetomaternal medicine; and
(b) a midwife, general nurse or medical assistant provided that nursing care is provided.
1.15.2. Oncogyno
(a) an oncologist or gynaecologist and an obstetrician certified by the Institute of Postgraduate Education in Health, issued before 2009 on compliance with the requirements of the training programme in oncogylology; and
(b) a midwife, general nurse or medical assistant provided that nursing care is provided.
1.15.3. Urogyno
(a) an urogynecologist or gynecologist and an obstetrician certified by the Institute of Postgraduate Education in Health issued before 2009 on compliance with the requirements of the educational programme in urogynology; and
(b) a midwife, general nurse or medical assistant provided that nursing care is provided.
1.16. Hematology and Transfusion Medicine
(a) a haematologist and a transfuziologist; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.16.1. Stationary care - haematology
(a) haematologist and transfuziologist,
(b) the general nurse or medical assistant; and
(c) a nurse or an orderly.
1.16.2. Stationary care - hemapheresis
(a) haematologist and transfuziologist,
(b) a general nurse with specialised competence in the field, provided that activities are carried out under another legislation (4); and
(c) a nurse or an orderly.
1.17. Hygiene and Epidemiology
(a) hygienists and epidemiologists, epidemiologists, children's and adolescents' hygiene, general health, communal or nutritional hygiene and articles of common use;
(b) a general nurse or a practical nurse, where nursing care is provided;
(c) a professional in the protection and promotion of public health after having acquired professional competence or an assistant to protect and promote public health, provided that the activities under another legislation are carried out (22), to which only a professional in the protection and promotion of public health or an assistant in the protection and promotion of public health are eligible.
1.18. Hyperbaric and Aerial Medicine
(a) a physician with special competence in hyperbaric and aviation medicine; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.19. Surgery
(a) a surgeon; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.19.1. Oncosurgery
(a) an oncosurgeon; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.20. Infectious medicine
(a) an infectious agent; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.21. Cardiology
(a) a cardiologist; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.22. Clinical Biochemistry
(a) a clinical biochemist; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.23. Clinical pharmacology
(a) a clinical pharmacologist; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.24. Clinical Oncology
(a) a clinical oncologist; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.24.1. Stationary care - oncology
(a) clinical oncologist,
(b) a doctor with competence;
(c) a general nurse or medical assistant; and
(d) a nurse or an orderly.
1.25. Clinical Osteology
(a) a clinical osteologist; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.26. Corrective Dermatology
(a) a corrective dermatologist; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.27. Medical genetics
(a) medical genetics; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.28. Long-term care medicine
(a) a doctor with special competence in long-term care medicine; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.29. Addictive diseases
(a) a doctor with specific professional or specialised competence in addictive diseases or a psychiatrist; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.29.1. Stationary care - adictology
(a) a doctor with specific professional or specialised competence in addictive diseases, a psychiatrist, a clinical psychologist competent to pursue a profession without professional supervision or an adictologist competent to pursue a profession without professional supervision; a doctor with specific professional or specialised competence in addictive diseases or psychiatrists - availability, provided that the care is provided by a clinical psychologist competent for the exercise of the profession without professional supervision or by an adictologist competent for the exercise of the profession without professional supervision; and
(b) general nurse or medical assistant.
1.30. Nephrology
(a) a nephrologist; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.30.1. Stationary care - dialysis
(a) a nephrologist,
(b) a general nurse qualified to pursue a profession without professional supervision (1 nurse for the current care of 5 patients on dialysis); and
c) Nurse for intensive care 5).
1.31. Neurosurgery
(a) neurosurgeon, and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.32. Neurology
(a) a neurologist; and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.33. Ophthalmology
(a) ophthalmologist,
(b) a general nurse or medical assistant, provided that nursing care is provided; and
(c) an orthoptist where specific nursing care is provided to patients with eye disorder.
1.34. Ortho and Trauma of the Musculoskeletal
(a) orthopedic, and
(b) a general nurse or medical assistant, provided that nursing care is provided.
1.35. Orthopedic Protetics
(a) orthopaedic prosthetics; and
