on admission to secondary school studies
The Ministry of Education of the Czech Socialist Republic, in agreement with the Ministry of Health of the Czech Socialist Republic and after consulting the participating central authorities, provides for the Act No. 29 / 1984 Coll., on the System of Primary and Secondary Schools (School Act) and pursuant to § 24 (8) of the Act of the Czech National Council No. 77 / 1978 Coll., on State Administration in Education, as published under No. 48 / 1984 Coll.:

ACCEPTANCE OF REQUESTS TO THE DETAILED STUDY IN MIDDLE SCHOOL
§ 1
Basic provisions
(1) Pupils and other applicants (hereinafter referred to as "pupils") shall be admitted to the first years of secondary education according to their abilities, knowledge, interests and health status and in accordance with the needs of the socialist society, 1) who:
(a) have successfully completed primary school before the beginning of the following school year, if not for the pupils referred to in paragraph 2;
(b) they shall not reach the eighteenth year of age by the end of the calendar year in which they begin their studies; the study field "Singing" and the study field "Music" in the conservatory can also be accepted by pupils older.
(2) Pupils who have completed primary school education in the lower than eighth year or the eighth year have not completed successfully and are not continuing to complete compulsory school education in primary school.2)
Application to study
§ 2
(1) The application for secondary school studies is submitted by pupils on the prescribed form. The application of a minor student shall be addressed by his / her legal representative, foster parent or citizen or, where appropriate, by an institution to which the child has been assigned to education under a judicial decision (hereinafter referred to as the "legal representative ') .3).
(2) Primary school pupils submit an application to the principal of the primary school they attend; pupils who perform compulsory schooling outside the territory of the Czechoslovak Socialist Republic, principal of the primary school in the Czechoslovak Socialist Republic, in whose state they are maintained. Applicants who are in an employment relationship or similar employment relationship (hereinafter referred to as "employment relationship ') shall submit an application to the organisation to which they are in an employment relationship (hereinafter referred to as" organisations') and to those who are not in an employment relationship shall submit an application to the district national committee according to their place of residence. Applications are submitted
(a) after the start of recruitment by individual organisations at the dates set by the annual implementation plan of qualified staff in the fields of secondary vocational training, which are favoured by special regulations, 4)
(b) by 15 January in secondary school studies;
(c) by 15 February in the fields of secondary vocational training, except those referred to in (a).
(3) The application shall include a secondary school, including a study or a teaching field, and an organisation for which they wish to prepare. On the application, pupils may indicate another secondary school (study or teaching field, organisation for which they wish to prepare) which, in the event of non-admission to the school to which they originally applied, could apply for the transfer of the application pursuant to § 9 (3). Pupils applying to a secondary school where special competences are required (§ 6 (1) and (2)) shall indicate in second place a secondary school where those competences are not required.
(4) The application shall be accompanied by documentary evidence showing its ability, knowledge and interests (e.g. confirmation of participation and placement in the Olympics, sports and art competitions or technical competitions announced by the Pioneer Association of Youth Socialists, and, where appropriate, documentary evidence of the copyright of the discovery, invention, improvement design or industrial design adopted under specific regulations).
(5) A pupil who is a citizen with a changed working capacity shall also attach the decision of the Social Security Assessment Board of the relevant District National Committee, including an indication of whether the chosen field of study or teaching is suitable for applicants.
§ 3
(1) The principal of the primary school (for applicants in employment, organisation and non-employment, the district national committee) ensures that the pupil's personal characteristics are drawn up. The personal characteristics of the pupil shall include data on the ability, knowledge and interests of the candidate in relation to the chosen study or school course, data on his or her characteristics, an indication of whether the school or organisation or the national committee recommends the pupil to study. The school or organisation or national committee shall be informed of the personal characteristics of the student, if the minor is his legal representative, who may add his or her observations to the personal characteristics.
(2) The Director of the primary school, organisation or district national committee shall ensure proper completion of the application and its addition by expressing to the competent doctor the health status of the applicant and his medical fitness for the relevant study and pursuit of the chosen profession; The application shall be accompanied by the personal characteristics of the pupil and the other documents referred to in § 2 (4) and (5) and shall send the application as documented.
