Decree of the Ministry of Labour and Social Affairs of the Slovak Socialist Republic and of the Ministry of Education of the Slovak Socialist Republic on the remuneration and physical security of pupils and apprentices preparing for working occupations in teaching and learning fields

on the remuneration and physical security of pupils and apprentices preparing for the professional professions in teaching and study fields
The Ministry of Labour and Social Affairs of the Slovak Socialist Republic and the Ministry of Education of the Slovak Socialist Republic shall, in agreement with the participating central authorities and the Slovak Trade Council pursuant to § 230 (2) and (3) of the Labour Code and under § 40 (3) (a) of Act No. 63 / 1978 Coll., on measures in the system of primary and secondary schools:
§ 1
Scope
This decree applies to pupils and apprentices1)
(a) secondary vocational schools, vocational schools and apprenticeships, 2)
(b) secondary vocational training and vocational training for young people requiring special care and vocational training (hereinafter referred to as "youth facilities requiring special care") .3)
§ 2
Apprenticeship period in teaching and study fields
The teaching period is divided into periods of preparation and period of professional development and their duration is determined according to the complexity of the teaching and study field (hereinafter referred to as the "teaching field ') .4)
§ 3
Category of teaching fields
(1) For the purposes of remuneration and physical security of pupils and apprentices, teaching subjects are classified in Category A or Category B.
(2) Category A is to be classified in the preferential subjects listed in Annex 1,
(a) the most nationwide economic;
(b) in selected organisations5) to take account of the planned extraordinary interregional transfers of apprentices;
(c) declared priority.
(3) Category B includes other teaching subjects.
Remuneration of pupils and apprentices
§ 4
Remuneration of pupils and apprentices in the preparatory period
(1) During the preparatory period, pupils and apprentices shall be granted monthly remuneration within the limits laid down for the school year concerned and the category in which they are classified.
(2) Monthly fees are granted to pupils and apprentices in the following ranges:

(3) The organisation in which the preparation of pupils and apprentices is carried out (hereinafter referred to as the "organisation") shall determine the amount of the monthly remuneration to individual pupils and apprentices within the limits set out in paragraph 2, according to an overall assessment of the benefits, behaviour and participation in non-teaching activities for the relevant settlement period.
(4) Apprenticeships who have received full secondary education through a high school shall be awarded the monthly remuneration referred to in paragraph 2 throughout the preparatory period within the range set out in the relevant category for the second year of the preparatory period.
(5) A monthly allowance shall also be granted to pupils and apprentices for a period of important obstacles to work (Sections 124 to 128 of the Labour Code), with the exception of maternity leave and other maternity leave and, where appropriate, in the period of professional development, provided that the onset of incapacity falls within the preparatory period, but no longer than the period for which sickness benefits would otherwise be granted under the sickness insurance rules. 7)
(6) Where the apprentices carry out productive work during the preparatory period for the third or fourth year in accordance with the curriculum and curriculum, they shall be remunerated for the work carried out, as provided for in paragraphs 5 and 6. Where the remuneration thus determined is higher than the monthly remuneration referred to in paragraph 2, they shall not be granted a monthly remuneration.
(7) There is no monthly remuneration for pupils during the main school holidays.
Reward for apprentices in the period of professional development
§ 5
(1) In the period of professional development, the apprentices are awarded productive work according to their curriculum and curriculum and are rewarded for that work according to other provisions of this decree.
(2) If an apprentice performs productive work in time wages during the period of professional development, it shall be remunerated on the basis of an overall assessment of its benefits and behaviour: in the first half of that period, between 50% and 75%, in the second half of that period, between 60% and 100% of the time wage received by a qualified worker for the same performance and work results. The period of pay shall be calculated from a class fare equal to or equal to one degree lower than the personal grade to be awarded to the apprentice under the wage rules after the final apprenticeship examination under the wage regulations.
(3) If, during the period of professional development, an apprentice performs productive work for which workers over 16 years of pay are a task wage, he shall be remunerated according to an overall assessment of his benefit and behaviour of between 70% and 100% of the salary that a skilled worker would receive for the same performance and performance results.
(4) The apprentice shall be granted, in addition to the remuneration established under the preceding paragraphs, any premium or remuneration which a qualified worker would receive for the same performance or performance.
(5) Where an apprentice is working in a collective task-based wage, he shall be remunerated in accordance with paragraph 3, but at least the remuneration corresponding to the time-based wage in the second half of the period of professional development referred to in paragraph 2.
(6) In the period of professional development, apprentices shall be granted economic results under the conditions laid down in collective agreements.
