on State control, statistics and other fields of national economic records
The National Assembly of the Czechoslovak Socialist Republic decided on this law:
Basic provisions
§ 1
(1) An increase in the level and efficiency of the management of the development of the national economy, consistent protection and effective enforcement of the interests of the entire society is essential to strengthen the social role and increase the level of control and its close links with the national economic record.
(2) The role of national economic records, including records of technical, accounting and statistics operations, is to ensure a deep knowledge of the state and development of the various sectors and of the entire national economy, in particular for the need for annual and long-term planning and management of the national economy, as well as to ensure, at all stages of the procedure, a deep knowledge of how the tasks of the State Plan and the State Budget are carried out.
§ 2
(1) All the authorities responsible for the management of the national economy and cultural construction and all the managers of the public and economic authorities follow the principle that control is an inseparable part of the procedure. They are therefore obliged to organise and carry out control as an important state and social obligation.
(2) Organising a single system of checks and national economic records is the government's responsibility.
§ 3
Control and statistics play an important role in strengthening central management of national economic development in the conditions of deepening socialist democracy.
§ 4
The state and economic authorities, in organising and carrying out control and statistics, perform their social role with the broadest participation of workers, national committees and voluntary social organisations, in particular the Revolutionary Trade Union Movement.
§ 5
State control authorities and statistics
(1) The Central Authority for State Control and Statistics is the Central Authority for State Control and Statistics, headed by the President, who is the Minister.
(2) In the counties and counties, the regional and district departments of state control and statistics are subordinate to the Minister-General of the Central Office of State Control and Statistics.
(3) As a regional authority of the Central Office of State Control and Statistics, a regional unit of State Control and Statistics is established in Bratislava, which is subordinate to the Minister-General of the Central Office of State Control and Statistics. The Head of the Regional Department for State Control and Statistics is the Head of the Ministry for National Control and Statistics.
(4) The Central Office of State Control and Statistics shall carry out its tasks either directly or through its regional department and its regional and regional departments.
(5) The Minister-President of the Central Office of State Control and Statistics may, as appropriate, appoint special controllers in each organisation for the duration of certain particularly important tasks.
(6) In the performance of their duties, State control and statistics are independent of ministries (central government bodies) and national committees and other state bodies.
§ 6
Scope of the Central Office of State Control and Statistics
The Central Office of State Control and Statistics shall be responsible for:
(a) organise and carry out state control and statistics in all sections of the government and in all sectors and sectors of the national economy;
(b) methodically manage and direct control activities and national economic records carried out by other authorities and organisations, except accounting records (§ 22) and supervise the performance of tasks in the whole area of control and national economic records.
Tasks of the Central Office of State Control and Statistics and its Bodies
§ 7
Tasks in the field of state control and statistics
(1) In the field of State control and statistics, the Central Office of State Control and Statistics shall, in particular, carry out the following tasks:
(a) monitor compliance with the guidelines of the Communist Party of Czechoslovakia and compliance with the laws, regulations and resolutions of the Government, compliance with state discipline in the performance of the tasks arising from the State Plan for the Development of the National Economy and the Management of Property in Socialist Property, and verify that the requirement of high economy in production and administration and in other areas of social life is maintained;
(b) examine the organisation and operation of the state and economic apparatus, study its structure and working methods and generalise the knowledge acquired in order to make it economically, simplify and improve;
(c) coordinate verification and review activities carried out by other bodies and organisations;
(d) organise, in cooperation with other bodies, checks and revisions on important issues of the national economy;
(e) control the production and observance of prices;
(f) monitor the handling of complaints, notifications and incentives of workers by state authorities and socialist organisations;
(g) organise statistical surveys of national importance;
(h) carry out analyses of the state and development of each sector of the national economy; use the results of the statistical surveys, the results of the verifications and revisions, the information obtained from synergies with the working and supporting documents required of other bodies,
(ch) give prior consent to statistical surveys carried out by other authorities;
(i) monitor the development of mechanisation and automation of national economic records, the effectiveness of the organisation and deployment of machine calculators and calculation centres for the automation and use of numerical machines;
j) makes use of progressive methods and forms of control activity and national economic records to continuously increase the level of management work.
(2) The control of State control bodies and statistics does not apply to judicial and prosecutor activities.
Methodological management and supervision
§ 8
In the methodological management of the control and of the national economic records carried out by other authorities and organisations, the Central Office of State Control and Statistics shall perform in particular the following tasks:
(a) issue guidelines for the organisation and conduct of control activities and national economic records in agreement with the central authorities involved;
(b) issue directives for the compilation, submission or processing of reports and, in cooperation with the competent authorities, manage the national economic records in a manner consistent with the methodology and needs of national economic planning;
(c) ensure the unification of forms of records and documents, in particular for the purposes of mechanisation and automation of data processing;
(d) supervise the training of inspection staff and national economic records.
