concerning the organisation of veterinary services and certain veterinary measures (veterinary rules).
The Government of the Czechoslovak Republic orders pursuant to § 1 of Act No. 143 / 1949 Coll., on Changes in the Organisation of Public Administration and in the jurisdiction of its bodies, and under Act No. 187 / 1950 Coll., on Improvement of Animal Production:
Tasks of the State Veterinary Service and its unification.
The task of the State Veterinary Service is to organise and carry out the protection of animal health, their treatment and to take veterinary measures to ensure the production of raw materials of animal origin with regard to the veterinary health and thus the protection of humans against diseases that are transmissible to humans.
To the Ministry of Agriculture, the current Ministry of Health has been transferred in the field of inspection of slaughter animals and meat.
Purchasing and taking-over places for animals for slaughter, slaughter facilities, meat and milk processing establishments, collection and storage centres of raw materials of animal origin and processing undertakings and all operations therein shall be subject to veterinary health surveillance.
Organisation of veterinary services.
The veterinary service organises, animal health and disease control measures, plans, manages, implements and is controlled by the Ministry of Agriculture; does so through the veterinary departments of the agricultural reports of regional and regional national committees.
(1) A main veterinary inspection shall be established in the Ministry of Agriculture for the control of the veterinary service and a Regional Health Veterinary Inspector shall be established in the veterinary departments of the Regional National Committees.
(2) The work programme of the main veterinary inspection and of the regional veterinary inspectors is laid down by the Ministry of Agriculture.
In particular, the Ministry of Agriculture shall carry out the following tasks:
(a) draw up a national plan for all veterinary services and issue directives and guidelines for its implementation;
(b) manage the veterinary establishments of the Ministry of Agriculture and National Committees;
(c) manage and monitor compliance with animal health measures imposed on undertakings, establishments, organisations and offices;
(d) carry out the upper veterinary health surveillance referred to in Article 3;
(e) keep a register of the cadres of the veterinary service, guide and supervise their training, and manage their placement;
(f) establish and manage scientific veterinary institutes, guide and supervise their activities;
(g) plans and organises the production of veterinary sera, vaccines and other vaccines and diagnostics and plans to equip veterinary services with the necessary medicines and facilities;
(h) organise protection at national borders against the introduction of diseases and parasitic diseases of animals from abroad and manage, where applicable, veterinary protection measures;
(ch) organise and maintain veterinary statistics, report animal diseases and exchange such reports with foreign States under international agreements;
(i) cooperate in dealing with animal insurance issues;
(j) participate in the development of indicative plans for the construction of stables.
The veterinary department of the agricultural reports of the Regional National Committees shall, in particular, carry out the following tasks:
(a) draw up, within the framework of a national veterinary plan, partial work plans for all veterinary services in the region;
(b) issue directives to supplement general provisions according to the needs of the region and guidelines of the Ministry of Agriculture;
(c) manage and control veterinary establishments in the county;
(d) manage and control the implementation of veterinary measures imposed on undertakings, establishments, organisations and offices and carry out the veterinary health surveillance provided for in Article 3;
(e) places veterinary agencies in the county, keeps records of them and ensures that they are fully trained;
(f) plans all the needs for veterinary services in the county;
(g) organise all veterinary measures in the region according to the needs of the region and use animal insurance statistics to implement them;
(h) organise and maintain veterinary statistics on animal diseases in the county, receive and report on those diseases;
(ch) organise veterinary information activities in the county.
The veterinary department of the agricultural reports of the District National Committees shall perform in particular the following tasks:
(a) organise all veterinary services in the district, veterinary health surveillance and supervision of the operation of the district veterinary activity and surveillance of the veterinary facilities of the district;
(b) organise preventive anti-epizootic and anti-parasitic measures in the district;
(c) organise therapeutic veterinary activities in the district;
(d) give binding opinions with a view to veterinary health regarding the plans and their reconstructions and their location;
(e) notify the persons who have infringed the veterinary measures for criminal prosecution.
