amending and supplementing Decree No. 137 / 1974 Coll., on Inland Navigation
The Federal Ministry of Transport provides in agreement with the participating central authorities pursuant to § 24 of Act No. 26 / 1964 Coll., on Inland Navigation, as amended by Act No. 126 / 1974 Coll. and in order to implement the Decree of the Government of the Czechoslovak Socialist Republic No. 11 / 1976 Coll., on the registration of inland vessels:
Decree No. 137 / 1974 Coll., on Inland Navigation, is amended as follows:
1.
"(d) the operational competence of vessels for navigation in terms of navigation safety (hereinafter referred to as" operational competence "), including compliance with the maximum number of passengers (persons) in respect of passenger ships, as well as the technical competence of small vessels (§ 35 (1)), ferries, ferries and floating equipment, with the exception of the equipment referred to in paragraph 3 (c),"
Article 1 (2) (i) reads as follows:
"(i) to decide on the operational competence of vessels, as well as on the technical competence of small vessels, trailers, ferry vessels and floating equipment, with the exception of the equipment referred to in paragraph 3 (c); to issue small vessel type licences and to approve technical documentation for the construction of small vessels for which seaworthiness is demonstrated by a ship certificate;"
3. Article 1 (3) (c) reads as follows:
"(c) carry out technical technical supervision of the construction, reconstruction or modernisation of ships, floating machinery, floating docks, restaurants, botels, dormitories, mills and workshops, as well as the production of marine material and equipment; issue certificates certifying the technical competence of vessels subject to such surveillance; ';

"(d) carry out technical inspections of the vessels referred to in (c);"
5. the last sentence of Paragraph 4 (2) reads:
"Gravel mining in the monitored waterway is authorised by the water authority in agreement with the navigational authority. '
6. Article 11 (2) (a) and (b) read:
"(a) for passenger and cargo ships, for tugs, for tanker ships, for unmanned cargo boats used on a regulated line and on enclosed water areas including gravel sites and for icebergs - every fourth year,
(b) in the case of cargo boats with crew, floating machinery and floating docks, restaurants, botels, hostels, mills and workshops up to 20 years old - every sixth year, in the case of older vessels - every fourth year, "
7. The heading "Sensitivity" above Section 13 is deleted.

(to Article 12 (1) of the Act and the Decree of the Government of CSSR No. 11 / 1976 Coll.)
(1) The registration of vessels shall be subject to the following conditions:
(a) ships of a total weight including an authorised load of more than 1000 kg or with a total sail area of more than 10 m2 or with an engine power of more than 4 kW (approx. 5,4 k);
(b) floating machines;
(c) floating equipment;
(d) ferry vessels.
(2) The registration of vessels consists of the registration of vessels in the register of inland vessels and the allocation of registration marks or markings for small vessels (§ 37a).
(3) Details of vessel registration marks are laid down in the Code of Navigation Safety on Inland Waterways (the Code of Navigation Safety) .1.
(4) The place of registration of vessels (except small ones) with a permanent post in the Czech Socialist Republic is Prague and a permanent post in the Slovak Socialist Republic Bratislava. "
9. The following Section 35a is inserted after Section 35:
Small vessel construction
(1) Small vessels subject to registration under Paragraph 37a (2) may be manufactured or imported in excess of 5 pieces only if they have been issued for their type of licence. This licence is issued by the navigation service after examination of the technical documentation for the construction of the vessel or after the test voyage. The manufacturer, for imported vessels, shall issue a type-certificate for each vessel.
(2) The technical documentation, which is intended for reuse in the individual construction of small vessels subject to registration (type documentation), must be approved in advance (e.g. before printing) by the navigational authority responsible for the residence (s) of the documentation processor.
(3) Where the documentation referred to in paragraph 2 is not used for the construction of a small vessel which is subject to registration, one set of drawings containing the general plan, the main rib drawings, the rib (ribs) drawing, the drafts of the steering and propulsion equipment and the wiring shall be submitted to the navigational authority responsible for the applicant's residence before the construction begins for approval, as well as a technical description. The construction of such a vessel may not commence until the documentation submitted has been approved.
(4) In the case of individual construction of small vessels not subject to registration, the technical documentation shall not be submitted to the navigation authority. '
10. Paragraph 36 (2) reads as follows:
"(2) Eligibility for navigation shall be demonstrated by a ship's certificate for vessels subject to registration in accordance with Paragraph 37a (2). ';
11. the first sentence of Paragraph 36 (3) reads:
"The ship's certificate shall be issued on written request and extended by the navigational authority responsible for the place of residence of the vessel operator. ';
12. In Paragraph 36 (4), the following sentence is added at the end:
"The Sailing Authority may waive the technical inspection of sport racing vessels whose technical competence is demonstrated by a certificate issued by a body-keeping organisation. '
13. in Article 37 (1), (2) and (4):
"(1) A self-propelled vessel with an engine power up to 4 kW (approx. 5,4 k) may be operated by a person over 15 years of age who has a licence to conduct a vessel (hereinafter referred to as" licence ").
(2) A self-propelled vessel with an engine power greater than 4 kW (ca. 5,4 k), a vessel with no self-propelled capacity of the total weight, including an authorised load of more than 1000 kg, and a vessel without a self-propelled vessel with a total sail area greater than 10 m2 may be operated by a person over 18 years of age with a licence.
(4) The minimum age condition laid down for the management of sails in paragraphs 2 and 3 shall not apply to youth organised in the yacht sections of body-keeping organisations when the voyage is carried out under the supervision of a qualified instructor. ';
14. the last sentence of Paragraph 37 (7) reads:
"The sailing authority may require the conduct of a test voyage if it considers it necessary. '
15. The following Section 37a is inserted after Section 37:
Registration and marking of small vessels
(1) The record of small vessels is kept by the navigational authority or its branches responsible for the place of residence of the vessel operator.
(2) Small vessels (§ 35 (1)) are subject to registration of vessels meeting the criteria set out in § 14.
(3) Each vessel subject to registration shall have a designation assigned by the navigational authority responsible under paragraph 1. The indication shall indicate the abbreviation of the place of registration, the group number of the category of small vessels concerned and the serial registration number. The designated designation shall be indicated by the navigational authority in the ship's certificate for vessels whose seaworthiness is demonstrated by this certificate (§ 36 (2)).
(4) The Maritime Safety Order provides for the designation of small vessels not subject to registration. '
(1) Operators of small vessels which are subject to registration under this Order and have not already been registered under previous regulations are required to register with the competent navigation authority on the prescribed forms by 31 December 1976 at the latest.
(2) Operators of small vessels for which a ship's certificate is required under this Order are required to apply to the competent navigational authority on the prescribed form for its issue by 31 December 1976 at the latest, unless such certificate has already been issued under the previous rules.
This decree shall take effect on 1 January 1977.