(a) within 15 days of its receipt to the relevant secondary vocational training centre, if it is about the teaching fields of secondary vocational education which are favoured under special regulations, 4)
(b) by 10 February, the competent secondary school (s) concerned, if the fields of study are in gymnastics and secondary vocational schools and the fields of study of secondary vocational schools,
(c) by the end of February, to the relevant secondary vocational training centre, if they are in the secondary vocational training fields, except those referred to in (a).
§ 4
(1) The Director of the secondary vocational training centre referred to in § 3 (2) shall immediately send applications for study in the secondary vocational training centre to the organisations for which pupils are to be trained for observations.
(2) The organisation for which the pupil is to be prepared shall attach his or her observations to the application; 5) in its opinion, the organisation shall in particular assess the suitability of the pupil's admission to and application to the chosen field of study or to the organisation after completion of the study.
(3) The organisation must send the application back to the Director of the secondary vocational training centre with its comments
(a) within eight days of receipt of the application referred to in Article 3 (2) (a);
(b) by 7 March, if the applications referred to in Article 3 (2) (b) are submitted,
(c) by 15 April, if the applications referred to in Article 3 (2) (c) are submitted.
Decision-making of admission
§ 5
(1) The Director of the secondary school shall proceed to decide on the admission of a student to a secondary school in accordance with the basic conditions for the admission referred to in Paragraph 1 (1), based on the relevant documents. 5)
(2) Pupils who, according to the decision of the Social Security Assessment Board of the District National Committee, are citizens with altered working capacity, (6) and pupils who are authors of the discovery, invention, improvement design or industrial design according to specific regulations, (7) shall be recruited preferably before pupils who are equivalent to the admission conditions.
§ 6
(1) The competence and knowledge of pupils applying to study in secondary education shall be verified by an admission examination. If the chosen field of study requires special competence, the entrance examination also includes verification of the required special competences (the talent test).
(2) The Talent Exam is held by pupils who apply for a degree in mathematics or physical education, for a course in sports school, in secondary art and industrial school, in secondary vocational school of Fine Arts and Fine Arts in secondary vocational schools, in secondary pedagogical school, in secondary medical school for "dental technician" and "rehabilitation worker," in conservatory and in secondary vocational education for visually impaired youth.
(3) A talent test in a grammar school focusing on mathematics is carried out by tenderers only if the number of pupils enrolled exceeds the specified number for admission.
(4) Pupils applying to study in the field of study do not take an entrance exam.
§ 7
(1) The Director of the secondary school forgives pupils who:
(a) in the last four years of primary school, in the midterm and at the end of the school year, the degree of benefit of compulsory subjects has been excellent; or
(b) have been placed in the district rounds of the Olympics declared by the Ministry of Education of the Czech Socialist Republic (hereinafter referred to as the "Ministry of Education") or the Ministry of Education of the Slovak Socialist Republic in the first three places and have had an average benefit of at least 1.50 in the half-year and at the end of the school year in the last four years of primary school; or
(c) as members of the youth centre or as athletes at primary school, they have gained from 1st to 3rd place in individual or collective sports in national and national championship or interstate sports competitions and have had an average benefit of at least 1.50 in the midterm and at the end of the school year in the last four years of primary school; or
(d) are authors of the discovery, invention, improvement or industrial design in accordance with specific regulations. 7)
(2) The examination shall be waived only if:
(a) the number of pupils meeting the conditions referred to in paragraph 1 shall not exceed the planned number of pupils who may be admitted to the relevant field of study or, where appropriate, the focus of study;
(b) the focus of the Olympics, competition, discovery, invention, improvement or industrial design corresponds to the chosen field of study;
(c) the reason for waiving the entrance examination shall be supported by evidence, as a rule, at the same time as the application, but not later than one day before the examination.
§ 8
(1) Pupils take an entrance exam at secondary school from 1 to 5 April.
(2) The acceptance tests shall be written and anonymous; their content and scope shall be determined by the Ministry of Education. A pupil who has not benefited from the entrance examination may take an oral examination. Corrective tests shall be carried out at the dates referred to in paragraph 1. The Director of the Secondary School shall grant the corrective examination only if the candidate has not benefited from one of the subjects of the written admission examinations or both, if the assessment of the entrance examinations is at least two grades worse than that of the candidate in the first half of the eighth year of the primary school.
