ORDER
GOVERNMENTS OF THE CZECH REPUBLIC
of 26 February 2021
on the adoption of crisis measures
Following the Government Resolution No. 196 of 26 February 2021 by which the Government, in accordance with Article 5 and 6 of Constitutional Act No. 110 / 1998 Coll., on the Security of the Czech Republic, declared emergency in accordance with Article 5 (a) to (e) and § 6 of the Act No. 240 / 2000 Coll., on emergency management and on the amendment of certain laws (Crisis Act), as amended, for the resolution of the crisis situation, the adoption of emergency measures within the meaning of § 5 (e) and § 6 (1) (b) respectively.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
I. prohibits
1. retail sale and sale and provision of services at premises, except for the following establishments:
(a) food stores;
(b) fuel outlets and other needs for the operation of motor vehicles;
(c) fuel outlets;
(d) stores of sanitary goods, cosmetics and other druggie goods,
(e) pharmacies, dispensers and medical devices outlets;
(f) sales of small domestic animals,
(g) sales of feed and other animal needs;
(h) sales of glasses, contact lenses and related goods;
(i) newspapers and magazines,
(j) tobacco stores;
(k) laundry and dry cleaners,
(l) road vehicle service and repair facilities;
(m) the premises of the towing providers and the removal of in-service vehicle defects on the road;
(n) sales of spare parts for means of transport and manufacturing,
(o) establishments permitting the collection of goods and consignments purchased in a distance manner;
(p) garden shops, including seed and seed;
(q) ticket ticket bill,
(r) florists;
(s) facilities for the negotiation and disposal of construction, project activity under construction, geological work, surveying, testing, measurement and analysis in construction,
(t) sales of textile material and textiles,
(u) computer and telecommunications services, audio and video receivers, consumer electronics, appliances and other household products,
(v) real estate brokerage establishments and the activities of accountants, accounting, tax records,
(w) locking and servicing of other household products,
(x) repair, maintenance and installation of household machinery and equipment,
(y) funeral services, embalming and preserving, cremation of human remains or human remains, including the storage of human remains in Urenas;
z) car washing machines,
(aa) domestic and hardware stores, where furniture, carpets and other floor coverings are not considered as household supplies;
(ab) establishments collecting and purchasing raw materials and composting plants;
ac) stone processing plants (e.g. the production of monuments, tombstones and their installation),
(ad) establishments (including mobile plants) with the sale of piety goods, such as wreaths, flower decorations for graves, piety candles, etc.; for these establishments there is no prohibition of sale in mobile plants referred to in point I / 7;
ae) establishments providing treatment and cutting services for dogs and cats,
(af) arms and ammunition sales,
(ag) paper-making;
ah) children's clothing and footwear stores,
(ai) taxis or other individual carriage of passengers;
(iii) a day-care establishment under three years of age,
(ak) establishments where psychodiagnostic examinations are carried out, which are an integral part of the selection procedures and, consequently, the necessary condition laid down by law for the performance of a particular activity;
where other goods and services are prohibited from being sold or supplied in such stores or establishments; This prohibition shall not apply to non-commercial activities under the Trade Code; Furthermore, this prohibition does not apply to establishments in which retail sales and sales and the provision of services which are not prohibited do not constitute an exclusive activity in an establishment, but the part of the establishment in which retail sales and sales and the provision of services which are not prohibited are separated from other parts of the establishment to which customers are not allowed access,
2. the presence of the public in food service establishments (e.g. restaurants, pubs and bars), except:
(a) in establishments which do not serve the public (e.g. occupational catering, catering of health and social services providers, in prison facilities),
(b) school meals for staff present at the workplace and for children, pupils and students participating in preschool education;
(c) in accommodation establishments, provided that they provide meals only to persons admitted, only between 05: 00 and 20: 59;
This is without prejudice to the possibility of selling off-site catering services (e.g. fast food establishments with a window or the sale of food with them), with the prohibition of selling to customers at the place of the establishment (e.g. dispensing window) between 21.00 and 4.59 hours,
3.