The district veterinarian shall carry out in particular the following tasks:
(a) oversee the health status of all livestock in its perimeter;
(b) manage and implement protective and therapeutic anti-epizootic and anti-parasitic measures such as protective and therapeutic vaccination and compulsory deworming of animals, order the isolation of animals and their slaughter or culling and other veterinary measures and acts;
(c) report the occurrence of animal diseases to the competent veterinary authorities;
(d) keep an eye on the movement and transport of animals and raw materials of animal origin in the veterinary district, issue and verify animal health certificates of raw materials of animal origin, keep an eye on the markets and movements of animals, their purchases and stalls of ransom undertakings;
(e) provide or provide veterinary treatment to sick animals;
(f) manage the work of veterinary technicians and other auxiliary veterinary staff;
(g) in accordance with the instructions of the District National Committee, carry out the veterinary health surveillance provided for in Article 3 and the inspection of slaughter animals and meat;
(h) notify the persons who have violated the veterinary measures for criminal prosecution.
The veterinary technician working in the veterinary district shall perform in particular the following tasks:
(a) ensure the health of all livestock in its perimeter;
(b) carry out protective and therapeutic vaccination, deworming of animals and preventive veterinary activities under direct management of the veterinarian;
(c) provide veterinary medical assistance to sick animals for driving and as instructed by the veterinarian, and carry out an inspection of the animals and meat for slaughter;
(d) notify the veterinarian of the occurrence of diseases and other severe animal diseases and immediately arrange the necessary veterinary measures under the guidelines of the Ministry of Agriculture.
Decisions and measures of the veterinary departments of the Regional (Regional) National Committees may be amended, supplemented or repealed by the Council of the Regional (Regional) National Committee.
Preventive measures against animal diseases and measures to combat them.
(1) In order to prevent animal diseases, all their holders and, in particular, the heads of state goods, the holdings of single agricultural cooperatives and the economy of the other socialist sector shall be required:
(a) keep the farms, stables and all places where animals are kept or housed clean and disinfect these places at least twice a year (spring and autumn);
(b) to provide a sufficient feed base and to take care of the biography of animals;
(c) all animals newly arrived on the holding are temporarily kept separate from other animals under the guidelines of the Ministry of Agriculture;
(d) the sick animals are immediately separated from the healthy animals and, as instructed by the veterinarian or the veterinary technician, do not use them as productive and draining until they have recovered;
(e) not to expel or expel sick animals to common pastures or to common watercourses and to prevent sick animals from coming into contact with healthy animals and, without the approval of the veterinary service authority, not to allow access to sick animals for the unemployed;
(f) to have protective vaccination and diagnostic investigations carried out in accordance with the guidelines of the Ministry of Agriculture and to provide the veterinary authorities with all the necessary assistance during veterinary procedures;
(g) to kill in stables all pests of livestock, such as insects and harmful rodents, and to take appropriate measures to prevent them entering the stables;
(h) to provide veterinary assistance to sick animals and to immediately inform the veterinarian or veterinary technician of the signs of animal diseases (sudden death of the animal without obvious signs of disease, concurrent diseases of several animals and such as).
(2) In newly built or adapted stables of agricultural establishments of single agricultural cooperatives, state goods and other socialist sectors, a room must be established for washing, changing and disinfecting persons entering the stables. For the current stables of these agricultural plants, such rooms shall be established gradually.
(1) If a disease is found in a holding or part thereof (in one of the stables, stables, separation or herd, etc.) in animals, that holding or part thereof and, where appropriate, the whole municipality, after a territory to the extent appropriate to the nature and spread of the disease, shall be declared infected under the rules in force.
(2) Veterinary protection measures must be carried out in infected areas in accordance with the guidelines of the Ministry of Agriculture and protective vaccination of animals, as appropriate.
(3) Veterinary protection measures must be carried out on the following diseases of animals: rinderpest, contagious bovine pleuropneumonia, foot-and-mouth disease, anthrax, contagious fescue, tuberculus, glanders, dourine, equine infectious anaemia, equine infectious anaemia, vesicular stomatitis, game and bovine disease, dourine, rabies, sheep pox, swine fever, infectious swine polio, swine fever, swine fever, poultry plague, poultry cholera, contagious streptococcal inflammation of the udder, contagious agalacia of the sheep, bovine disease (vesicular disease), contagious bovine disease (fungi), infectious diseases of the mammary gland of the cervitis of the foetus.
(4) The Ministry of Agriculture may determine other animal diseases in which animal health protection measures must be implemented.