(3) Talent examinations in the fields referred to in Article 6 (2) shall take place between 8 and 15 March; they are anonymous in the fields of study designated by the Ministry of Education and, as regards medical study, the Ministry of Health of the Czech Socialist Republic.
(4) For duly substantiated serious reasons (in particular medical or compulsory schooling outside the territory of the Czechoslovak Socialist Republic), students who are unable to attend the entrance or talent test within the prescribed time limit, will be permitted to pass the examination at a replacement date after consultation of the Regional National Committee conducting the school. The examination shall also be carried out by pupils who have applied for the transfer of the application to vacancies in the field of study following non-admission. The replacement date of the entrance exam, the secondary school where the examination will take place, and the content of the examination will be determined by the Regional National Committee, which shall conduct the school professionally.
§ 9
(1) The principal of the secondary school shall decide on the admission of a student to the secondary school course within eight days of the deadline set for the examination; for the admission of a pupil to the teaching profession from 3 to 7 May, and for teaching subjects which benefit under special regulations, 4) within eight days of receipt of the application from the organisation (§ 4 (3)). The decision shall be notified without delay to the student by the Director of the secondary school and, if he is a minor, to his legal representative, and shall inform the district national committee responsible for the primary school address of the student or the seat of the organisation with which he is engaged, or the district national committee which recommended the non-employment candidate. The Director of the secondary vocational training centre shall also inform the organisation for which the pupil is to be prepared of his decision.
(2) A pupil may, within eight days, appeal to the Regional National Committee, which shall lead the secondary school by means of the Director of the secondary school, against the decision; The Director of the High School may not decide to appeal himself. 8)
(3) A student who has not been admitted to the selected secondary school and has not lodged an appeal against a decision not to accept may, within the time limit laid down for the lodging of an appeal, apply for the application to be transferred to a post still vacant in the field of study or teaching. If the student requests the transfer of the application to a still vacant post in the field of study, the principal of the secondary school shall immediately send the application with all the file material to the Regional National Committee responsible for the secondary school, to which the student originally applied. If a student requests to transfer an application to a secondary school in another region, the Regional National Committee shall refer the application to the Regional National Committee, which shall be the head of the secondary school. If a student requests the transfer of an application to the teaching field, the principal of the secondary school shall immediately send an application with all the file material selected by the secondary vocational training centre to ensure the expression of the organisation for which the student wishes to be prepared.
(4) The transfer of the application referred to in paragraph 3 shall at the same time be communicated by the Director of the Secondary School to the Regional National Committee according to the primary school address of the student or to the headquarters of the organisation with which the candidate is engaged, or by the Regional National Committee to a candidate who is not in employment and recommended for study. In the field of teaching, the Director of the Secondary School shall also inform the Regional National Committee responsible for the secondary school's headquarters, which has not received the pupil.
(5) If the student does not appeal to the decision not to accept or apply for the transfer of the application, the principal of the secondary school shall send the application with all the file material to the Regional National Committee responsible for the student's permanent residence.
Specific provisions on the admission of pupils to secondary schools
§ 10
(1) The Regional National Committee ensures the conduct of the admission procedure to secondary schools and provides an overview of the vacancies in secondary schools. The Regional National Committee offers pupils who have not chosen a secondary school to study within the vacancies in secondary schools.
(2) The Regional National Committee designates secondary schools to ensure completion of compulsory schooling of pupils who have not been admitted to the secondary school to which they have applied or have not applied for a secondary school, nor have they chosen any secondary school offered to them in the framework of vacancies in secondary schools. 9)
§ 11
(1) The Director of the designated secondary school (Paragraph 10 (2)) shall initiate the admission procedure for pupils under Section 10 (2) on his own initiative. 10)
(2) Paragraph 1, § 3 (1), § 5, 6, 7, § 8 (2) and (4) and § 9 (1) and (2) apply when deciding to accept a pupil. Pupils who have already passed the entrance exam do not take a new entrance exam.

