Ministry of Finance of the Czech Republic
of 14 February 1992
on the method of reimbursement by the State of the costs of land-based adjustments
The Ministry of Finance of the Czech Republic provides pursuant to § 10 paragraph 1 of the Act of the Czech National Council No. 284 / 1991 Coll., on land modification and land offices:
Subject matter
This decree regulates the way in which the costs of the development of land-use improvement, land-use identification, land-setting, geometrical plans, land-access costs and landscape protection and restoration costs borne by the State ("land-use adjustment costs') are to be paid.
Method of reimbursement of land-based adjustment costs
(1) The cost of land-use adjustment is borne by the State
a) through the budget of the Czech Office of Geodetic and Cartographic, 1) if
1. an inventory of plots, registers, list and register of owners and users in the form of outputs from the real estate information file, a copy of land maps, a copy of archived maps from the former land register, a basic map of ČSFR 1: 10 000, a basic map of ČSFR 1: 25 000 and a map of the counties of the Czech Republic 1: 100 000, in one copy for land modification proceedings,
2. listing of plots, list and register of owners and users in the form of outputs from the real estate information file, copies of land maps, copies of archived maps from the former land register, documents for the layout of the land and for the development of geometrical plans (in particular copies of coordinates and geodetic data), State map derived from 1: 5000, Basic map ČSFR 1: 10 000, or Basic map ČSFR 1: 25 000, in one copy for the preparation of individual land modifications,
3. o administrative action2) between public authorities, 3)
(b) through the budgets of the district offices and the capital of Prague, whose land offices (4) decide on and organise their implementation, (5) if other costs are involved.
(2) In the budgets of the district offices and the capital city of Prague, a subsidy from the state budget is used for this purpose by the state budget of the Czech Republic for the calendar year in question.
(3) In agreement with the Ministry of the Environment of the Czech Republic, the Czech Ministry of Finance of the Czech Republic submits the proposal for the subsidy referred to in paragraph 2 for each district and capital city of Prague. 6)
Efficacy
This decree shall take effect on the day of its publication.