§ 9
The Central Office of State Control and Statistics shall supervise the state and methods of control and national economic records in all state bodies and socialist organisations. It shall examine the overall level of their control activity and of their national economic records and how the knowledge obtained by carrying out internal control and managing the national economic records is used to improve the efficiency of the management. State control authorities and statistics shall also monitor whether the managing authorities control the status of the records and the proper and timely submission of statistical data for subordinate units and whether they operationally address deficiencies which they have identified themselves or which have been brought to the attention of the State Control and Statistics Authorities.
§ 10
In order to carry out statistical surveys of any kind, prior approval of the Central Office of State Control and Statistics is required. The conditions under which such surveys may be carried out shall be laid down by the Central Office of State Control and Statistics.
Main principles of activity of State control bodies and statistics
§ 11
(1) State control bodies and statistics are helping all their activities, in particular through the systematic generalisation of the experience gained, to continuously increase the efficiency of management and thus to develop the national economy and culture in a universal manner. It acts to prevent deficiencies and defects in the state and economic apparatus or to eliminate them in good time and to combat inreconcilable indiscipline, inefficiency and other actions contrary to the interests of society; to this end, they unify the efforts of all control bodies.
(2) State control authorities and statistics ensure that the national economic records are complete and true, that they serve effectively control and that the knowledge resulting from both control activities and the national economic records for all stages is used to the maximum. present timely and objective reports on the situation in the national economy to the relevant party and state authorities and propose the necessary measures.
§ 12
Cooperation with workers
(1) State control and statistics bodies shall carry out their tasks in close cooperation with workers and their voluntary social organisations and with the support of national committees. This synergies is one of the forms of participation of workers in the management of economic and cultural construction.
(2) State control authorities and statistics consistently link top-level control to bottom-level control and thus create conditions for workers to participate actively in both the carrying out of the checks and the monitoring of the implementation of the measures to remedy the defects detected and to seek their timely and complete removal.
(3) State control and statistics authorities use the experience, knowledge and initiatives of workers in their activities; They shall also inform the workers, their social organisations, the Committee of the National Committees, or other bodies with the results of the inspection activities, and shall discuss the measures to be taken to ensure a lasting remedy, as well as organisational, cadre and educational measures which would in future prevent the emergence of detected or similar defects, contribute to simplifying and improving governance, to enhancing the protection of property in socialist property and to strengthening state and labour discipline.
(4) In cooperation with voluntary social organisations, state control authorities and statistics shall create the assets of voluntary collaborators who assist them in the performance of their tasks, in particular in the performance of the control, in the familiarity of workers with the results of the control and in ensuring timely submission of true statistical data.
§ 13
Authorisation of asset members
(1) The members of the State control and statistics asset are authorised, within the scope of the mandate, as staff of State control and statistics authorities.
(2) Members of the asset shall, if possible, carry out their activities outside their working hours. If this cannot be ensured, it is the responsibility
(a) to members of the asset in employment, compensation for earnings forgone, calculated on average over the last three months; the compensation is provided by the organisation in which they are employed;
(b) non-working members (e.g. members of single agricultural cooperatives), compensation for lost earnings or increased costs; the reimbursement is provided by the Central Office of State Control and Statistics or by its authorities.
(3) Travel and other expenses will be reimbursed to members of the asset by the Central Office of State Control and Statistics or by its regional or regional departments of State Control and Statistics, mutatis mutandis, in accordance with the rules applicable to civil servants.
§ 14
Cooperation with other institutions and organisations
(1) State control and statistics bodies perform their tasks in cooperation with central authorities, national committees and other state bodies and socialist organisations.
(2) State authorities and socialist organisations are required to assist the authorities of state control and statistics in their activities; In particular, they shall be required to provide the authorities of State control and statistics with written and other supporting documents to be provided for inspection and statistical work, to provide explanations and expert opinions, and to provide the authorities of State control and statistics within the time limits set by them with reports of the state of the investigation and of the results of the investigation and of the procedures for which they have been initiated or mandated.
§ 15
Reporting obligation
(1) All authorities, organisations and individual citizens are obliged to provide the authorities of state control and statistics correctly, truthfully and within the time limits set, with all the data and reports required for the purposes of national economic records.
(2) State control authorities and statistics are entitled to verify on the spot the completeness, accuracy and veracity of the data and reports provided.
Approval of State control authorities and statistics
§ 16
(1) The Central Office of State Control and Statistics and its authorities are entitled to:
(a) carry out examinations and revisions and other investigations in state bodies and socialist organisations;
(b) require the responsible staff of the bodies and organisations checked to address the deficiencies and deficiencies detected in an operational manner or to propose effective remedies; draw the attention of the managers of the superior bodies or organisations to the facts established by the inspection;
(c) to give binding instructions to the head of the authorities or bodies checked or superior, if the deficiencies and defects detected are not resolved operatively, on the immediate removal of defects detected by the examination or revision; the heads of such authorities or organisations shall be required to report within a specified time limit on the removal of the defects detected and on the measures to prevent their recurrence for the future,
(d) require that the issue of funds and material values be immediately stopped if there is a risk of damage to the national economy.
