Ministry of Education of the Slovak Socialist Republic and Ministry of Health of the Slovak Socialist Republic
of 27 July 1979
on the provision of scholarships and physical security to students of gymnastics, vocational schools, secondary vocational schools, conservatories and secondary schools for workers
The Ministry of Education of the Slovak Socialist Republic and the Ministry of Health of the Slovak Socialist Republic shall, in agreement with the Ministry of Labour and Social Affairs of the Slovak Socialist Republic and after consultation with the participating central authorities pursuant to § 40 (3) (b) of Act No. 63 / 1978 Coll., on measures in the system of primary and secondary schools and pursuant to § 25 (2) of the Slovak National Council Act No. 79 / 1978 Coll., on State Administration in Education:
Scope
(1) This decree provides for the provision of scholarships and physical security to pupils of daily studies in gymnasiums, vocational schools, secondary vocational schools, conservators and cyclists in secondary schools for workers.
(2) Exceptionally, a grant may be granted from state budget funds to pupils who are not Czechoslovak state citizens.
(3) This decree does not apply to pupils of secondary military schools, secondary schools of the National Security and Secondary Schools of the Slovak Socialist Republic.
STIPENDIUM AND HUMAN SECURITY FROM THE STATE BUDGET ENVIRONMENT
Scholarship provided taking into account social circumstances and benefits
Conditions for grant of a scholarship
(1) A scholarship from state budget funds at their request, taking into account their social circumstances and benefits, is granted to students of daily studies at Gymnasium, Vocational Schools, Secondary Vocational Schools and Conservatives; This scholarship shall not be granted to students of daily studies in secondary vocational schools if they receive a scholarship and physical security from the resources of state economic, cooperative and social organisations under an agreement concluded under Paragraph 10 (2).
(2) The student's application for a scholarship is submitted annually on the prescribed form at the beginning of the school year to the principal of the school at which he studies; If the pupil is not of age, the application shall also be signed by the legal representative of the pupil.
(3) Verification of the conditions under paragraphs 5 to 9 and Article 3 applicable to the award of the scholarship shall be carried out by the end of February of the current year. On the basis of this verification, the scholarship shall be newly awarded or withdrawn retroactively from 1 February.
(4) If a student applies for a scholarship during the school year, he shall be granted a scholarship from the first day of the month in which the application was submitted.
(5) In order to establish social conditions for childless single, widowed, divorced or for other serious reasons of solitary pupils and for childless married pupils whose spouse is not employed, the average net monthly income corresponding to one member of the parent's household or one member of the household of one parent of his spouse shall be determined. For a student whose spouse is employed, the average net monthly income per member of his household shall be determined; If the student's husband performs basic military service, the amount of the allowance shall be determined.
(6) If parents are divorced, they are based on the average net monthly income per member of the household of the parent to whom the child (pupil) has been given custody.
(7) If the pupil is not in the care of either of the parents, the maintenance allowance provided for by the court shall be paid to both parents.
(8) In the case of non-childcare pupils and whose spouse is not employed, single, divorced, widowed or other serious reasons for single pupils with undependent children, and in the case of two-sided or foster-care pupils, the amount of the average net monthly income per member of the household shall not be determined except in cases where the pupil has income from a work (member) relationship or from an invalidity, partial disability pension exceeding 800 Kčs per month.
(9) The average benefit of pupils in the first half of the year shall be collected according to the annual report from the school they last attended; for the second half of the year for pupils in the first years and for pupils in other years of study according to the average benefit of the previous half. A pupil may not benefit from compulsory subjects less than 2,5, a grade 5 mark and a grade less than 1 grade from any compulsory subject and a grade less than 1.
(10) The pupil, and if he is not an adult, his legal representative, is obliged to immediately notify the school director of any circumstances which might affect the provision or the amount of the scholarship.
(11) If a scholarship has been awarded as a result of false or incomplete data, incorrectly or in silence, if the pupil or his legal representative has changed the circumstances in which he or she was granted or retained at the specified amount, the pupil shall be obliged to repay the amount wrongly received. If the pupil is not of age, he shall be returned by the legal representative of the pupil who signed the application.
(12) There is no grant of a scholarship when repeating a year.
Calculation of average net monthly income
(1) The average net monthly income for the determination of social circumstances shall be the monthly average of the money or money payable less the wage tax and, where applicable, of any other tax which is subject to such income, which has been achieved by:
(a) both parents and pupils,
(b) one of the parents, his husband and pupil,
(c) the spouse of the pupil and the pupil.
