DECLARATION
Ministry of Finance of the Czech Socialist Republic
of 2 November 1970
on financial assistance for cooperative and individual housing construction and modernisation of family houses in the border
The Ministry of Finance of the Czech Socialist Republic, in agreement with the participating central authorities, provides, pursuant to § 391 paragraph 2 of the Economic Code No. 109 / 1964 Coll., pursuant to § 20 of Act No. 8 / 1959 Coll., laying down the basic rules on the State Budget and on the management of budgetary resources:
Scope
(1) The decree covers residential construction in the border area *)
(a) for cooperative housing construction initiated from 1 July 1970, carried out under the conditions laid down in § 5 of Decree No. 137 / 1968 Coll., on financial, credit and other assistance to cooperative and individual housing construction, as amended by Decree No. 14 / 1969 Coll., or on the basis of an exception permitted under § 10 (2) of the Decree cited;
(b) to the individual housing and modernisation of privately owned family houses, carried out on the basis of a building permit issued from 1 July 1970 in accordance with the concept of long-term development of the settlement (Section 11 (1) of the last sentence of Decree No. 137 / 1968 Coll. as amended by Decree No. 14 / 1969 Coll.). * *)
(2) Assistance under this Order is provided in addition to financial, credit and other assistance under Decree No. 137 / 1968 Coll. as amended by Decree No. 14 / 1969 Coll., or in addition to assistance provided under special regulations. * * *)
(3) Assistance under this decree shall not be granted for the modernisation of family homes which are not used for permanent housing.
Cooperative housing construction
A contribution of 20% of the contribution due to such construction pursuant to Article 2 of Decree No. 137 / 1968 Coll. as amended by Decree No. 14 / 1969 Coll. In determining the minimum own funds of the cooperative (s), this additional contribution shall not be taken into account.
Individual housing construction
(1) For each apartment which is obtained by building a family house or by rebuilding it, by extension, etc., and for the construction of a personal apartment †), an individual building allowance of 35 000, - Ccs in category I, 25 000, - Ccs in category II and 15 000, - Ccs in category III. † †)
(2) The allowance referred to in paragraph 1 may be granted to the builder only once.
Modernization of personal-owned family houses
(1) A State contribution of 50% of the material and its import costs, up to a maximum of 15 000, - CZK per family house, is granted to owners of personal homes for modernisation.
(2) Working in agricultural and forestry primary production, to which an interest-free loan under the special rules * has been granted for this purpose, the contribution referred to in paragraph 1 shall be granted only to such an extent that the sum of that interest-free loan and contribution does not exceed 75% of the cost of the material and its import.
(3) Modernization of a family house means a modification that achieves a higher standard of housing. * *) It is not considered to be a modernization of normal maintenance and repair of a family house or the establishment of a garage or economic accessories to a family house.
(4) Paragraph 3 (2) applies mutatis mutandis.
Means of providing financial assistance
(1) The contribution provided for in Article 2 will be provided by the Regional National Committee at the request of the building housing cooperative.
(2) The contribution referred to in Article 3 (1) and Article 4 (1) and (2) shall be granted to individual builders on condition that they are permanently used and worked in the border area for at least 10 years from the issue of the permit to use the building; in the event of non-compliance with this condition, the contribution shall be reimbursed within 6 months at the latest. If they do not repay the contribution at that time, it shall be decided by the granting authority. This obligation shall cease if the builder dies or becomes fully disabled.
(3) The contribution referred to in Section 3 or 4 shall be provided by the district national committee at the request of the builder, supported by a building permit. The contribution to the modernisation of the family houses working in agricultural and forest primary production shall be granted on request, supported by a confirmation of the organisation in which the builder works, of the possible granting of an interest-free loan for the modernisation carried out.
(4) The contribution referred to in paragraph 3 shall be deposited in the interest-free account of the builder at the branch of the Czech State Savings Bank, in whose district the construction is carried out, with only the costs associated with the construction or modernization involved.
(5) The contribution shall be decided in the administrative procedure. * * *)
Efficacy
This Decree shall take effect on 3 November 1970.
