GOVERNMENT REGULATION
of 9 February 2005
amending Government Regulation No 181 / 2004 Coll., laying down closer conditions for the implementation of common market organisations as regards the system of granting export subsidies for agricultural products and processed agricultural products
The Government orders pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll.:
Government Regulation No 181 / 2004 Coll., laying down closer conditions for the implementation of the common market organisations as regards the system of granting export subsidies for agricultural products and processed agricultural products, is amended as follows:
1. The following Section 3a and 3b are inserted after Section 3, including footnotes 4a to 4d:
In the case of exports of agricultural products under the rules of the European Communities (4a), the exporter shall submit the transport documents4b) and, where the State Agricultural Intervention Fund (hereinafter referred to as the Fund) is invited in writing, also the documents provided for in the rules of the European Community4c).
The security (guarantee) under the rules of the European Community (4d) must be provided to the Fund demonstrably at the latest on the date of receipt of the application for an export subsidy.

2. In Article 4 (1), the words "State Agricultural Intervention Fund (hereinafter referred to as the Fund) 'are replaced by the words" Fund'.
3. in Paragraph 4 (2) (b), the words "on export refund" shall be replaced by "on export subsidy."
This Regulation shall enter into force on the day of its publication.