(7) A monthly fee of the same amount as that payable to the apprentices of the same category in the last year of the preparatory period shall also be paid to the apprentices during the period of professional development who did not perform productive work during the relevant monthly period on account of the organisation of the teaching set out in the curriculum and curriculum. Where, for reasons of production or for reasons of organisation of teaching provided for in the curriculum and curriculum, they have worked only to a limited extent during the relevant monthly period, they shall be remunerated at least at the rate corresponding to the time wage referred to in paragraph 2.
(8) During a single settlement period, the rotation of salary forms is permissible only if the work carried out in each form of pay can be accurately recorded.
(9) The organisation may use another method of remuneration only on the basis of principles issued by the competent central authority with the agreement of the Ministry of Labour and Social Affairs of the Slovak Socialist Republic.
§ 6
(1) Apprenticeships who, for teaching purposes in accordance with the curriculum, exceptionally work in a difficult or healthy environment, where this is permitted under the relevant list of work and workplaces prohibited by the teens, provide the organisation with a fee set in accordance with § 5 (2) to (5), which is payable under the same conditions as the worker under the wage rules.
(2) For apprentices who exceptionally work on a Saturday or Sunday for the purposes of teaching, the organisation will provide a bonus for the work these days, which according to the wage rules belongs to other workers.
Physical safety of pupils and apprentices
Meals
§ 7
(1) For pupils and apprentices in category A, pupils and apprentices who are socially needy, pupils and apprentices in youth establishments requiring special care, the organisation shall provide all-day meals free of charge during the preparatory period, provided that they are also provided with accommodation; If the organisation does not provide these pupils and apprentices with accommodation, it provides them free of charge with one main meal (lunch or dinner) and one side meal per day.
(2) The organisation shall provide the other pupils and apprentices, if they so request, with meals for remuneration.
(3) The organisation provides full-time meals for pupils and apprentices, with the value of the financial food standard 15,70 CZK, of which:

(4) The costs of purchasing food up to the level of the financial food standard are borne by the organisation from operational funds.
(5) The organisation may provide pupils and apprentices with a diet of higher nutritional value than that laid down in the financial standard for food, provided that the higher costs are paid by the compulsory maintenance of pupils and apprentices.
(6) Organisations managed by the Federal Ministry of Fuel and Energy and organisations of the production unit of the ore mines and magnesite plants ensure the catering of pupils and apprentices of mining disciplines and selected teaching disciplines listed in Annex 1 (a) to the following financial food standards:

(7) The higher costs than the value of the financial standard laid down in paragraph 3 shall be borne by the organisation on the profits after the fulfilment of the compulsory contributions, taxes and allocations. 8)
(8) Pupils and apprentices are considered to be socially necessary if the net monthly income of persons obliged to feed them per member of the household does not exceed 650 Cds. The principles for identifying social needs are set out in Annex 2. Pupils, apprentices and dependants are required to notify the organisation without delay of any circumstances which might affect the assessment of social needs.
(9) In the period of professional development, all apprentices shall pay the amount corresponding to the financial standard laid down in paragraph 3 for the monthly periods when they are remunerated for productive work for each day on which they were consumed. The apprentices must always remain at least an amount equivalent to the monthly remuneration in the last year of the preparatory period from the remuneration for productive work in the relevant accounting period.
(10) If the organisation provides pupils and apprentices with food for which the cost of buying food is lower than that provided for in the financial standard, it shall provide them with more substantial additional meals to compensate for the whole-day and / or semi-daily meals up to the level of the financial standard.
§ 8
(1) Pupils and apprentices who do not benefit from the provisions of Article 7 (1) shall pay the remuneration of the financial standard referred to in Article 7 (3) during the preparatory period; in the period of professional development, if the cost of meals is not fully paid by the apprentice in accordance with the provisions of Article 7 (9), they shall pay the remainder up to the level of the financial standard.
(2) The organisation shall agree with the apprentices and the persons responsible for their maintenance how the costs are to be paid, in particular whether the apprentice agrees to pay these costs in the form of a deduction from his pay for productive work or, where appropriate, from sickness.
§ 9
Accommodation
(1 For the accommodation of other pupils and apprentices, the following monthly amounts shall be paid during the preparatory and professional development period of the person obliged to feed them:
(a) 40 CZK if the accommodation is equipped with a central heating, hot water and bedrooms with a capacity of up to 4 persons,
(b) 30 CZK, if the accommodation complies with at least one of the requirements under (a);
(c) 20 CZK if the accommodation does not comply with any of the requirements under (a).
(2) During the period of professional development, the apprentice pays the benefit referred to in Paragraph 7 (1) for the accommodation of the amount referred to in paragraph 1, while maintaining the amount of the remuneration referred to in Paragraph 7 (9).