The average net monthly income shall be calculated on the basis of the income for the previous calendar year, provided that there has been no change in the basic wage or basic remuneration since then, or the working (member, professional) ratio of one of the parents or spouse of the pupil. In the event of a change in the basic salary or basic remuneration, the average net monthly wage (remuneration) shall be taken as a basis from the date of the change in the basic salary (remuneration) plus the average net monthly income obtained from variable components of the salary (remuneration) of the previous calendar year. If, in the previous or current calendar year, one of the parents or spouse of the pupil has entered employment, the average net monthly income shall be calculated from the date of entry into employment.
(2) The income underlying the survey of the average net monthly income includes:
(a) revenue from, or in connection with, the employment relationship and other revenue:
1. wages,
2. remuneration for ancillary activities;
3. stabilisation fees for years worked and stabilisation recruitment fees and allowances,
4. share of economic results,
5. Annual remuneration for managers,
6. in-kind benefits and other similar benefits which are due to the worker even in his absence at work,
7. additional remuneration of members of production cooperatives,
8. Reimbursement of wages paid to workers for the period during which they did not work (e.g. for a vacation to be recovered) and compensation for unspent leave;
(b) income from the work of a member of the JZD, which is:
1. basic remuneration, including allowances and allowances for such basic remuneration;
2. premium,
3. the performance and exceptional remuneration paid for the results of the work of a member of the cooperative and included in the costs of the cooperative,
4. the premiums and fees for which special-purpose subsidies were granted to the cooperative;
5. in-kind benefits and other benefits, if the income in question belongs to a member of the cooperative even at the time of incapacity for work;
6. share of economic results,
7. Annual remuneration of managers,
8. stabilisation fees for years worked and stabilisation recruitment fees,
9. Reimbursement of the remuneration paid to members of the cooperative for the period during which they did not work (e.g. for a vacation to be recovered) and compensation for unspent leave;
(c) revenue from activities held in proportion to the employment relationship and revenue from activities under non-employment agreements, which are:
1. pay for work paid by any organisation to persons who are not in employment but who are working for it under a non-employment agreement (employment agreements and employment agreements),
2. income from the operation of music in sets of folk musicians,
3. the remuneration of experts and interpreters appointed by the competent authority in the proceedings for expert and interpretation,
4. remuneration paid to persons in connection with the resolution of the tasks of scientific and technological development; thematic tasks; rewards for inventions of discoveries, improvements, designs; for proposals for new ways of preventing, diagnosing and treating animals and for new ways of protecting plants against pests,
5. Exceptional one-off remuneration paid to workers on the occasion of the award of honours, in the amount subject to taxation;
6. exceptional one-off remuneration paid to workers for specific results in the evaluation of the socialist competition organised and evaluated according to internal principles issued in accordance with the guidelines of the Government of the Czechoslovak Socialist Republic and the Central Council of Trade Unions, the Central Council of Cooperatives and the Central Committee of the Association of Cooperative Farmers and, where appropriate, other central bodies at the same level, to develop the workers' initiative;
7. remuneration for work carried out in connection with membership of organisations or collective bodies, whether paid in cash or credited to members' shares;
(d) income subject to public income tax; 1)
(e) income subject to tax on the income of citizens from agricultural production; 2)
(f) income of citizens subject to tax on literary and artistic activities; 3)
(g) sick leave; compensation in pregnancy and maternity; financial assistance in motherhood; support for the treatment of family members;
(h) pension security benefits (4), except those referred to in paragraph 3;
(i) provision allowance; 4)
(j) maintenance (maintenance allowance) from other persons designated by a court decision or provided by an agreement approved by the court;
(k) deductions to cover maintenance for the benefit of children carried out on the basis of the remuneration of persons in prison or in custody; 5)
(l) the income of the pupil from the employment (member) ratio and invalidity and partial disability pension exceeding 800 Kns per month.
