amending Decree No. 112 / 2015 Coll., on the professional and medical competence of crew members of ships, certificates of competence, seafarers' books and captain's promise
The Ministry of Transport provides, pursuant to § 85 (1) of Act No. 61 / 2000 Coll., on Maritime Navigation, as amended by Act No. 310 / 2008 Coll., Act No. 261 / 2011 Coll., Act No. 64 / 2014 Coll., Act No. 81 / 2015 Coll. and Act No. 90 / 2022 Coll., ("the Act ') for the implementation of Article 42 (6) of the Act:
Čl. I
Decree No. 112 / 2015 Coll., on the professional and medical competence of crew members of ships, certificates of competency, seafarers' books and captain's promise, is amended as follows:
1. At the end of footnote 1, the sentence "Directive (EU) 2019 / 1159 of the European Parliament and of the Council of 20 June 2019 amending Directive 2008 / 106 / EC on the minimum level of training of seafarers and repealing Directive 2005 / 45 / EC on the mutual recognition of seafarers' certificates issued by Member States is added to the separate line. '.
2. In Article 7 (s), the word "or 'is deleted.
3. In Section 7, at the end of point (t), the dot is replaced by a comma and the following points (u) to (x) are added:
"(u) essential activities on ships using gases or other low-flash fuels as fuel,
(v) expanded activities on ships using gases or other low-flash fuels as fuel;
(w) basic fishing activities in polar waters; or
(x) expanded fishing activities in polar waters. ';
4. In Paragraph 10, paragraphs 8 to 11 are added:
"(8) The essential activities on ships using gas or other low-flash fuels shall include activities related to the application of requirements for the operation of such ships, in particular taking into account health and safety risks in their operation and maintenance and repair of machinery, activities carried out in the supply of such fuels, including their storage and taking appropriate measures to prevent hazards, ensure safety and protection at work and to prevent environmental pollution, including fire prevention and reaction to fire.
(9) Extended activities on ships using gas or other low-flash fuels shall include, in addition to the activities referred to in paragraph 1, the operational operation of propulsion and machinery, in particular those related to ensuring the safe operation of engines burning the relevant fuel, safe operation and operation of fuel systems, the safe operation, monitoring and control of direct fuel operations and the taking of appropriate risk prevention measures, including the management of fire-fighting activities and the management of accident operations.
(10) Basic activities in polar water navigation include activities related to taking into account the risks associated with possible damage to the ship and the limited possibilities for external assistance and health and rescue in polar areas and effective assistance to passengers in the event of a ship's accident.
(11) Extended activities in polar waters shall include planning and carrying out voyages in polar waters with permanent or prevailing ice cover, in particular with regard to the safety of navigation, navigation and proper guidance of the navigational watch service, taking into account the technical equipment and characteristics of the ship and the management of the activities referred to in paragraph 10 in the event of a ship's accident. ';

Efficacy
This Decree shall take effect on 1 May 2022.