(a) concerts and other musical, theatre, film and other artistic performances including circuses and varieté with the presence of spectators; without spectators, these performances may be held or tested only if they are carried out by artists who do so in the context of a job or business, provided that:
(i) the breathing protection device of the practitioner may be postponed only at the place of performance of his own production and only for the duration of that production;
(ii) if the stage work is part of a song, the number of performers on the stage or in the examination room shall be limited in such a way that the total number of performers shall not exceed the number of square metres of the total floor area of the stage or test room divided by four;
(iii) for players of all tool groups, it is necessary to follow intervals of at least 1.2 metres and each player on string tools shall use a separate note counter if space conditions permit;
(b) pilgrims and similar traditional events,
(c) congresses, educational events and examinations in presentation form, except:
(i) practical teaching and practice according to Act No. 95 / 2004 Coll., on the conditions for obtaining and recognising professional competence and specialised competence for the exercise of the medical profession of a physician, dental practitioner and pharmacist, as amended, and under Act No. 96 / 2004 Coll., on the conditions for the acquisition and recognition of competence for the pursuit of non-medical medical professions and for the exercise of activities related to the provision of medical care and on the amendment of certain related laws (Law on non-medical medical medical professions), as amended, and on the practical preparation for the pursuit of a regulated profession by a social worker under Act No. 108 / 2006 Coll., on social services, as amended,
(ii) professional training of members of the security corps of the Czech Republic, officers of municipal police, members of the Fire Rescue Corps of the Czech Republic and members of fire protection units;
(iii) activities under Act No. 247 / 2000 Coll., on the acquisition and improvement of professional competence for the management of motor vehicles and on amendments to certain laws, as amended, and Act No. 266 / 1994 Coll., on Railways, as amended, and on Transport Psychological Examinations pursuant to Act No. 361 / 2000 Coll., on Road Traffic and on Amendments to Certain Acts,
(iv) the activities leading to the acquisition of special professional competence pursuant to Article 11 of Act No. 309 / 2006 Coll., as amended, and the activities leading to the overcoming of the conditions under Section 3 (10) (d) of Decree No. 87 / 2000 Coll., laying down the conditions of fire safety in welding and heating of lives in melting containers,
(v) other training actions and examinations from professional qualifications and other examinations, the composition of which is a condition laid down by law for the pursuit of certain activities, courses with an accredited programme according to Act No. 108 / 2006 Coll., on Social Services, as amended, and the retraining courses secured by the Office of Labour of the Czech Republic or the Ministry of Labour and Social Affairs under Act No. 435 / 2004 Coll., on Employment, as amended, on the acquisition of professional qualifications by passing the exam according to Act No. 179 / 2006 Coll., on the verification and recognition of the results of further education, and on the amendment of the Act No. 111 / 1998 Coll.
the presence of more than 10 persons shall be prohibited at one time and, if the test is public, more than 3 persons from the public; Furthermore, it shall be prohibited to stay in a motor vehicle without a respirator of at least class FFP2 or KN95 without an exhaust valve during a practical journey with a training vehicle in the context of a proficiency test to drive motor vehicles,
(d) fairs,
(e) the operation of gambling, casinos and betting offices;
(f) the operation and use of sport sites in the indoor areas of buildings (e.g. gyms, playgrounds, ice rink, courts, rings, bowling or billiards, training facilities) and the internal premises of outdoor sports sites, dance studies, gym and fitness centres, with the exception of sports activities in schools or educational establishments and universities, where emergency measures allow, and with the exception of training carried out by persons in the framework of employment, business or other similar activities such as preparation for sporting events held in competitions organised sports associations, and sports events which are not prohibited;
(g) the operation and use of artificial swimming pools (swimming pool, bath pool, infant pool and toddlers, paddling grounds), wellness facilities including saunas, solarium and salt caves, unless it is a health service provider;
(h) visits and inspections of zoos and botanical gardens;
(i) visits and tours of museums, galleries, exhibition premises, castles, castles and similar historical or cultural objects, observatories and planetariums;
j) the operation of an establishment or the provision of services to persons aged between 6 and 18 who are engaged in activities similar to those of interest education pursuant to § 2 of Decree No. 74 / 2005 Coll., such as in particular an interest, educational, recreational or educational activity, including preparation for teaching;
(k) the operation of ski lifts and cableway installations with the exception of the use of cableway installations to provide transport services in the framework of public services and the use of ski lifts and cableway installations to ensure the supply or operation of critical infrastructure or for the needs of components of the Integrated Rescue System, including the Mountain Service;
4. the provision of accommodation services, with the exception of the provision of accommodation services:
(a) only to persons for whom such accommodation is necessary for the pursuit of employment, occupation, business or other similar activities, provided that:
(i) that purpose shall be demonstrated by any person who is allowed to stay before the accommodation is opened by a written confirmation of the employer or the client;
(ii) the operator is obliged to require proof of the purpose referred to in (i) and to keep it throughout the stay of the person staying;
(b) persons required under the Crisis Act;
(c) foreigners who have no other residence in the Czech Republic and who are authorised to enter and stay in the Czech Republic in accordance with other regulations,
(d) persons ordered to be isolated or quarantined;
(e) persons for the purpose of completing accommodation initiated before the application of this Government Order, if they have no other residence in the Czech Republic,
(f) persons who are accommodated in order to receive health services and their necessary escort;
5. drinking alcoholic beverages in public places; this is without prejudice to the possibility of drinking alcoholic beverages in the indoor premises of catering services,
