on schools for youth requiring special care
The Ministry of Education of the Czech Socialist Republic, after consulting the Ministry of Health of the Czech Socialist Republic and the Ministry of Labour and Social Affairs of the Czech Socialist Republic, provides pursuant to § 23 paragraph 4 and § 25 paragraph 2 of Act No. 63 / 1978 Coll., on Measures in the System of Primary and Secondary Schools, and pursuant to § 14 paragraph 2 (a) and § 22 paragraph 2 of the Act of the Czech National Council No. 77 / 1978 Coll., on State Administration in Education:
§ 1
Basic provisions
This decree regulates the types, types and names of schools for youth requiring special care (1) (hereinafter referred to as "schools'), the conditions for their establishment and cancellation, the details of the organisation of certain schools and the conditions for the classification of pupils in those schools.
§ 2
Types and types of schools
(1) A special school, a support school and a special vocational training centre are set up for pupils with mental disabilities.
(2) For pupils with hearing disabilities, a primary school for hearing, a primary school for pupils with hearing remnants, a primary school for deaf, a vocational school for hearing affected young people, a secondary vocational school for hearing affected young people, a gymnasium for hearing affected young people and a secondary industrial clothing school for hearing affected young people.
(3) For pupils with speech defects, a primary school is established for faulty speaking and a primary school for non-speaking.
(4) A primary school for the visually impaired, a primary school for pupils with vision remnants, a primary school for the blind, a vocational school for the visually impaired youth, a secondary vocational school for the visually impaired youth, a gymnasium for the visually impaired youth, a conservatory for the visually impaired youth, a vocational malpractice school for the visually impaired youth, an economic school for the visually impaired youth and a secondary economic school for the visually impaired youth.
(5) For pupils with disabilities, a primary school is set up for disabled, a vocational school for disabled young people, a secondary vocational school for disabled young people, a gymnasium for disabled young people and a secondary economic school for disabled young people.
(6) A primary school at a hospital, a primary school at a children's hospital, a primary school at a children's spa hospital and a primary school at a children's health care facility (hereinafter referred to as "primary school at a health facility ') are set up for pupils who are sick or disabled.
(7) Where pupils who are ill or disabled are also mentally ill, a special school at a hospital, a special school at a children's hospital, a special school at a children's spa hospital and a special school at a children's recovery centre (hereinafter referred to as the "special school at a medical institution ') shall be set up for them.
(8) A primary school is set up for pupils who are difficult to educate in a children's education institution and in a child's diagnostic institution, in a youth education institution.
(9) For pupils who are also mentally disabled, a special school is set up in a children's education institution and in a children's diagnostic institution, in a youth education institution, in a special vocational training centre.
(10) For pupils with sensory disabilities, disabled or with speech defects, who are also mentally affected, schools are set up for pupils with multiple defects, which are: special school for the deaf, special school for pupils with hearing remnants, special school for the deaf, special vocational school for the hearing affected youth, special school for the disabled, special school for the non-speaking, special school for the weak-sighted, special school for pupils with vision remnants, special school for the blind, special vocational school for the visually impaired youth, special school for the disabled and special vocational school for the disabled.
§ 3
School names
(1) The name of the school consists of a designation of the degree, type or type of school (§ 2), indicating the school's seat, e.g. "Primary School for the weak-sighted in....., district........"
(2) The name of the school for Polish national pupils shall be made up of the name established for a particular degree, type or type of school and shall be accompanied by a designation on the language of instruction, such as "Special School with Polish language in.........., district.......... '. The foreign language translation of the name shall be given in the second place.
§ 4
Establishment and cancellation of schools
(1) Schools are set up for at least 10 pupils.
(2) Schools shall be abolished if the number of pupils falls below the number laid down in paragraph 1. With the approval of the National Committee, which is the head of the school, the school can be left in operation even with a lower number of pupils, taking into account the school network established by the Ministry of Education of the Czech Socialist Republic.2)
§ 5
Organisation of certain schools
(1) Regional National Committee (3) may set up, at the latest until the beginning of the school year 1983 / 84, secondary vocational training courses, vocational training courses and special vocational training courses for young people requiring special care which provide only theoretical training and extracurricular and extracurricular education; practical training or training shall be provided by the organisation for which the youth are prepared.4)
(2) At the conservatory for visually impaired young people, a preparatory class may be set up for pupils who have demonstrated musical aptitude and abilities during the entrance exam but have not achieved the necessary degree of technical maturity in the game. The class shall be set up at least 3 pupils.