(3) The monthly amount of accommodation is unchanged even if the pupil or apprentice is not accommodated for all days of the month. If the student or apprentice is accommodated only for part of a month for reasons of organisation of preparation for the profession, the amount of the payment for accommodation shall be determined in proportion to the number of days during which the pupil or apprentice is accommodated.
§ 10
Organisations shall provide pupils and apprentices with working clothes, footwear and, to the extent specified by specific regulations, personal protective equipment and personal equipment.
§ 11
Reimbursement of fare
(1) The organisation will pay pupils and apprentices for public transport tickets
(a) on a one-off basis on taking up training for the profession from the place of residence to the place of departure;
(b) commuting from the place of residence to theoretical teaching, provided that it is carried out in a municipality other than practical training or training; by analogy to pupils and apprentices who, during the teaching period, have had a change in the place of theoretical teaching or vocational training due to the introduction of an improved school system (9);
(c) to the students and apprentices entitled under § 7 (1) twice a month to their place of residence throughout the period of accommodation;
(d) in-service pupils and apprenticeships in the category B four times a year to their place of residence throughout the accommodation.
(2) The organisation shall pay pupils and apprentices with a reduced fare by bus or, where applicable, for the 2nd carriage class of the passenger train and at a distance of more than 100 km, including the express fee. Students and apprentices are required to obtain tickets for the fare discount and choose the shortest direction of travel. Expenditure on local means of transport shall not be borne by the organisation.

Transitional and final provisions
§ 12
(1) Teachers with whom the organisation has agreed, in the teaching contracts concluded prior to the date of application of this decree, favourable meals or accommodation which would not belong to them under that decree, are maintained until the end of their teaching relationship. The same procedure shall apply where the organisation has agreed in writing with the legal representatives of the pupils who benefit from meals or accommodation before this decree is effective.
(2) The provisions of Decree No. 124 / 1967 Coll., on the partial reimbursement of the costs of care provided in certain youth establishments, do not apply to pupils of the apprenticeship referred to in § 1 of this Decree or to persons obliged to provide them with nutrition.
§ 13
They shall be deleted:
a) Decree of the Ministry of Labour and Social Affairs of the Slovak Socialist Republic No. 67 / 1969 Coll., on financial and material security of apprentices,
(b) Decree of the Ministry of Labour and Social Affairs of the Slovak Socialist Republic No. 156 / 1970 Coll., on the financial and material security of apprentices in boarding school for young people requiring special care and in apprenticeships attended by apprentices from social care institutions for disabled youth;
(c) Decree of the Ministry of Labour and Social Affairs of the Slovak Socialist Republic of 26 June 1978 No VII- 4589 / 1978 on the financial and material security of apprentices of mining and selected teaching fields of the organizations of the Federal Ministry of Fuel and Energy, registered in the amount of 16 / 1978 Coll.,
(d) Decree of the Ministry of Education of the Slovak Socialist Republic of 18.8.1978 No 1610 / 1978-22 on the financial and material security of pupils raised in apprenticeship establishments, registered in the amount of 29 / 1978 Coll.
§ 14
This Decree shall take effect on 1 September 1979.

Annex No 2 to Decree No 95 / 1979 Coll.
Principles for determining the social needs of pupils and apprentices
(1) A pupil or apprentice (hereinafter referred to as "apprentice ') shall be considered as socially needed if the average net monthly income per member of the household in which the apprentice lives does not exceed 650, - Ccs.
(2) The average net monthly income for the determination of social needs shall be the monthly average of the money or money valued income reduced by the payroll tax or, where applicable, by any other tax that is subject to that income that has reached in the previous calendar year.
(a) both parents and apprentices,
(b) one of the parents, his husband and apprentice,
(c) the apprentice and his husband.
(3) The following shall be included in the income underlying the average net monthly income:
(a) income from, or in connection with, the employment relationship and other income subject to payroll tax;
(b) income from the work of a member of the JZD;
(c) income from activities carried out in proportion to the employment relationship and income from activities carried out under non-employment agreements;
(d) income subject to public income tax;
(e) income subject to tax on the income of citizens from agricultural production;
(f) income subject to tax on literary and artistic activities;
(g) sickness, maternity and maternity compensation, maternity allowance, support for family care,
(h) pension benefits with the exception of those referred to in paragraph 4;
(i) provision allowance;
(j) maintenance (maintenance allowance) from other persons, determined by a court decision or provided by an agreement approved by the court;
(k) deductions to cover maintenance for the benefit of children carried out on the remuneration of persons in jail or in custody.