(5) For areas declared infected with animal disease, a closure shall be imposed according to the nature of the disease, its symptoms and the economic importance of the animals according to the guidelines of the Ministry of Agriculture; animal health protection measures such as:
(a) the prohibition on the transport and overloading of animals by the closure and any movement of animals into and out of the closure, if any, of animals susceptible to the disease, and the prohibition on the carrying out of articles used in the treatment of sick animals;
(b) a ban on the purchase of animals and raw materials of animal origin from the closure; the exemption may be authorised by the Ministry of Agriculture or under its responsibility by the Regional National Committee;
(c) the closure of markets, ransom points, exhibitions and other points of introduction of animals in the closure for animals susceptible to the disease;
(d) the prohibition of common grazing, joint feeding, swimming or bathing of animals susceptible to the disease in question; pastures and watercourses used by or suspected of being sick by animals shall be closed to all animals susceptible to the disease;
(e) immediate disposal and incineration or burial of the bodies of animals which have died of the disease;
(f) prohibition on the use of manure from animals affected by or suspected of being infected; the derogation may be authorised by the veterinary department of the agricultural report of the District National Committee;
(g) a ban on entry into stables of persons other than operators and nursing workers in which animals affected by the disease are kept;
(h) isolation of persons or other restrictions on personal contact;
(ch) the obligation to immediately notify the competent authority of the health and anti-epidemic service of the presence of a disease which is communicable to humans and listed in the rules on combating diseases communicable to humans.
(6) The Ministry of Agriculture sets out the veterinary protection measures to be applied to each disease.
The closure for sites declared infected by the disease shall be kept and withdrawn:
(a) the district national committee, in respect of individual holdings of state goods, single agricultural cooperatives and other socialist sectors, as well as of individual holdings, or of a single municipality,
(b) a district national committee approved by the Regional National Committee, if there are several municipalities;
(c) the Regional National Committee, if the whole county, several counties or the whole county,
(d) the Ministry of Agriculture, if it is more than one region.
Special precautions against diseases.
(1) A state farm, a single agricultural cooperative or other breeding holding must undergo prior testing for brucellosis, tuberculosis and contagious udder inflammation. Animals who are sick or suspected of having one of those diseases shall be treated in accordance with the guidelines of the Ministry of Agriculture, which shall issue them in agreement with the Ministry of Health as regards the protection of people.
(2) Holdings infected with parasitic animal diseases are required to:
(a) to implement recovery measures in pastures, watercourses and stables;
(b) perform regular deworming of animals.
(3) The removal of forage from the holding or from a municipality infected with anthrax, anthrax, equine infectious anaemia, contagious bovine disease, bovine plague, glanders, foot-and-mouth disease, swine fever or brucellosis shall be prohibited; forage may only be used in such infected holdings and municipalities.
(4) Dogs and cats which have injured a person and other domestic animals if suspected of rabies must be placed and observed separately under the supervision of a veterinarian for a specified period of time. Dogs and cats suspected of being infected with rabies must be killed.
(5) Animals with obvious signs of pulmonary disease of bovine animals, rinderpest, rabies, poultry sickness and advanced and externally identifiable tuberculos of the lungs, intestines, uterus and udder must be killed.
(6) When rinderpest, contagious bovine pleuropneumonia or foreign foot-and-mouth disease is introduced into the territory of the State, all other animals from the consignment in which the disease was detected must be immediately slaughtered.
(7) Withdrawal of skin in cases of culling or death of animals on glanders, contagious equine anaemia, rabies, rinderpest, murmur, anthrax or suspected diseases shall be prohibited. The bodies of such animals, manure and litter shall be immediately destroyed and disinfecting according to the guidelines of the Ministry of Agriculture; the objects with which the killed or dead animals were in direct contact must also be disinfected.
The Ministry of Agriculture shall, as appropriate, order an examination of animals (horses, donkeys and mules) for glanders by a diagnostic test; animals suspected of glanders shall be handled in accordance with the guidelines of the Ministry of Agriculture.
It shall be established in municipalities in accordance with the guidelines of the Ministry of Agriculture issued in agreement with the ministries of health and interior collection of dead animals or a carcass.
Veterinary health measures at ransom points, slaughterhouses, markets and associated slaughterhouse facilities, raw milk collection centres and dairy establishments.
