DECLARATION
Ministry of Education and Culture
of 26 November 1966
on work allowances and economic security for learners at work
The Ministry of Education and Culture provides, pursuant to § 126 (3) of the Labour Code No. 65 / 1965 Coll., pursuant to § 33 (3) of Act No. 186 / 1960 Coll., on the System of Education and Education (Education Act), under § 19 (3) of the Act No. 19 / 1966 Coll., on Higher Education Schools, and under the authority given by the Government Resolution of 2 November 1966 No 398:
§ 1
Scope
(1) This decree provides for work relief and economic security for workers, members of single agricultural cooperatives and members of production cooperatives recommended by organisations to study in educational establishments or courses in order to obtain a degree of education or to extend or deepen the degree of education or professional qualifications achieved.
(2) The work allowances and economic security provided for in this Decree are for students in all forms of study.

Work relief
§ 2
Working allowances for students in secondary education, secondary schools for workers, vocational schools, secondary vocational schools, corporate technical schools and conservatories
The organisations shall provide students at secondary education schools, secondary education for workers, vocational schools, secondary vocational schools, corporate technical schools and conservatories with the following work concessions:
(a) four hours of leave per week, with the exception of teachers who are entitled to two hours per week from the normal level of education and educators who are entitled to three hours per week from direct education;
(b) one week of leave with compensation for wages in each school year for preparing and carrying out examinations;
(c) one week of leave without compensation for a school year to participate in study centres (laboratory exercises, practices, practices), if they are part of the curriculum;
(d) preparation and performance of the graduation examination (final artistic examinations)
1. two weeks' leave without compensation of salary, if the graduation exam does not include professional graduation,
2. Five weeks (three weeks for graduates of schools providing full secondary education) on leave without compensation of salary, provided that the final examination includes professional graduation.
§ 3
Work relief for students at corporate institutions and in higher years of conservatory *)
The organisations shall provide the following work concessions to students at corporate institutions and in senior year conservatories:
(a) four hours of leave per week, with the exception of teachers who are entitled to two hours per week from the normal level of education and educators who are entitled to three hours per week from direct education;
(b) two weeks' leave, with compensation for wages in each school year for preparing and carrying out tests;
(c) one week of leave without compensation of a salary in the school year to participate in laboratory exercises (practices) if they are part of the curriculum;
(d) five weeks, two weeks' leave for teachers to pay for the preparation and completion of the final examination and for the defence of professional work.
§ 4
Work relief for students in universities
The organisation shall provide university students with leave of absence with compensation to the following extent:
(a) twenty-two working days in each school year for evening and external studies, except for teachers who are due two hours a week for a normal degree of teaching;
(b) twenty-four working days in each school year for long-distance studies, with the exception of teachers to whom two hours per week are due for a normal degree of teaching;
(c) two working days for preparing and carrying out each test;
(d) one week in the school year to participate in the study centres if they are part of the curriculum;
(e) 16 weeks for preparing and carrying out a state final examination, except for teachers who are 12 weeks old.
§ 5
Working allowances for course participants
The organisation shall provide course participants with a period of work with compensation to the following extent:
(a) in courses which have at least 200 teaching hours per year or 80 consulting hours in a remote studio;
1. one hour per week except for teachers;
2. Three working days, two working days for teachers to prepare and perform the final examinations;
(b) in courses of at least 400 teaching hours per year or 160 consulting hours in a remote studio;
1. Three hours a week, except for teachers who are entitled to one hour a week from the normal level of teaching;
2. Three working days, two days for teachers to prepare and perform the final examinations;
(c) in management courses of at least six months;
1. Twelve working days per six months for study, consultation, laboratory exercise and concentration,
2. two working days for preparing and carrying out each examination, except for school directors;
3. One week to prepare and perform the final exam.
§ 6
Work relief for participants in the graduation course
In the post-graduate course, which has at least 400 teaching hours per year or 160 consulting hours during the long-distance study, the organisation shall provide the study staff with a salary replacement of four hours per week and for the preparation and completion of examinations for each school year of one week.