(4) The following shall not be included in income underlying the survey of the average net monthly income:
(a) child allowance and supplement;
(b) education and training supplement;
(c) raising pensions and education for helplessness;
(d) orphan's pension;
(e) the remuneration of a foster parent,
(f) cash allowances and social assistance in kind;
(g) a contribution to meet the needs of the child in foster care;
(h) aid at the time of birth of the child;
(i) maternity allowance;
(j) remuneration to voluntary care workers;
(k) benefits in kind and in cash provided for life and working years;
(l) funeral expenses,
(m) cash benefits from contract insurance;
(n) apprenticeship fees for work under work agreements outside the employment relationship, remuneration resulting from the employment relationship under the framework contract or from civil assistance;
(o) apprentices' income from the employment (member) ratio and invalidity or partial disability pension up to an amount of 800 Kns per month.
(5) The average net monthly income shall be deducted from the amount determined by the court or an apprentice, or his spouse, to fulfil the maintenance obligation.
(6) The net monthly income per household member shall be determined by dividing the income of the parents and apprentices or the spouse by the number of members of the household.
(7) The following shall be considered as members of the household:
(a) parents and their own or adopted unprovided children13) (hereinafter referred to as "dependent children"), where the average net monthly income is collected by apprenticeship for parents;
(b) the apprentice, his or her spouse and their dependent children where the average net monthly income is collected by the apprentice from the spouse;
(c) the apprentice shall be counted as two members of the household where:
1. care of the family is free, divorced, widowed or for other serious reasons a single parent,
2. both parents are pensioners and, in addition to the pension, have no income from work,
3. Married apprentice.
1) The term "pupils and apprentices" is used everywhere where, on the one hand, the pupils mentioned in § 20 of Act No. 63 / 1978 Coll., on measures in the system of primary and secondary schools, and, on the other hand, on the apprentice who concluded a teaching contract under § 220 et seq. The term "apprentice 'shall be used as regards only the teaching ratio.
2) Article 24 (3) of Act No. 89 / 1958 Coll., on the Education of Adoption to the Occupation of Vocational Aspects (Apprentice Act).
3) Decree of the Ministry of Education of the Slovak Socialist Republic No. 127 / 1978 Coll., on schools for youth requiring special care.
4) The duration of the teaching period and the duration of the preparatory period are defined by Decree No. 11 / 1971 of the Slovak Socialist Republic and Decree No. 11 / 1971 Coll., on teaching fields and on the organisation of apprenticeship, as amended by Decree No. 88 / 1971 Coll., Decree No. 82 / 1972 Coll. and Decree No. 90 / 1978 Coll., and, where appropriate, by school plans with regard to the fields of study, the Decree of the Ministry of Education of the Slovak Socialist Republic and the Ministry of Health of the Slovak Socialist Republic, Decree No. 103 / 1979 Coll. The period referred to in § 15 (3) and § 20 (4) of Act No. 63 / 1978 Coll., on measures in the system of primary and secondary schools is also included in the total length of the teaching period.
5) The list of selected organisations designated on the basis of relevant resolutions of the Governments of the Republic is published in the Ministry of Labour and Social Affairs of the Slovak Socialist Republic and in the Ministry of Education Bulletin of the Slovak Socialist Republic and can be consulted on the labour and education departments of the District National Committees.
6) Paragraph 6 (2) of Act No. 63 / 1978 Coll., on Measures in the System of Primary and Secondary Schools.
7) During the period of incapacity for work for which the pupil and apprentice are entitled under this provision, no sickness allowance shall be granted. Financial assistance in motherhood shall be provided in accordance with specific rules.
8) Paragraph 5 (1) of Decree No. 151 / 1975 Coll., on the financial management of state economic and certain other socialist organisations.
9) Act No. 63 / 1978 Coll., on Measures in the System of Primary and Secondary Schools.
10) The newly designed teaching fields are defined by the Decree of the MŠ SSR No. 90 / 1978 Coll., amending and supplementing Decree No. 11 / 1971 Coll., on teaching fields and on the organisation of apprenticeship education. Only those subjects which are introduced by 1 September 1980 are listed. Favourable teaching fields introduced since 1.9.1981 shall be decided in accordance with the plans of qualified staff for the period of the 7th Five-Year Plan.
11) The fields of study provided for by the Decree of the Ministry of Education No. 11 / 1971 Coll., on teaching fields and on the organisation of apprenticeship, as amended by Decree No. 88 / 1971 Coll., Decree No. 82 / 1972 Coll. and Decree No. 90 / 1978 Coll.
13) Article 18 of Act No. 88 / 1968 Coll., on the extension of maternity leave, on maternity benefits and on the allowance for children from sickness insurance, as amended by Act No. 99 / 1972 Coll., on the increase of child allowance and education allowance.