(3) Schools of different grades, types and types may be managed by one director.
§ 6
School Sanitary and School Club
(1) A school club and a school club (hereinafter referred to as "satellite and club") may be set up if at least 10 pupils are regularly present.
(2) The cooperative and the club shall be cancelled if the number of students under 10 regularly falls.
§ 7
Internal care
(1) The boarding school provides educational care, rehabilitation, accommodation and meals for pupils outside the teaching period. Parents or other persons who have a maintenance obligation on the child (hereinafter referred to as "legal representatives') in accordance with a special regulation shall contribute to the partial reimbursement of the costs associated with the residence of children. 5)
(2) The boarding school also provides education outside teaching and training for pupils who are in full-time care of the school.
(3) The details of the organisation of educational work in boarding school and the resulting rights and obligations of pupils and their legal representatives shall be determined by the internal rules of the boarding school approved by the National Committee which shall lead the school in a professional capacity.
(4) The education, accommodation and physical care of pupils with an ordered constitutional education will be provided by the boarding school during school holidays. The school provides these pupils with educational care until their vocational training is completed. If these pupils do not have parents and their own income, they are provided with a boarding school and allowance according to a special regulation. 6)
Classification of pupils requiring special care in primary schools for youth requiring special care, special schools and support schools
§ 8
(1) The inclusion of pupils in primary schools for youth requiring special care, special schools and auxiliary schools (except primary school pupils in medical institutions and primary school pupils for pupils difficult to educate) is decided by the district national committee responsible for the place of residence of the pupil. 7)
(2) Incentives for inclusion may be submitted to the district national committee by the school to which the pupil is taking part, pedagogic-psychological advice, medical institutions, legal representatives of the pupil, childcare bodies and other social institutions.
(3) The District National Committee will provide a comprehensive examination of the pupil proposed for inclusion in the school.
(4) A student enrolled in a school is obliged to attend that school. An exception may be made if the pupil cannot be placed in a school after the decision of the National Committee for lack of space. In this case, the pupil shall temporarily enter the primary school responsible for his place of residence.
§ 9
(1) Pupils with such mental shortcomings are included in a special school for which they cannot be successfully educated at other schools. Pupils with such mental shortcomings are included in the secondary school, for which they cannot be educated even at a special school, but are still educational.
(2) Teachers with hearing defects are included in the primary school for pupils with hearing disabilities, for which they cannot be educated in primary school even if they are using common electroacoustic aids.
(3) Pupils with visual defects for which they are not able to be educated at primary school are included in the primary school.
(4) The primary school for pupils with speech defects includes pupils with speech disorders in which the removal of a medical preventive care disorder, including rehabilitation care, cannot be achieved.
(5) Pupils with physical disabilities for whom they cannot successfully be educated at primary school are included in primary school.
(6) Special schools for pupils with hearing disabilities, for pupils with speech defects, for pupils with visual disabilities or for pupils with physical disabilities shall be classified as having a disability and a mental deficiency for which they cannot be successfully educated at other schools.

§ 10
Replacement of pupils
(1) The school director shall, if necessary, initiate the transfer of the pupil to another school within 5 months of the date of adoption of the national district committee which has decided on the inclusion. the same progress has been made if, during school attendance, the pupil has had a significant change in his disability.
(2) The complaint referred to in paragraph 1 shall be lodged by the school director after the expert doctor has expressed his opinion and after consultation with the school's pedagogical board.
(3) The national district committee shall decide on the initiative of transferring a pupil to another school, which shall decide on its inclusion in the school.
(4) A student who has been enrolled in a primary school for young people requiring special care after prior attendance at primary school may, after consultation with the school's pedagogical board, be enrolled in a primary school for young people requiring special care in a higher grade than that in which he has completed compulsory schooling, if his age, year of schooling and knowledge of the school corresponding to the year in which he is to be enrolled.