(3) The income underlying the survey of average net monthly income does not include:
(a) child allowance and supplement;
(b) education and training supplement;
(c) increase in pension and education for helplessness;
(d) orphan's pension;
(e) the remuneration of a foster parent;
(f) a contribution to cover the needs and the child in foster care; 6)
(g) cash contributions and social assistance;
(h) aid at the time of birth of the child;
(i) maternity allowance;
(j) remuneration to voluntary care workers;
(k) provided for life and working years; 7)
(l) death grants;
(m) cash benefits for contract insurance;
(n) the remuneration of the pupil for work under agreements on work outside the employment relationship, the remuneration resulting from the employment relationship under the framework contract or from civil assistance;
(o) the income of the student from the employment (member) ratio and the invalidity and partial disability pension up to 800 Kns per month.
(4) The average net monthly income shall be deducted from the amount determined by the court to one of the parents of the pupil or pupil, or his spouse, to fulfil the maintenance obligation.
(5) The net monthly income per member of the household shall be determined by dividing the income of the parent, pupil or spouse by the number of members of the household.
(6) The following shall be considered as members of the household:
(a) parents and their own or adopted dependent children; (8) (hereinafter referred to as "dependent children"), where the average net monthly income is collected from the parents of the pupil;
(b) the pupil, his or her spouse and their dependent children where the average net monthly income is collected from the student's spouse.
(7) The pupil shall be counted as two members of the household where:
(a) a single, divorced, widowed or for other serious reasons a single parent takes care of the family;
(b) both parents are pensioners and, in addition to their pension, have no income from the work;
(c) the pupil is married (the pupil is married).
Scholarship amount
(1) The scholarship is granted for a period of 10 months from the beginning of the school year, taking into account social circumstances and benefits; its above is:

(2) In the case of pupils referred to in § 2 (8), a scholarship shall be granted for an average benefit of between 1,0 and 1,5 at the rate of 400 CZK, over 1,5 to 2,0 at the rate of 350 CZK, over 2,0 to 2,5 at the rate of 300 CZK per month.
(3) The scholarship referred to in paragraphs 1 and 2 is increased by:
(a) pupils of the 5th and 6th year of conservatory and pupils of the 6th and 7th year of conservatory for youth with visual defects

(b) pupils of the fourth year of Gymnasium and Vocational Schools, concentrated in classes for preparation for higher education abroad, and pupils of classes and schools for gifted and talented pupils, provided they are housed in youth homes by 200 Kns a month, provided that their benefit is not less than 2,0;
(c) pupils with a total of 100 Kcs per month.
(4) A scholarship of 200 CZK per month shall be granted to pupils in the fourth year of Gymnasium and secondary vocational schools, concentrated in the classes for preparation for higher education abroad, and pupils in the classes and schools for gifted and talented pupils, housed in youth homes, whose average net monthly income per member of the household is greater than 650 Kčs per month but not more than 1000 Kčs per month, and whose average benefit is not less than 2,0.
Scholarship to pupils - mothers
Conditions for the grant of a scholarship and its amount
(1 The grant shall also be granted if the pupils with dependent children are awarded a scholarship under Section 4.
(2) The scholarship referred to in paragraph 1 shall be provided throughout the course of the studies, including repeated years.
(3) A pupil who is born at the time of her studies at a school shall be granted a scholarship equivalent to that provided for in paragraph 1, retroactively starting on the first day of the calendar month in which the beginning of the fourth week before the birth falls; the pupil is granted a scholarship in accordance with § 4 (1) and § 3 (a) and (c) for the same period, provided that he fulfils the conditions for granting it.
(4) A pupil who is born within four weeks of completion of her studies at a school shall be granted a scholarship at the rate laid down in paragraph 1 retroactively starting on the first day of the calendar month in which the beginning of the fourth week before the birth falls; the pupil shall be granted a scholarship in accordance with Article 4 (1), (2) and (3) (a) and (c) for the same period, provided that he fulfils the conditions for granting it. The scholarship thus awarded shall be granted in the month in which the studies were completed.
(5) A pupil who is born a dead child or whose child dies within six weeks of childbirth shall be awarded the scholarship referred to in paragraph 1 for the calendar month in which the end of the sixth week from the date of birth falls; the pupil shall be granted a scholarship in accordance with Article 4 (1), (2) and (3) (a) and (c) for the same period, provided that he fulfils the conditions for granting it.
(6) A pupil who has ceased caring for a born child and has therefore been entrusted with a measure of the competent authority (court of the national committee) to family or constitutional care replacing the care of parents and a pupil whose child is in constitutional care for reasons other than health, the payment of a scholarship referred to in paragraph 1 shall be suspended from the first day of the calendar month following the implementation of this measure; for the purpose of granting the scholarship referred to in paragraphs 1 and 4 (1) and (2), the pupil shall be treated as if she had no child.
