amending and supplementing Decree No. 126 / 1993 Coll., implementing Act No. 265 / 1992 Coll., on the registration of property rights and other property rights in kind, and Act No. 344 / 1992 Coll., on the Real Estate Register of the Czech National Council, as amended by Decree No. 277 / 1993 Coll.
The Czech office of surveyor and cadastral provides pursuant to § 17 of Act No. 265 / 1992 Coll., on the registration of ownership and other property rights:
The Decree of the Czech Office of Geographic and Catastrophe Act No. 126 / 1993 Coll., implementing Act No. 265 / 1992 Coll., on the registration of property rights and other property rights in kind, and the Act of the Czech National Council No. 344 / 1992 Coll., on the Real Estate Register of the Czech Republic (cadastral law), as amended by the Order of the Czech Geographic and Catastrophic Office No. 277 / 1993 Coll., is amended as follows:
1. in Paragraph 37, point (i) shall be deleted;
2. in Paragraph 38 (3) (a) (1), the definitions "and (i)" shall be deleted and the comma between "(e), (g)" shall be replaced by "a."
3.Paragraph 38 (4), including footnote 56, shall be deleted.
Paragraphs 5, 6 and 7 shall be renumbered paragraphs 4, 5 and 6.
4. the following paragraph 3 shall be added to Article 40, including footnotes 64a) and 64b):
"(3) The record shall also record property ownership rights from privatized assets. 51) In order to carry out the alert, the contract, the instrument of incorporation or the confirmation by the competent authority of the sale of the public auction (62) shall be accompanied by an officially certified copy (54) of the relevant part of the privatisation project, including the introductory part of the project, the decision by the competent authority on privatisation, 64a), including the conditions for the approval of the privatisation projects approved before 13 August 1993, and the inventory of the immovable property, followed by a certified copy (54) of the company's founder's decision to abolish the company or the decision to set aside part of the company's assets and transfer of the privatised assets to the Czech National Property Fund and the extract from the commercial register. In the implementation of the transfer of privatized assets by the Land Fund of the Czech Republic, the agreement by which the Fund of National Property of the Czech Republic transfers privatized assets to the Land Fund of the Czech Republic shall be attached to the above lists.
64a) § 10 paragraphs 1 and 2 of Act No. 92 / 1991 Coll., as amended by Act No. 210 / 1993 Coll.
64b) Paragraph 10 (1) to (3) of Act No. 92 / 1991 Coll., as in force until the entry into force of Act No. 210 / 1993 Coll. '.
5. in footnote 51), after the words "Act No. 92 / 1992 Coll.," the "clutch" and "shall be replaced by a comma and the words" and Act No. 210 / 1993 Coll. "shall be added at the end of the note.
This decree shall take effect on the day of its publication.