§ 7
Working allowances for post-graduate students
(1) The organisations shall provide post-graduate students, with the exception of teachers, with paid leave to the following extent:
a) in the daily form of postgraduate studies
1. on a one-off basis for the duration of teaching, but not more than 15 weeks;
2. two working days to prepare and carry out each test;
3. Two weeks for preparation and completion of the final examination;
(b) in other forms of postgraduate studies
1. twenty-four working days in the school year for study, consultation and laboratory exercises,
2. two working days to prepare and carry out each test;
3. one week in the school year to participate in the study centre,
4. Two weeks to prepare and perform the final exam.
(2) In all forms of post-graduate studies, the organisations shall provide the teachers with leave of absence with compensation to the following extent:
(a) two hours a week from the normal level of teaching;
(b) two working days to prepare and carry out each test.
§ 8
Work relief for students at the evening universities of Marxism-Leninism
The organisation shall provide students at the evening universities of marxismyleninism with a pay-compensation period of two working days to prepare and perform each test and one week to prepare and perform the final examinations.
§ 9
Other work relief
(1) A student in the educational establishments referred to in Sections 2 and 3, if the curriculum provides them with more than 15 hours of compulsory education per week, shall be extended by an additional hour of leave per week, with compensation for the salary for each additional three hours of study, but not more than eight hours per week.
(2) Women who take care of at least one child under 15 years of age are hereby extended leave with compensation for the salary of the studies referred to in § 2, 3, 4, 6, 7, except for the daily form of postgraduate studies for another week in the school year.
(3) For those who have applied for an external graduation exam, the organisation shall provide a leave of absence of compensation for the salary to the extent provided for in Section 2 (d).
(4) The organisation shall provide applicants for study with the necessary time off without compensation for the salary to carry out the entrance examinations (interviews).
§ 10
Drawing of work relief
(1) Working leave
(a) the number of hours that a student may draw per week may be added up and used, in agreement with the organisation, for a maximum period of four weeks and for studies at secondary agricultural and forestry technical schools in the same school year;
(b) the number of days or weeks cannot be drawn after hours;
(c) provided in long-distance and external studies can be drawn throughout the school year, including the period of main holidays, during evening and exchange studies outside the main school holidays and in courses only for the duration of courses.
(2) Unspent leave may not be transferred to another school year except for the leave to prepare and carry out the final examination, the final examinations and the leave granted in the post-graduate course.
(3) The working time of the worker shall also be included in the number of weeks' leave provided that the working time has been allocated to less than 6 days in the week in question.
§ 11
Recruitment of work allowances during incapacity and leave
(1) Working leave
(a) shall be interrupted by the recognition of incapacity for work or, where appropriate, by the quarantine regulations at the time when the student receives the allowance under this decree; if the student receives a study allowance (§ 13), his pay is stopped;
(b) it is for the student to have a fixed number of hours for a week in which he has not worked during a specified working week for an obstacle to work, in which he is entitled to compensation for wages or physical security under sickness insurance rules; If the obstacle to work persists continuously for more than four weeks, he shall be entitled to leave for a maximum period of four weeks.
(2) It is not for the student to take a full period of time, but it is also for him to take up a week in which he has chosen up to two working days.

Economic security
§ 12
Compensation of wages
(1) The remuneration for the period of leave is paid at the rate of the average earnings (Section 275 of the Labour Code).
(2) The organisation shall bear the cost of working leave with compensation.
§ 13
Study contribution
(1) During the period of leave without compensation, the organisation of the study allowance shall grant to the student at the time of employment.
(2) The study allowance shall be:
u ženatých (vdaných), ovdovělých, rozvedených a svobodných, kteří mají vyživovací povinnost aspoň k jednomu dítěti 340,- Kčs
u ženatých (vdaných) bezdětných 275,- Kčs
u svobodných, ovdovělých, rozvedených, kteří nemají vyživovací povinnost k dítěti 170,- Kčs
(3) The amount of the study allowance may not exceed the amount of the average earnings. A proportion of the study allowance shall be provided on leave of less than or longer than one week. The costs of the study allowance shall be borne by the organisation.
