Government Regulation
of 22 March 1949
on certain formalities for military professional persons, military persons of the number of petty officers and of the staff and civilian personnel of the military administration.
The Government of the Czechoslovak Republic hereby orders, pursuant to the Law of 24 June 1926, No. 103 Coll., on the modification of the salary and certain service conditions of civil servants (the Law of the Clause 3 and 6 of the Law of 31 May 1932, No. 83 Coll., on the modification of the formalities of military personnel from the number of men in active service and of certain other persons to be treated as equivalent to them, and on the provision of services of servants, as amended by the Act of 14 February 1946, No. 37 Coll.:
Dangerous encore.
(1) Outside the time of the security alert,
(A) professional military persons,
(B) Military persons of the number of petty officers and teams,
C) civil servants of the military administration whose pay ratios are governed by a salary law or by regulations issued pursuant to it, in respect of which every day
| a) | pyrotechnických a odminovacích prací, | |

| bb) pomocným pyrotechnikům v částce | 40 Kčs, | |
| cc) osobám, které vykonávají pomocné práce v částce | 10 Kčs, | |
| b) | studijních nebo výzkumných prací s mimořádně nebezpečnými bojovými prostředky, po případě prací při jejich tovární výrobě v částce | 40 Kčs, |
| c) | zvláštních prací s látkami nebo zařízeními škodlivými lidskému zdraví, nebo nebezpečných prací s municí nebo výbušninami v továrnách, muničních skladech nebo na pokusných střelnicích v částce | 20 Kčs, |
| d) | prací s infekčním materiálem, s veterinářskými plynovými lázněmi nebo v prostředí aktivního záření v částce | 10 Kčs. |
(2) The details, in particular what works are regarded as those referred to in the preceding paragraph, are laid down by the Ministry of National Defence.
(3) Where a military person or staff member is entitled, in one calendar day, to one or more other similar allowances in accordance with other provisions, in addition to entitlement to the allowances referred to in paragraph 1, the highest of them shall be entitled.
(4) The security allowance is paid monthly in arrears. It shall not affect the right to reimbursement of service expenses. In accordance with the provisions of Section 3, paragraph 2 of the Law of 26 June 1947, No 109 Coll., on payroll tax, is exempt from payroll tax.
Special requirements of the castle guards.
(1) Military professional persons and persons of the number of sub-officers and of the teams permanently assigned to the castle guard shall be responsible for the following allowances for each calendar month for the period during which the number of castle guards living and operating on a continuous basis:

| závodčímu v částce | 150 Kčs, |
| ostatním osobám přiděleným k hradní stráži v částce | 100 Kčs. |
(2) Entitlement to the service allowances referred to in paragraph 1 shall arise on the day on which the military person is assigned to the castle guard and shall expire on the day of his departure. If the period of secondment does not exceed 15 days in the calendar month, including the date of its arrival, after the date of departure, the half of the allowance referred to in paragraph 1 shall be due, otherwise the allowance shall be payable for the whole calendar month.
(3) If a military person assigned to the castle guard is permanently engaged in a service for which he / she is entitled to an allowance other than that of the present day, he / she shall be entitled to this new allowance from the first day of the month following the assignment to another service; if he has been in such service since the first day of the month, he shall be entitled to this new allowance on that date.
(4) If a military person permanently assigned to a castle guard does not serve him for a period not exceeding two months, he shall retain his entitlement to the allowance referred to in paragraph 1, provided that he continues to live in the number of castle guards. However, if such interruption in the service of the castle guard lasts more than two months, the entitlement to the allowance shall cease on the last day of the second month following the day on which the service was interrupted. On the first day of the following month, entitlement to any higher duty allowance linked to that service shall be transferred to the member of the castle guard who actually holds it.
(5) For each night in which a military person assigned to the castle guard is on guard duty, it shall be subject to a special night allowance, namely:

(6) Special allowances to members of the castle guard shall be paid monthly in advance or at the end of the assignment to the castle guard, shall not be part of the pension base and shall be exempt under the provisions of § 3, paragraph 2 of Act No. 109 / 1947 Coll. from payroll tax.
Staff allowances of members of the Airborne Corps.
(1) Special allowance shall be granted for each calendar month of training to members of the paratrooper's basic, improvement, maintenance or recurrent training,

(2) Where the training referred to in paragraph 1 is carried out only for part of a month, a special allowance shall be granted for each day of the training period of one thirty-monthly amount.
(3) The special allowance referred to in paragraph 1 shall also be granted during the period of proper leave provided for in the relevant regulations, provided that the member of the troop continues on completion of the leave in one of the types of training referred to in paragraph 1.
(4) The special allowance referred to in paragraph 1 may also be granted by the Ministry of Defence for the duration of the treatment of injuries or diseases arising directly from training of the parachute units, from the date of the injury or disease until the end of the treatment no later than the last day of the third calendar month following the end of the month in which the injury or disease occurred. If the treatment of injury or illness, including convalescence, lasts longer, the Ministry of Defence may grant all or part of the service allowance for the remaining period of incapacity to serve in the troop, but for a maximum period of three months, assuming that the injured or ill will again be able to serve in the troop after recovery. The Ministry of National Defence shall determine the details, in particular how the injury or illness is related to the performance of the service.
(5) The special allowance is paid monthly late, is not part of the pension base and is exempt under the provisions of § 3, § 2 of Act No. 109 / 1947 Coll. from payroll tax.
Final provisions.
The provisions of § 9, § 1 and § 12 of the Decree of 15 June 1934, No 111 Coll., on the formalities of military personnel in active duty and of certain other persons in equal terms shall be deleted.
The measures taken by the Ministry of Defence on matters covered by this Regulation between 5 May 1945 and its effectiveness are seen as if they had already been taken for its effectiveness.
This Regulation shall enter into force on the first day of the month following its publication; they shall be carried out by the Minister for National Defence.