ČÁST DRUHÁ

ACCEPTANCE TO A STUDY IN EMPLOYMENT AND TO A COMBINATED STUDIES IN MIDDLE SCHOOL
§ 12
(1) In the first years of study at work and in the combined study, applicants who, according to their abilities, knowledge, interests and health and in accordance with the needs of the socialist society (1) are admitted to the first years of study at work and to the combined study.
(a) have successfully completed the eighth grade of primary school or obtained basic education;
(b) they shall reach the age of at least 18 years in the year of commencement of the studies;
(c) at the time of starting their studies in secondary school, they are engaged in a field corresponding to the chosen field of study or school;
(d) have successfully passed the final examination or final apprenticeship examination until the beginning of the study and have applied to the fields of secondary vocational training for graduates of the teaching disciplines; (11) the conditions laid down in (b) and (c) shall not apply to such tenderers.
(2) Women who take care of at least one child, citizens with altered working capacity and disabled pensioners may be admitted to secondary school studies without having an employment relationship.
§ 13
Applicants for studies shall submit applications for studies before 1 February to the organisation and tenderers who are not in employment with the district national committee responsible for the applicant's residence. Pupils in secondary vocational schools who apply to the corresponding fields in secondary vocational training for graduate students shall submit applications via the Director of secondary vocational training. The organisation (District National Committee) shall send the application by 15 April to the Director of the selected secondary school.
§ 14
(1) Candidates for study shall take the entrance examination from 10 to 31 May and, where appropriate, by replacement in the last week of August; the exact date and content of the examination shall be determined by the Regional National Committee, which shall lead the school in a professional manner.
(2) The principal of the secondary school shall decide on the admission of a pupil to the field of study within eight days of the deadline set for the examination; In the last full week of June, the principal of the secondary vocational training centre will decide on the admission of a pupil to the teaching field.
(3) A candidate may also be admitted to study who has not been recommended by the organisation (Regional National Committee) to study.

ACCEPTANCE TO HIGH YEAR SCHOOL
§ 15
(1) Candidates who are not students of another secondary school and who successfully pass the entrance exam, the subject of which is the knowledge of a lower secondary school, may be admitted to the upper secondary school.
(2) Admission to a maximum of the third year of secondary school is permitted.
(3) The dates and content of the entrance examination shall be determined by the Director of the secondary school to which the applicant applies.

ACCEPTANCE TO THE SUPPORT STUDY
§ 16
(1) Candidates shall be admitted to the study courses of the post-graduate course in which the new professional qualification provided for in the special regulations (12) is acquired by a study in a field other than that in which they have completed the final examination.
(2) Candidates shall be admitted to the graduate studies referred to in paragraph 1 according to their abilities, knowledge, interests and health status and in accordance with the needs of socialist society. 1)
(3) High-school pupils are admitted to the day-to-day course, who will receive full secondary education by the beginning of the following school year.
(4) Pupils who have received full secondary education and are in employment are admitted to their post-graduate studies. For women who care for at least one child, for citizens with altered working capacity and for disabled pensioners, no employment is required.
(5) In the post-graduate studies in which students complement and deepen their education, improve their professional skills or specialise in specific activities, admission procedures shall not be held.
§ 17
(1) High school pupils submit applications for a daily graduation to the principal of the secondary school in which they graduate; The Director of this School shall send the application by 20 May to the Director of the High School to which the student applies. Graduates of secondary schools who have not been accepted to study at university will ask the Dean of the relevant faculty to transfer the application to study. The Dean shall send the application and related documents to the Director of the High School by 15 August.
(2) Candidates for post-graduate studies at work submit applications to study before 1 February with the organisation and tenderers not in employment, to the district national committee responsible for the applicant's permanent residence; the organisation (district national committee) sends the application to the Director of the selected secondary school by 15 April.
§ 18
(1) Admission shall be carried out through an interview to identify the skills and knowledge of secondary school pupils and other applicants. If the chosen field of study requires special competence, verification of them is part of this interview.
(2) Admission interviews shall take place at the end of June; Admission interviews of high-school graduates who have not been admitted to university studies and who have requested the Dean of the relevant faculty to transfer the application shall take place at the end of August. The term and content of interviews shall be determined by the Director of the High School.
(3) The Director of the secondary school shall decide on admission to the secondary school according to the basic conditions for admission referred to in Section 16.

COMMON PROVISIONS
§ 19
(1) Admission to study at work and to combined studies in secondary schools is not subject to the provisions of § 1, § 2 (2), § 3 (2) (a) to (c), § 4, § 8 (1) to (3), § 9 (1), (3) to (5), § 10 and 11.
(2) The provisions of § 1 (2), § 7, § 8 (1) to (3), § 9 (3) to (5), § 10 to (14) shall not apply to admission to higher education.
(3) Admission to higher education in employment or to combined secondary education shall not be subject to the provisions of § 1 (1) (b) and § 2 (2) (a) to (c), § 4, § 7, § 8 (1) to (3), § 9 (1), (3) to (5), § 10, 11, § 14 (1).
(4) The provisions of Sections 1, 2 (2) and (3), 3, 4, 5 (1), 6 to 15 do not apply to admission.

FINAL PROVISIONS
§ 20
The Decree of the Ministry of Education of the Czech Socialist Republic No. 153 / 1978 Coll., on Admission to Secondary Schools is hereby repealed.
§ 21
This decree shall take effect on the day of its publication.
