on forest management and its contributions
The Ministry of Forestry and Water Management of the Czech Socialist Republic provides pursuant to Section 15 of the Act of the Czech National Council No. 96 / 1977 Coll., on Forestry Management and the Government Administration of Forestry:
EXECUTIVE MANAGEMENT OF WOODS
(1) Organisation for forest management in the performance of professional management tasks
(a) ensure the development of technical documentation for forest economic plans;
(b) supervise and keep an overview of the results of the management of forest users in professional management (hereinafter referred to as "forest users") in accordance with approved forest management plans;
(c) draw up, pursuant to approved forest management plans, annual forest production plans in the cultivation and forest conservation activities and determine measures to improve forest functions, inform in writing the tasks arising from these forest user plans and measures and require and monitor the performance of these tasks;
(d) discuss with forest users how to carry out tasks in the growing, mining and, where appropriate, other activities related to forest management in the place where the tasks are to be carried out and give them more detailed guidance on the implementation of each work;
(e) provide seed and seedling for forest renewal in professional management;
(f) indicate the extraction and educational intervention in forest areas in accordance with the tasks arising from approved forest plans;
(g) require the users of forests to process random extractions and apply the impact of these exceptional events to the annual forest production plans;
(h) maintain forest economic records and reports of performance carried out in forests in professional management;
(i) monitor and require the proper protection of forests in professional administration in accordance with the principles of sound management, in particular the presence of harmful factors;
(j) provide forest users with technical explanations for their application on issues relating to forest management in professional management and protection;
(k) report regularly to the authorities of the state administration of the forestry sector on the performance of forest tasks in the professional administration and notify them of infringements of forest management rules;
(l) provide forest users with the necessary documentation and, where appropriate, data from forest plans;
(m) keep in the framework of their own (corporate) forest land records in the professional administration, with the indication of their users, normally complementing it according to the notification of forest users and comparing it annually with real estate records kept by geodesy and cartography authorities;
(n) give incentives to eliminate the differences found between the real estate stock and the actual situation.
(2) The basic task of the professional management of forests with a limited scope (1) is to ensure the development of expertise for forest economic plans and supervision, as managed under these plans; any other tasks of forest management shall be specified in the individual decisions of the Ministry of Forestry and Water of the Czech Socialist Republic to limit the scope of forest management.
Forest management organisations shall cooperate with forest users who shall:
(a) participate at the invitation of the organisation carrying out the professional management of forests to discuss the way in which the tasks are to be carried out in the cultivation, mining and, where appropriate, other activities related to forest management on the site where the tasks are to be carried out;
(b) proceed with forest management in professional management in accordance with the guidelines of the organisation carrying out forest management;
(c) notify without delay the organisation carrying out the professional management of forests of the fulfilment of tasks, changes in the management, ownership or use of forests in the professional administration and changes in its address or, where appropriate, its name and registered office, and communicate to it the decisions of other state bodies concerning the forest in the professional administration.
CONTRIBUTIONS TO FOREIGN MANAGEMENT
(1) The forest management allowance shall be paid by the person who is the user of forest land on 1 January of the current year.
(2) The amount of annual contributions is determined by:

(3) In order to determine the contributions, the area of forest land up to 1 ha shall be considered as a whole hectare, the area up to 0,50 ha shall always be rounded downwards and the area above 0,50 ha upwards.
(4) The contribution does not include payment for the supply of seeds and seedlings of forest trees.
(1) The forest management contribution shall be paid by the forest user on the basis of a call for contributions. The invitation shall be sent by the organisation responsible for forest management, as recommended by the end of March of the current year, indicating the area of the forest from which the contribution is intended, the amount of the contribution and the year for which the contribution is determined.
(2) The allowance shall be payable within 15 days of receipt of the call for payment of the allowance.
(3) The contributions due which have not been paid are enforced by organisations carrying out professional forest management in civil or arbitral proceedings.
In exceptional cases, the Ministry of Forestry and Water Management of the Czech Socialist Republic may allow an exemption from the payment of contributions for professional forest management.
COMMON AND FINAL PROVISIONS
If the forest management organisation finds that the forest user has failed to comply with the obligations laid down in this Decree, it shall submit to the forestry authority an incentive or, where appropriate, a proposal for the necessary measures; It shall act mutatis mutandis if the forest user has not implemented the measures of the State Administration of the Forestry Authority or has failed by that authority to fulfil the task assigned to the annual forest production plan or timber deliveries.
State organisations which have been granted a derogation to the management of forest national property pursuant to § 18 of Act No. 166 / 1960 Coll., pay contributions for the professional management of forests under this decree starting on 1 January 1979.
They shall be deleted:
1. decree of the Ministry of Forestry and Water Management of the Czech Socialist Republic No. 173 / 1973 Coll., on the purchase of timber from the forest, as amended by Decree No. 179 / 1975 Coll.;
2. the Decree of the Ministry of Agriculture, Forestry and Water Management No 89 / 1965 Coll., on the protection of trees growing outside the forest, as amended by Regulations No 154 / 1968 Coll. and No 142 / 1969 Coll.;
3. principles for the exercise of professional management in forests managed by own forestry operators (Collection of Guidelines of State Forests 1964, Article 65, registered in the amount 47 / 1967 Coll.).
This Decree shall take effect on 1 January 1978.
