Order of the Minister of Justice
of 15 December 1952
providing for derogations in the evidence of the expert in certain matters of national insurance.
In an agreement with the Minister for Health and the Chairman of the State Pension Insurance Commission pursuant to § 398 (3) of Act No. 142 / 1950 Coll., on Civil Procedure (Civil Code):
(1) If a court needs an opinion on the state of health in the pension matters, it will request it exclusively from the Regional Pension Insurance Assessment Board ("the Assessment Committee").
(2) For serious reasons, the court may request a new opinion or review of the opinion already submitted to the same commission in another cast, another evaluation committee or other body (for example, the Faculty of Medicine); If the opinion submitted is to be supplemented, the court shall request the same opinion committee to be supplemented, which may submit its opinion in the same capacity.
(1) As a general rule, the Court of First Instance shall be confined to the written assessment of the Panel of Appeal; However, if it considers it necessary, taking into account, in particular, the seriousness of the questions which the members of the Chamber or the experts wish to ask, it shall, as an expert, hear the chairman of the panel or of another member of its medical service as a spokesperson for the majority of the commission.
(2) The provisions of paragraph 1 shall be applied mutatis mutandis if the opinion is submitted by another body.
The costs of the expert evidence carried out by the panel shall be borne by the State without any claim for compensation; This shall be without prejudice to the provisions relating to the costs of the participants in their relationship.
If the Regional Court has not yet established an assessment committee, the provisions of Sections 1 to 3 shall not apply; in these cases, the court follows the general provisions on the evidence of the expert (§ 108 et seq. of the Civil Code).
This Regulation shall enter into force on 1 January 1953.