(2) The authorised staff of State control bodies and statistics are entitled to all the operations necessary to carry out the inspection, to ensure the protection of property in socialist ownership or to perform any other task of State control and statistics; in particular, may require that plans, documents, files and other documents be presented to them within the time limit laid down and that explanations, reports and communications be provided. They are also entitled to enter all rooms, equipment and objects and to provide original documents.
(3) Any person called upon by or authorised by a State control authority and statistics shall submit plans, documents, files and other documents, as well as explanations, reports and communications, even if they contain facts constituting State, economic or professional secrecy.
§ 17
In carrying out their tasks, the authorities of state control and statistics shall act on staff of state authorities and socialist organisations in order to carry out timely and proper control, to address the deficiencies identified without delay and to prevent them from repeating them, to provide timely and true statistical information, to be aware of state discipline, to ensure the protection of property in socialist ownership and to promote the principle of economy. This educational role is primarily a criticism of the shortcomings in the work of the responsible staff and an extension of the knowledge of advanced working methods. If these measures are not sufficient, they shall apply the measures provided for in Articles 18 and 19 where necessary.
§ 18
Pricing measures
(1) Workers of authorities or organisations who, in the performance of their duties, have infringed state discipline in particular by failing to comply with the laws, regulations or resolutions of the Government, ineconomically using monetary or material values, submitting incorrect information to the authorities or authorities of state control and statistics, or carrying out unauthorised statistical surveys (disciplinary misconduct), may be subject to any of the following disciplinary measures: reprimand, strict reprimand or dismissal.
(2) The disciplinary action is imposed by the Central Office of State Control and Statistics, in agreement with the competent authorities. The Minister-President of the Central Office of State Control and Statistics may authorise the administration of disciplinary measures by regional departments and regional and regional departments of state control and statistics.
(3) The measures should not be imposed one year after the finding of a criminal offence.
(4) Persons to whom the authorities of State control and statistics have imposed disciplinary measures cannot be charged for the same acts under other rules.
§ 19
Cash refunds
(1) The responsible staff of the audited bodies and organisations who, in the performance of their duties, have been responsible for causing damage to the State, in particular to national assets, may receive compensation in cash. The amount of the refund shall not exceed three times the average monthly earnings of the worker to whom the refund has been imposed. The cash refund belongs to the State.
(2) The Central Office of State Control and Statistics decides on the imposition of cash compensation. The Minister-President of the Central Office of State Control and Statistics may authorise regional departments, regional and regional departments of state control and statistics to impose cash refunds.
(3) If cash compensation has been imposed, the injured organisation cannot claim compensation under the rules on compensation obligations caused by an employee in breach of employment obligations. However, this shall be without prejudice to the organisation's entitlement to compensation where the staff member is responsible for the total damage caused by the organisation; However, in such cases, compensation shall be reduced by the amount of compensation imposed.
§ 20
State Wood Inspection
The Central Office of State Control and Statistics is associated with the State Wood Inspection.
Final and transitional provisions
§ 21
(1) The Minister-President of the Central Office of State Control and Statistics may issue implementing rules in order to ensure the tasks of the national control and statistics bodies and to exercise their powers.
(2) The scope and competence of regional departments, regional and regional departments of state control and statistics are determined by the Minister-President of the Central Office of State Control and Statistics. It may also set up a single department of state control and statistics for several counties.
§ 22
The principles for accounting shall be laid down by the Government. The methodological management of the accounting records and the supervision of their implementation shall be carried out by the Ministry of Finance in agreement with the Central Office of State Control and Statistics.
§ 23
Repeal
(1) The following shall be deleted:
1. Government Decree No. 73 / 1951 Coll., establishing the Ministry of State Control, as amended by Government Decree No. 38 / 1952 Coll.,
2. Decree No. 260 / 1952 of the Ministry of State Control Ú. l., declaring certain provisions of the Statute of the Ministry of State Control,
3. Act No. 108 / 1951 Coll., on the Organisation of National Economic Records; Government Regulation No. 30 / 1958 Coll., laying down the principles governing accounting (accounting principles), remains in force until new provisions are adopted,
4. provision § 1 (1) (h) of Act No. 108 / 1960 Coll., on the determination of sections of state administration in which the delegates of the Slovak National Council operate,
5th Government Decree No. 109 / 1951 Coll., on the organisation of a statistical service,
6th Decree of the President of the State Office of Statistics No. 44 / 1955 Ú. l., on the care of the mechanisation of records and computational work.
(2) Decree of the Ministry of State Control No 261 / 1952 Ú. l., which establishes directives on the imposition of cash compensation by the authorities of the Ministry of State Control, is hereby repealed with effect from a date to be determined by the Minister-General of the Central Office of State Control and Statistics.
§ 24
Efficacy
This Act shall take effect on the day of its publication.