Exceptional scholarship
Conditions for the grant of a scholarship and its amount
(1
(a) if the pupil has an average benefit of between 1,0 and 1,5 and the average net monthly income per member of the household does not exceed 800 CZK; or
(b) if the student has an average benefit of between 2,5 and 3,0 and the average net monthly income per member of the household does not exceed 500 CZK.
(2) A student who receives a scholarship under § 4 (1) and (2) may be granted an exceptional scholarship in the event of an exceptional social situation in the family up to 250 Cds per month; the total amount of the two scholarships shall not exceed 400 CZK per month. Pupils receiving a scholarship in accordance with § 4 (1) and (2) of the 400 Cds per month may be granted an exceptional scholarship of 100 Cds per month if the exceptional social situation in the family so requires.
(3) A pupil who repeats the year for health or other serious reasons may be granted an exceptional scholarship of up to 200 CZK per month if the average net monthly income per member of the household does not exceed 500 CZK.
(4) The amount of funding for exceptional scholarships for the relevant calendar year is determined by the Regional National Committee in the breakdown of the tasks of the State Budget.
Deciding on scholarships and paying them
Decision-making on scholarships
(1) The award and withdrawal of the scholarship provided for in Part One shall be decided by the school director; as regards the scholarship provided for in Article 1 (2), with the agreement of the Regional National Committee.
(2) In order to prepare the documents for the award of scholarships, the school director shall appoint a scholarship committee as his advisory body, the members of which are class teachers, representatives of the Association of Parents and Friends of the School, the Socialist Youth Union and the School Manager.
(3) A pupil may oppose the decision of the school director and if the minor is his parents or other legal representatives through the school director to appeal to the Regional National Committee which shall lead the school professionally.
Payment of scholarships
The scholarship shall be paid at the time specified by the school director; the dates for the payment of scholarships for the whole school year shall be published by the school director before the beginning of the school year. The scholarship will not be paid unless the pupil picks it up without serious reasons or in the next month's pay term. In cases of special consideration due to the principal of the school and within a maximum of two months, the payment of unrecovered scholarships shall be authorised retroactively.
Material security
The meals of pupils in school and boarding rooms, meals and accommodation of pupils in youth homes, the provision of a fare discount for public transport by public public transport means are regulated by specific regulations. 9)
STIPENDIUM AND COMPETITION FROM THE ENVIRONMENT OF STATE ECONOMIC ORGANISATIONS, COMPLIANCE AND COMMON ORGANISATIONS
Conditions for grant of a scholarship and physical security
(1
(2) A scholarship and physical security may be provided if the pupil and the organisations referred to in paragraph 1 conclude a written agreement in which the pupil undertakes to work in the organisation for a period of 3 to 5 years after leaving high school and to return the scholarship or the corresponding part thereof if he fails to comply with the agreement. If it is a minor, the organisation shall request the expression of the legal representative of the pupil to conclude the agreement.
(3) The agreement referred to in paragraph 2 may be concluded by the pupil upon completion of compulsory education.
(4) The pupil is obliged to submit a copy of the agreement to the school head of the school at which he is studying.
(5) State economic organisations, cooperative organisations and social organisations will normally sign up for bankruptcy scholarships and inform the school concerned thereof.
(6) When the year is repeated, a scholarship and physical security may be provided if the repetition is for family, health or other serious reasons.
Scholarship amount
(1) A scholarship is granted to students in secondary vocational schools for each month of the school year in the range of 400 to 600 CZK per month; in determining the level of the scholarship, account shall be taken of the importance of the field of study, the previous study results and the participation of the pupil in the social work. The scholarship is intended mainly for pupils of the last two years of study.
(2
(a) those working in secondary schools for workers up to three years after the end of the teaching relationship between 300 and 600 CZK per month;
(b) those working in secondary schools for practitioners over three years of age, if they have not reached 25 years of age, within a range of 500 to 800 Cds per month;
(c) working in secondary schools for workers over 25 years of age in the range of 700 to 1000 CZK per month.
(3) Where students of cyclical studies in secondary schools participate in a course lasting only part of a calendar month and work in the remaining time, they shall be granted a proportion of the monthly scholarship.