(5) If there has been a significant change in the disability of the pupil during school attendance at the primary school for young people requiring special care, the student shall be assigned to the primary school responsible for his / her place of residence or to another type or type of school.
(6) Pupils with extended compulsory education (8) continue at primary school responsible according to their place of residence or at a school where pupils have not been extended to compulsory education, in a lower year than they would have had completed compulsory schooling at the school from which they were reassigned. If pupils with extended compulsory education are transferred 8) to a school where the compulsory education has also been extended, they continue the same year.
§ 11
Compulsory education
Pupils enrolled in schools shall be counted against the compulsory education period they have completed in other primary schools.
§ 12
Secondary schools
(1) Candidates shall be admitted to secondary schools requiring special care according to the regulations for other secondary schools.
(2) The period of study required to obtain secondary education or complete secondary education is extended to 3 years at the school of economic education for the visually impaired youth, 5 years at the secondary school of economics for the visually impaired youth, 4 years at the vocational seed school for the visually impaired youth, 5 years at the conservatory for the visually impaired youth. For pupils in the preparatory class of the conservatory for visually impaired youth, the study is extended to 6 years.
(3) Preparation in the teaching and study fields established by the Ministries of Education of the Czech Socialist Republic No. 24 / 1980 Coll. and No. 70 / 1978 Coll., amending and supplementing Decree No. 87 / 1970 Coll., on the teaching fields and on the organisation of apprentices, as amended by Regulations No. 68 / 1971 Coll. and No. 54 / 1972 Coll. and by the Ministry of Education of the Czech Socialist Republic and the Ministry of Health of the Czech Socialist Republic, to extend for six months the nomenclature of the fields of study at secondary vocational schools, gymnastics, secondary vocational schools, conservatory schools, vocational schools for workers, vocational schools for young people requiring special care and a set of studies at secondary vocational schools, and to study in the two-year and three-year-year-year-year-olds in the vocational schools for the mentally affected youth. for four-year studies in secondary vocational schools for the sensory affected youth, this preparation is extended by one year. The extension of the preparation shall be included in the preparatory period.
(4) Pupils may be admitted to youth secondary schools requiring special care after the successful completion of the senior year of the primary school for youth requiring special care or of the final year of the primary school or of the basic nine-year-old school for which there has been a significant deterioration of the defect in the final year of the primary school or of the basic nine-year-old school. The applicant for admission to a vocational training centre or secondary vocational training centre for young people requiring special care must demonstrate by expressing to the competent doctor the medical fitness to carry out the chosen occupational profession; the classification of a candidate who is a citizen with a changed working capacity shall be in accordance with the recommendation of the Social Security Assessment Board of the relevant District National Committee.
(5) Special training courses, vocational training courses and secondary vocational training courses for young people requiring special care are organised for their apprenticeships for 20 working days.
(6) It is possible to set up a department for pupils who are mentally disabled (a department for pupils with multiple defects) in vocational schools for sensory or physically disabled youth.
§ 13
Training arrangements
The primary schools for youth requiring special care, special schools and auxiliary schools in accordance with the rules applicable to primary schools (9), with the following derogations:
(a) a group of optional subjects may be set up if at least five pupils join;
(b) the separation of special physical education shall be established with at least five pupils; the maximum number of pupils in the department is 8. If the number of pupils below 5 falls, the department is cancelled,
(c) tutoring groups, balancing classes and special classes shall not be established.
§ 14
Health and safety care for pupils
In the care of the health and safety of primary school pupils requiring special care, special schools and auxiliary schools, schools shall follow the rules applicable to primary schools (9) with the following derogations:
(a) there is a maximum of five bathing pupils per group;
b) ski training is performed by 1 instructor with a maximum of 10 pupils.
§ 15
Final provisions
Save as otherwise provided in this Decree, primary schools for young people requiring special care, special schools and auxiliary schools shall be subject to the rules applicable to other primary schools; secondary schools for young people requiring special care shall be subject to the rules applicable to other secondary schools of the relevant species.
§ 16
This Decree shall take effect on 1 September 1978.
