on the State Service for Precious metals
In agreement with the participating members of the Government pursuant to § 13 (1) of the Act of the Bureau of the National Assembly No 2 / 1955 Coll., on the State Service for Measures and Weights, on the State Service for Precious metals and on the testing of weapons and ammunition for civil use:

INTRODUCTORY PROVISIONS
§ 1
The task of the State Service for Precious metals is to manage and control the circulation of precious metals, to ensure that they are handled economically, to increase the technical level of production and to protect consumers' interests.
§ 2
Scope
The provisions of this Decree apply to gold, silver, platinum and platinum group metals: paladium, iridium, rhodium, ruthenium and osmium in pure or in materials containing the following metals ("precious metals').

STATE SERVICES AUTHORITIES FOR PREPARED METAL
§ 3
(1) The Ministry of the Metallic Industry and the ore mines is the central body of the State Service for Precious metals.
(2) The Ministry of the metallurgical industry and the ore mines is subordinate to the state testing facility for precious metals in Prague with branches in Jablonica nad Nisou, Brno, Ostrava and Bratislava (hereinafter referred to as the "state testing centre").
§ 4
Tasks of the Central Authority of the State Service for Precious metals
In particular, the Ministry of Steel and ore mines shall carry out the following tasks:
(a) organise and manage and control the State service for precious metals;
(b) decide on appeals pending a decision of the State Service;
(c) approve and assign manufacturing marks and labels.
§ 5
Tasks of the State Service
It shall be the responsibility of the State Service in particular of:
(a) to supervise the control and testing of precious metals by:
1. Checks whether the regulations on the use of precious metals are being complied with and takes measures to remedy the defects detected;
2. Suggests measures to ensure the efficient management of precious metals to the competent authorities;
3. oversees the observance of the purity of alloys in the embossing of gold and silver Czechoslovak coins and the observance of the purity of alloys for dental purposes;
4. carry out analyses of precious metals and auxiliary metals by a chemical-analytical or physico-chemical method and carry out testing; it gives opinions or certificates on the results of the examination and investigation ("the certificate '),
(b) carry out, and certify, the testing and arbitration tests for platinum, platinum metals, gold and silver;
(c) to carry out an official examination of the purity and the prescribed state of articles of goldsmiths, silversmiths and jewelers of platinum, gold and silver (hereinafter referred to as "precious metal goods") and their official marking,
(d) to carry out official testing and labelling of goldtepec products and alloys of gold, silver, platinum or platinum metal when presented for inspection;
(e) to carry out immediate checks on undertakings which manufacture, repair, purchase, store or sell goods of precious metal;
(f) order the provision of goods of precious metal which have escaped mandatory control and take samples of materials, semi-finished products and articles of precious metal for chemical testing;
(g) to take over old gold and silver, to melt this material and, after finding the amount of gold and silver, to deliver precious metals in pure condition in agreement with the balance sheet;