Material security
(1) The meals of pupils in school and boarding canteens, meals and accommodation of pupils in young people's homes, the provision of a fare discount for public transport by public public transport means are regulated by specific regulations. 9)
(2) Mass security also includes:
(a) the reimbursement of the proven fare for the carriage of public bulk vehicles at school and at the end of the school year, as well as the reimbursement of the proven fare to visit the family during the school year; for married pupils, the fare shall not exceed once a month and for single pupils, once every three months. The fare for the second carriage class of the passenger train shall be paid when the train is driving, and for a distance of over 100 km, the express fee shall be charged. The reimbursement of the fare shall be granted only up to the amount of the fare at a discount granted under the special rules. 9) Expenditure on local travel organisations shall not be reimbursed;
(b) a contribution to a husband who cannot be employed of 500 Kns per month; where the spouse receives sickness, maternity allowance, family care support, invalidity or partial invalidity pension, provision allowance or scholarship, the allowance shall be reduced by the amounts thus paid;
(c) an allowance for each child who is not provided for 100 Cds per month, without prejudice to entitlement to child allowance; If both spouses are studying, only one of them shall be granted an allowance for an uninsured child;
(d) a one-off social assistance of up to 1000 CZK per school year in cases of special consideration.
(3) Where pupils of cyclical studies in secondary schools participate in a course lasting only part of a calendar month and work in the remaining time, they shall be granted a proportion of the contribution referred to in paragraph 2 (b) and (c).
(4
Dissolution of a student's commitment to return a scholarship or part of it
(1) The obligation to replace a scholarship under an agreement concluded by a secondary school pupil pursuant to Paragraph 10 (2) shall cease if the organisation has refused to enter into an employment relationship with it or if the employment relationship has ended:
(a) a statement by the organisation concerned, if not a statement for a particularly gross breach of professional discipline or for reasons for which the employment relationship may be terminated immediately;
(b) a statement given by the worker if, under a medical opinion or a decision of a national health authority, he is unable to carry out work in the past or where he is entitled to an invalidity pension, or if the organisation is in breach of an essential obligation which it has against him under a contract of employment or collective agreement or legislation, or where he is unable to fulfil that obligation as a result of organisational changes or if his professional qualifications have not been used in the last 12 months for at least six months;
(c) immediate termination of employment by the worker. 11)
(2) If a student of a secondary vocational school enters another socialist organisation on the grounds that he follows his husband to his place of residence or that he is of urgent interest to the company, that organisation may assume the obligation to pay a full or partial grant if its superior body agrees to take over the obligation; By taking over the commitment, the new organisation ceases to be committed by the pupil.
(3) The obligation to pay the cost of scholarships under an agreement concluded by a secondary school pupil for workers is governed by specific rules. 12)
Payment of the scholarship and physical security
State economic organisations shall grant scholarships and physical security from other use of profits or additional additional resources, as appropriate, under specific rules. 13) The single agricultural cooperative provides a scholarship and physical security of profits according to special regulations. 14)
COMMON AND FINAL PROVISIONS
If a pupil becomes incapacitated for illness or accident, he / she shall be granted a scholarship for two months from the first day of the calendar month following the start of his / her incapacity for work.
(1) The following shall be deleted:
1. the Ministry of Education of the Slovak Socialist Republic of 22 January 1971, no. 838 / 1971-II / 3, for the provision of social scholarships to students of daily studies and in schools providing full secondary and higher education and secondary school pupils (Povsti MŠ and MK SSR, 1971, book 1 - 2);
2. the Decree of the Ministry of Education of the Slovak Socialist Republic of 1 December 1976 No 14 072 / 1976-II / 2 supplementing the Directives for the provision of social scholarships to students of daily study in schools providing full secondary and higher education and secondary school pupils (MŠ and MK SSR elevations, 1976),
3. Sections 10 and 11 of the Decree of the Ministry of Education of the Slovak Socialist Republic of 6 December 1976 No 14 571 / 1976-III on secondary schools for workers in the system of educational and educational establishments for youth preparation for the labour occupation (Pošti MŠ and MK SSR, 1977, Gazette 3) and as income no. 5 / 1977 Ú. v. SSR, registered at the amount of 11 / 1977 Sb.
(2) The decree of the Ministry of the Interior of the Slovak Socialist Republic no. 18 / 1976 Ú. v. SSR on the provision of study support to students of daily study in the field of ground construction with an internal focus of fire protection (registered in the amount of 25 / 1976 Coll.).
This Decree shall take effect on 1 September 1979.
