THE LAW
of 4 April 2000
on a supply ban for the Boshehr nuclear power plant
Parliament has decided on this law of the Czech Republic:
(1) Exports of goods and services, intangible rights and any documentation or information the designation of which is directly or indirectly related to the Boshehr nuclear power plant in the Islamic Republic of Iran are prohibited.
(2) For the purposes of this Act, export of goods shall mean the release of goods under the customs procedure of export or outward processing or re-export of goods.
(1) Exporters or any other person who infringes the prohibition laid down in Paragraph 1 (1) may be ordered by the Ministry of Finance to:
(a) a fine of up to 20 000 000 CZK or up to five times the price of goods or other transactions referred to in Article 1 (1), if this five times more than 20 000 000 CZK,
(b) the confiscation of goods covered by the prohibition under Article 1 (1).
The imposition of a fine shall not preclude the imposition of a forfeiture of goods.
(2) The amount of the fine shall be determined in the light of the degree, importance and duration of the threat to the foreign policy, security or commercial interests of the State or the damage caused by the infringement of this law.
(3) The fine is the revenue of the State budget. The owner of the forfeited goods is the State.
(4) Decomposition against the decision imposing a fine and the decision imposing a forfeiture of goods does not have suspensory effect.
(5) Penalties or forfeiture may be imposed within 3 years of the date on which the infringement of Paragraph 1 (1) was detected, but not later than 10 years after the infringement.
This Act shall take effect on the day of its publication.
