DECLARATION
of 30 March 2010
concerning certain animal health and veterinary requirements for the transport and processing of animal by-products
The Ministry of Agriculture provides pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., Act No. 316 / 2004 Coll., Act No. 48 / 2006 Coll., Act No. 182 / 2008 Coll. and Act No. 227 / 2009 Coll., to implement Section 41 (5) (a) of the Act:
Subject matter
This decree regulates the health and veterinary requirements of the
(a) the colour marking of packaging, containers and vehicles used for the collection (collection) and the transport of different categories of animal by-products (2) ("animal by-products"), as well as processed products3);
(b) the transport of manure;
(c) processing of certain animal by-products.
Colour labelling of packaging, containers and vehicles used for the collection (collection) and transport of animal by-products
(1) Packaging, containers or vehicles intended for the collection (collection) or transport of materials
(a) category 1 shall be marked in black;
(b) category 2, with the exception of manure and digestive tract content, shall be marked in yellow;
(c) Category 3 shall be marked with a green colour with a high blue content to ensure a clear distinction from other colours.
(2) The colour marking must be clear and indelible during the collection (collection) and transport. It shall be placed on the surface or part of the surface of the packaging, container or vehicle, where appropriate on the label or symbol attached thereto.
Transport of manure
Herring 4), which is transported within the territory of the Czech Republic within the holding or between the holding and the place of destination in which it is to be used, need not be accompanied by a commercial document or veterinary certificate (5), and the packaging, container or vehicle in which it is transported may not be marked verbally by the word "manure '(6).
Exemptions from the standards established by the directly applicable European Union Regulation
The operator of an animal by-product composting plant, biogas plant or other technical plant (hereinafter referred to as "the applicant ') shall be authorised by the Regional Veterinary Administration on application of standard parameters for the processing of animal by-products (7), other than those laid down in Regulation (EC) No 1774 / 2002 of the European Parliament and of the Council, provided that the applicant proves that the conditions laid down in Annex VI, Chapter II (C) (13a) and Annex VIII, Chapter III, Section II (A) (5) are met. (c) this Regulation.
Repeal
Decree No 295 / 2003 Coll., on animal confiscation, disposal and further processing, is repealed.
Efficacy
This Decree shall take effect on the first day of the second month following its publication.