6. retail sale and sale and provision of services at premises on public holidays and on other holidays throughout the day and on other days in the time between 21.00 and 4.59 hours, provided that this prohibition does not apply to non-business activities under trade law and to the operation of:
(a) petrol and lubricant filling stations;
(b) pharmacies,
(c) shops at points of increased passenger concentration at airports, railway stations and bus stations;
(d) shops in medical establishments;
(e) food service establishments within the scope of point I / 2;
(f) taxis or other individual carriage of passengers;
7. sales in markets, markets and mobile plants (sales in stalls, mobile shops and sales from other mobile devices), walking and door-to-door sales; the prohibition does not apply to mobile shops providing for the sale of food and drugist goods in municipalities where such goods cannot be purchased at another establishment;
II. limits
1. the operation of an establishment of catering services where public presence in an establishment as referred to in point I / 2 is not prohibited, so that their operators must comply with the following rules:
(a) customers shall be so established that the distance between them is at least 1,5 metres, except for customers sitting at one table;
(b) not more than 4 customers sit at one table, except for members of the household; In the case of a long table, it may accommodate several customers so that there is a distribution of at least 2 metres between groups of not more than 4 customers, with the exception of household members,
(c) the operator shall not allow more customers in the interior of the establishment than in the interior of the establishment of seating places for customers; the operator is obliged to record in writing the total current number of seating positions for customers;
(d) the prohibition on the production of live music and dance;
e) the possibility of wireless connection to the Internet for the public will not be provided;
2. the operation of the establishment of catering services in such a way that, in the case of sale from the establishment of catering services outside its internal premises (e.g. a window of dispensation), persons who consume food and food, including drinks purchased there (except for alcoholic beverages, the drinking of which is prohibited in public places), are required to keep spacing from other persons at least 2 metres, not for household members;
3. the operation of musical, dance, games and similar social clubs and discos by prohibiting the presence of the public;
4. the activity of shopping centres with a sales area exceeding 5 000 m2 so that
(a) the use of resting places (chairs, chairs, benches, etc.) is restricted so as not to be places of assembly;
(b) the possibility of wireless Internet connection for the public is not provided;
(c) the operator shall ensure at least one person oversees compliance with the following rules and shall act on customers and other persons to comply with them;
(d) the following customer instructions are communicated to customers and other persons, in particular by means of information boards, leaflets, screens, radio, etc.,
(e) the operator shall ensure a visible indication of the order to comply with the 2 metres spread between persons on publicly accessible areas in the shopping centre (e.g. in the form of info, radio centre spots, information at the entrance to stores and other premises, information on the floor of public spaces, etc.),
(f) the assembly of persons is prevented, in particular in all places where this can be expected, e.g. entrances from underground garages, spaces in front of elevators, escalators, travelers, toilets, etc.,
(g) the operation of children's corners is prohibited;
h) the operator ensures the maximum possible air circulation with outdoor air intake (ventilation or air conditioning) without air recirculation in the object;
(i) promotional activities in shops where a natural person is present to ensure their conduct are prohibited;
(j) sales from the establishment of catering services located within the shopping centre are only possible through the window or as food with them;
5. the operation of libraries in such a way as to prohibit the supply of other than pre-ordered borrowings and their return through the window or without contact; for non-contact handover of borrowings, it is recommended to use a respirator without a breathing valve of at least FFP2 or KN95 class,
6. operating at the premises referred to in point I / 1 whose operation is not prohibited, with the exception of taxis or other individual carriage of passengers, by the operator complying with the following rules:
(a) in an establishment it shall not allow more customers than 1 customer per 15 m2 of sales space; in the case of an establishment with a sales area of less than 15 m2, this restriction shall not apply to a child under 15 years of age accompanying a customer and accompanying a customer holding a disabled person's licence; in the case of other establishments, this restriction shall not apply to a child under 6 years of age accompanying the customer;
(b) actively prevent customers from staying less than 2 metres away, except for persons from the common household;
(c) ensure the management of fronts of waiting customers, both inside and outside the establishment, in particular with the help of indicating the area for waiting and placing marks for minimum spacing between customers (minimum spacing of 2 metres), the customer holding a disabled person's licence having the right of priority purchase;
(d) place disinfectants on frequently touched articles (mainly handles, railings, shopping carts) so that they are available to employees and customers of the premises and can be used for regular disinfection;
(e) ensure that customers are informed of the above rules, in particular by means of information posters at the entrance and at the premises, and, where appropriate, by communicating the rules of the loudspeakers at the premises;
f) ensure maximum possible air circulation with outdoor air intake (ventilation or air conditioning) without air recirculation in the building,
(g) promotional activities are prohibited in stores where a natural person is present to ensure their conduct;
(h) in the case of a person carrying a stroller with a child, the operator must not require that he uses a shopping cart for purchase, and the child in the stroller shall not be counted against the total permissible number of persons per sales space;
the sales area means the part of the establishment which is intended for the sale and display of goods, i.e. the total area to which customers have access, including test rooms, the area occupied by desks and interpretations, the area behind desks used by sellers; The sales space shall not include offices, warehouses and preparation rooms, workshops, staircases, dressing rooms and other public spaces.
