amending and supplementing the provisions on the formalities of military personnel in active duty and of certain other persons in equal terms.
The Government of the Czechoslovak Republic hereby orders according to the Act of 31 May 1932, No. 83 Coll., on the modification of the formalities of military personnel from the number of troops in active service and of some other persons to be treated as equivalent, as well as on the provision of longer-serving persons, as amended by the Act of 14 February 1946, No. 37 Coll.:
Čl. I.
The Government Decree of 15 June 1934, No. 111 Coll., on the formalities of military personnel in active duty and of certain other persons in equivalent terms, is amended as follows:
1. Paragraph 2 (1) reads as follows:
"(1) Military training centres (schools, colleges) for the education of professional officers (hereinafter referred to as" training centres ") shall mean military academy, military academy and military engineering academy. '
2. Paragraph 2 (3) reads as follows:
"(3) The provisions of paragraphs 1, 2 and 5 to 8 shall apply to all frequencies irrespective of rank, with the exception of professional military persons to whom the provisions of paragraphs 1, 2 and 9 apply only."
3. Paragraph 2 (5) reads as follows:
"(5) Entitlement to the daily mercenary of the frequencies arises on the day of entry into the teaching centre in the frequency ratio."
4. Paragraph 2 (6) reads as follows:
"(6) Entitlement to the daily pay paid by the frequencies shall cease to exist for graduate teachers who have been appointed as officers on the last day of the month preceding the day on which entitlement to the service salary arises, in all other cases on the day on which the person concerned ceases to be a reader. '
5. Paragraph 2 (7) reads as follows:
"(7) The daily mercenary also belongs to the frequencies during the main and other holidays, during the holidays and during the illness, even if they are treated in a military or civil hospital. The school regulations of the school, which are concerned, determine whether the daily mercenary of frequencies is reduced in freedom, with insufficient benefit or excessive behaviour during the period of disciplinary punishment. If such reduction occurs, the daily mercenary must not be less than 6 Ccs. For the duration of the reasoned judicial investigation or criminal proceedings, the mercenary of the frequencies shall be 6 Kns; If a court-martial has been revoked by a court-martial, it shall not be entitled to a daily service for the duration of judicial detention. '
6. In Paragraph 2, paragraph 8 is deleted, paragraph 9 becomes paragraph 8 and after this paragraph, paragraph 9 is added as follows:
"(9) The military administration shall, during the period of stay at the school, provide the Freakventants who are military persons of the profession with the same scope as the other frequencies. However, such persons shall be required to pay compensation in kind if they are not entitled to it or part of it from their service to military professional persons. The amount of this refund and the way in which it is paid shall be determined by the Ministry of National Defence. ';
7. in Paragraph 3 (1) (d), "6 Ccs" shall be replaced by "25 CCs" and "3 (1) (e)" 2 CCs "shall be replaced by" 10 CCs ";
8. Paragraph 3 (8) reads as follows:
"(8) The addition referred to in paragraph 7 (b) shall be without prejudice to the duration of the journey:
(a) on the journey by rail over 150 km to 400 km 40 Kčs, over 400 km 60 Kčs and over 600 km 80 Kčs,
(b) on a journey to a distance of more than 10 km to 20 km 20 Kčs, over 20 km to 40 km 40 Kčs and over 40 km 60 Kčs. '
9. in § 5, paragraph 3, "2 Ccs" is replaced by "5 Ccs";
10. in § 7, paragraph 1, "1 Cds" is replaced by "5 Cds";
11. in § 8, paragraph 1, the words "1 Ccs" are replaced by the words "5 Ccs," and in § 8, paragraph 3, the words "3 Ccs" are replaced by the words "10 Ccs."
12. Paragraph 9 (2) to (4) reads as follows:
"(2) Military persons of the number of sub-officers or of the staff employed in the military or military administration of operated enterprises, workshops, bakeries or similar facilities or in the professional performance of military installations, may receive an allowance of up to 5 Kcs per night, if their employment lasts at least two hours between 21 and 6 hours of the same night and if such work is repeated for at least two nights in succession. Under the same conditions, an allowance of up to 5 CZK may also be granted to military persons of the number of sub-officers or teams employed as heaters, engineers or craftsmen in the military or military administration of the undertakings operated or central offices operating steam boilers, electric motors or gas or petrol machinery.
(3) The Ministry of National Defence may grant an allowance of up to 5 CZK also to military persons of the number of sub-officers or personnel employed for at least two days in a row, taking into account the nature of their service, for a period exceeding the normal period of employment of a soldier.
(4) The Ministry of Defence may grant a daily allowance of 1.50 CZK for the treatment of the third and every other horse to military persons of the number of sub-officers or teams who treat more than two horses. '
13. the following sentence shall be added in Paragraph 9 (5):
"The Ministry of National Defence may entrust a higher headquarters or commander of military departments to grant allowances under paragraphs 2 to 4. ';
14. in Paragraph 15 (2), "1 Cds" is replaced by "6 Cds";
15. Paragraph 16 (2) reads as follows:
"(2) The measurement of the negative allowance shall be half the field allowance (§ 15 (2))."
16. in § 19, paragraph 1, point (d), the words "4 Ccs" are replaced by the words "10 CCs" and in § 19, paragraph 2, the words "4 CCs" and "2 CCs" respectively.
17. Paragraph 19 (7) reads as follows:
"(7) By order, the Government lays down the conditions under which the special service allowance and the amount thereof are to be paid to military air academics (frequencies of the military air academy). The frequencies of the Air Military Academy, which are military airmen, shall be subject to an air allowance only according to the previous sentence, even if they are military professionals. '
18. the following paragraph 8 is added to Paragraph 19:
"(8) The frequency of the military training centre, which is a military person of the profession, shall be entitled, instead of entitlement to the formalities referred to in paragraph 1, to formalities in accordance with the relevant provisions on the formalities of military persons of the profession. ';
Čl. II.
If there is talk of diet in Decree 111 / 1934 Coll., this is meant to be a food-for-food relutum, if there is talk of diet-for-food supplement, this is meant to be a food-for-food relay supplement.
Čl. III.
The measures taken by the Minister for National Defence in matters covered by this Regulation between 5 May 1945 and its publication are seen as if they had been taken for its effectiveness.
Čl. IV.
This Regulation shall take effect on the day of its publication, with the exception of the provisions of Articles I, 2, 3, 4, 6, 17 and 18, which shall take effect on 1 September 1949; they shall be carried out by the Minister for National Defence in agreement with the ministers involved.