§ 14
Meals
At the time of the study camp and during the final examinations, students are entitled to eat in school canteens and in menus under the same conditions as students in daily studies. *)
§ 15
Discounts on fare
(1) Czechoslovak State Railways and Czechoslovak State Automotive Transport provide students with the same discount on fares as students and students in daily studies, except for local transport.
(2) The student is obliged to use the most advantageous means of public transport from the place of residence to the place of instruction (consultation, concentration, examinations, etc.) and back. The discount on the fare is only applicable when the lowest carriage class is used, and if the speedster is used, only when the distance exceeds 100 km.

Common provisions
§ 16
Adjustment of working time
(1) The organisation will allow students to adjust their working conditions appropriately, in particular by scheduling working time, to fulfil all the obligations associated with the study and will not, as far as possible, order them to work overtime.
(2) Training staff who study remotely or externally shall plan working hours so that they have one free working day each week to participate in consultations and individual studies.
§ 17
Work relief at shorter working hours
Students with less than a specified weekly working time (Section 86 of the Labour Code) are not entitled to work leave fixed by the number of hours per week and, when studying in universities, to work leave provided for in Section 4 (a), (b).
§ 18
Duration of work allowances and economic security
(1) Relief and economic security shall be withdrawn from the student who has not passed the test prescribed for the relevant semester or school year within the prescribed time limit. They shall be provided again if they have successfully carried out all prescribed tests within a corrective period. If there is a study in which tests are not prescribed, the study's work allowances and economic security shall be withdrawn if the organisation finds that the student is substantially neglectful of the study's duties. Exemptions shall be granted by the organisation, where justified, after consultation with the race committee of the Revolutionary Trade Union Movement and the relevant educational establishment.
§ 19
Extension of work allowances and economic security
Organisations may, in cases justified by their cadre needs or by the student's needs which are worthy of special consideration, grant higher work allowances and economic security than those laid down in this Decree; Before its decision, the organisation shall seek the opinion of the race committee of the basic organization of the Revolutionary Trade Union Movement and the relevant educational establishment.
Transitional and final provisions
§ 20
(1) In the school year 1966 / 67, the annual leave to be paid under this decree shall also be included in the annual leave exhausted under the current rules.
(2) If the organisation has agreed to study before 1 January 1967 or if it has chosen a worker before that date, this shall be deemed to be a recommendation under Paragraph 1 (1) of this Decree.
§ 21
The Ministry of Education and Culture may, in the event of a further reduction in working time, reasonably limit the work allowances and economic security provided for in the previous provisions.
§ 22
This decree shall not apply:
(a) to healthcare professionals who, when working, are trained in health education establishments;
(b) to participants in the study at the Faculty of Medicine during the period of study, *)
(c) professional soldiers.
§ 23
(1) The following shall be deleted:
1. Decree No 20 / 1955 of the Minister for Education of the Ú. l., on work allowances for participants in extraordinary forms of study and on their economic security;
2. Decree No 131 / 1956 of the Minister for Education and Culture of the Ú. l., on work relief and reimbursement of fare to participants in special courses,
3rd Government Decree No. 107 / 1961 Coll., on Employment Relief and Economic Security of Students at School of Secondary and Higher Education, in some universities and in the evening universities of Marxism-Leninism,
4. all guidelines of the Ministry of Education and Culture on these decrees. * *)
(2) Without prejudice to:
1. the provisions of point 2 to 7 of the Decree of the Ministry of Education and Culture of 14 February 1961, namely 7.354 / 61-III / 5 on the physical security of faculty listeners - Institute of National Economic Planning at the University of Economics in Prague,
2. the Decree of the Ministry of Education and Culture of 20 July 1961, No 35.120 / 61-III / 5 on extending the validity of the Decree referred to under point 1, to the Faculty - Institute of National Economic Planning at the University of Economics in Bratislava,
3. regulations governing work relief and financial security of scientific and artistic aspirants. *)
§ 24
This decree shall take effect on 1 January 1967.