(1) Animals, including poultry, fish and game, and meat and raw materials of animal origin which come to the point of ransom, to markets, setups, shows or exhibitions of commercial or breeding animals, to slaughterhouses or to milk collection centres and to dairy holdings are under the health supervision of a veterinarian.
(2) Raw materials of animal origin include: meat, fats, blood, internal organs including intestines, milk, eggs, honey and wax, parts of the bodies of animals intended for technical processing (skin, fur, horns, bones, hooves and hooves, wool, horsehair, feathers, etc.).
(3) The following measures shall be carried out in all meat industry, slaughterhouses, mass-storage plants and all other places where animals are slaughtered:
(a) the animals must be examined daily by a veterinarian who must check at the same time that the veterinary health measures are complied with;
(b) the animals must be examined by a veterinarian before slaughter;
(c) for slaughtered animals, health checks must be carried out on meat and organs after slaughter;
(d) the compulsory stamping of the meat and the compulsory stamping or other marking of the hides must be carried out;
(e) the places of purchase or take-over for animals for slaughter, where they are at slaughterhouses, must be separated from the slaughterhouse operations;
(f) animals for slaughter transported to slaughterhouses must already be slaughtered; stables in slaughterhouses may only be used for slaughter animals;
(g) the slaughterhouse must have a special department for the slaughter of sick animals or animals suspected of being infected;
(h) to transport sick animals to slaughterhouses for the purpose of the necessary slaughter only by vehicles specially adapted for that purpose;
(ch) to transport raw materials of animal origin only by vehicles specially modified for that purpose;
(i) persons and wagons are subject to disinfection before leaving the places used to slaughter sick animals.
(1) Animals suffering from glanders, rabies, bovine plague, anthrax and murmur or animals suspected of causing these diseases must not be slaughtered in order to obtain meat. Meat of animals suffering from other diseases may only be used under specific conditions laid down by the Ministry of Agriculture in agreement with the Ministry of Health and Food.
(2) Milk of animals which have become tuberculosis-infected, contagious or foot-fed, or are suspected of such diseases, may only be used after pasteurisation or overcooking, for human consumption only if it is permitted by hygiene and anti-epidemic rules.
(3) The health inspection of animals for slaughter and meat and raw materials of animal origin is carried out in accordance with the guidelines issued by the Ministry of Agriculture in agreement with the Ministry of Health and Food.
Veterinary health measures for the transport of animals and raw materials of animal origin.
(1) The means of transport to be supplied for loading animals or raw materials of animal origin shall be thoroughly cleaned in advance and, if necessary, thoroughly disinfected.
(2) If, during transport, it is found that the animals have been infected with the disease or that raw materials of animal origin are infected with the disease, both health measures and anti-epizootic measures shall be carried out in accordance with the guidelines of the Ministry of Agriculture and if the disease is communicable to humans, the case shall be reported to the competent authority of the sanitary and anti-epidemic services.
(3) Animals or raw materials of animal origin imported from abroad may be transported to the place of destination only if they have been recognised as health-proof at the time of veterinary inspection.
(4) Exports of animals or raw materials of animal origin shall be allowed only on the basis of a certificate issued by the competent veterinarian.
(1) The Directive on the transport of animals and raw materials of animal origin, on the special treatment of means of transport used for the transport of animals and raw materials of animal origin and on their disinfection is issued by the Ministry of Agriculture in agreement with the ministries of health, railways, transport, food industry and redemption.
(2) The Directive on border veterinary inspection of animals and raw materials of animal origin is issued by the Ministry of Agriculture in agreement with the ministries of national security, health, external trade, railways and transport.
Final provisions.
The veterinary service in the field of military administration and national security is governed by specific regulations.
(1) The provisions of Act No. 4 / 1952 Coll., on sanitary and anti-epidemic care, remain unaffected.
(2) Where measures affecting the protection of both human and animal health are taken, the veterinary health authorities shall act in accordance with the measures ordered by the health and anti-epidemic services authorities.
The Ministry of Agriculture shall, in agreement with the participating ministries, issue detailed provisions for the implementation of this Regulation.
The provisions of this Regulation shall be repealed if they contravene this Regulation.
This Regulation shall enter into force on 1 January 1953; they shall be carried out by the Minister for Agriculture in agreement with the participating members of the Government.