PROCEEDINGS AND CONTROL OF THE CIRCUMSTANCES
§ 6
Compulsory testing and verification
(1) Compulsory checks and verifications are subject to:
(a) platinum, gold and silver;
1. produced in the Czech Republic and intended for circulation in the Czech Republic;
2. produced domestically and intended for export abroad,
3. imported from abroad,
4. old, not officially marked, stolen against payment of the property of citizens,
(b) alloys intended for the manufacture of semi-finished products for dental purposes.
(2) The permanent designation of an article by an official mark or by an official sign of the Office or by a suspended official seal or certificate of verification shall be regarded as proof of verification, indicating that the articles have been examined by the State authority and that they comply with the rules.
§ 7
Professional supervision in plants
(1) The authorities of the State testing centre for precious metals in charge of professional supervision in undertakings (hereinafter referred to as "supervisory authorities") check compliance with the rules on the use of precious metals
(a) in workplaces carrying out smelting, refining or exchange of precious metals or producing, repairing, buying, storing or selling materials, semi-finished products and articles of precious metal;
(b) in all plants, institutes and laboratories, etc., which use precious metals or articles made thereof in their operation; In doing so, they shall also check from a technical point of view whether the consumption of precious metals and their recovery complies with the requirements of economy and whether safe storage, registration and collection of precious metals waste is ensured.
(2) In carrying out their tasks, the supervisory authorities shall have the right to enter into establishments, establishments and warehouses in accordance with the relevant competition entry directives and to consult the relevant records; the staff of such organisations shall be obliged to allow them to carry out the inspection and to provide them with the necessary information.
(3) The supervisory authorities are required to maintain national, economic and professional secrecy. They shall be accompanied by a special certificate issued by the State Service.
§ 8
Handling of defects
(1) The supervisory authorities are required to check whether measures have been taken to remedy the defects and to prevent losses on precious metals.
(2) The supervisory authority shall write down the findings of the findings of the official finding, following the rules in force on the inspection service.
(3) The supervisory authority may order the provision of defective items.
(4) If the defects for which the articles have been secured are removed, official proceedings may be carried out (designation by official mark, etc.). If the removal of defects is not possible, the item shall be broken and returned to the person to whom it was found, unless other provisions prevent it.
Research and testing work
§ 9
In particular, in the field of research and testing work, the State Service
(a) monitor and verify new discoveries and test methods in the field of precious metals;
(b) carry out independent research in the field of precious metal analysts;
(c) carry out documentation activities in the field of precious metals;
(d) cooperate in the identification of new test and control standards and take care to implement more appropriate methods;
(e) ensure that the results of the test activity are used in practice;
(f) provide expert advice and expertise in the field of applied chemistry of precious metals and jewellery production;
(g) cooperate with other test, control, development and research institutes and departments.
§ 10
The certificates issued on the results of investigations and testing of materials, semi-finished products and precious metal products are public documents.
§ 11
Supervision of gold and silver Czechoslovak coins
(1) The State Service shall determine whether the weight and purity of gold and silver Czechoslovak coins comply with the applicable coin issuance rules.
(2) Until the state mint receives a report on the favourable test result, it shall not send out coins of the respective stamping.

§ 12
(1) Goods of precious metal and articles of goldsmiths' wares produced both domestically and imported from abroad may be released for free circulation within the country only if they have the required purity and comply with the other provisions of this Decree.
(2) Articles of precious metal referred to in paragraph 1 of less purity than the lowest prescribed purity may not be produced or imported for circulation within the country.
§ 13
(1) The content of precious metals in alloys (purity) is expressed in thousands (1 / 1000).
(2) Prescribed purity for goods of precious metal are:

(3) Gold tepec products (leaf gold and silver) may be produced in purity from 910 to 1000.
§ 14
The quantity and type of precious metals in alloys from which instruments and instruments or other objects are produced for the purposes of scientific, teaching, laboratory, medical or technical use, and articles of precious metal for dental use, shall be determined by the Ministry of the metallurgical industry and the ore mines in agreement with the central authorities involved.

PAYMENT, GOLD AND SYRINGE GOODS

Oddíl I

Domestic production
A. CIVIL OF GOODS IN THE TOWN
§ 15
Control of goods
(1) Any newly manufactured goods of precious metal, with the exception of those referred to in Section 30, must be presented to the public service for examination of the purity and the prescribed condition and for marking by an official mark.
(2) The goods submitted for inspection must be complete with all the decorations and components and to such an extent that, after official examination and marking, the official mark is not damaged during final processing and that the goods cannot be changed. If submitted before the final treatment, it shall be properly cleaned.
(3) Goods fully prepared may only be presented if they are tested on a rock without damage and with appropriate precision.
(4) Production organisations shall designate goods of precious metals which they supply for circulation in the country, with an officially approved production mark and a number indicating purity.
§ 16
Prescribed status of goods
(1) Goods of precious metals shall never have a whole less purity than that indicated. This purity shall not be less in the individual parts of the goods without soldering or in the case of goods connected.
(2) If the goods do not have at least the lowest prescribed purity or the fault cannot be removed, they shall be broken and returned to the feeder (§ 8 (4)).
§ 17
Derogations from prescribed purity
In particular justified cases, the national service may allow a derogation from the prescribed purity for articles from platinum up to 10 / 1000, from gold up to 5 / 1000 and from silver up to 10 / 1000.
§ 18
Use of other precious metal
(1) Other precious metal may be used in the manufacture of articles of precious metal for certain parts for decoration, for technical or other reasons.
(2) The admissibility and scope of the use of another precious metal referred to in paragraph 1 shall be decided by the State Service.
§ 19
Links with base metals
(1) In order to obtain the necessary strength and elasticity, it is permitted to use foreign bodies of base metal (such as pens, lift, inserts which can be removed, etc.) for goods of platinum, gold and silver, if such bodies can be easily recognized as false.
(2) Mechanical connection of parts of base metal to goods of platinum, gold or silver is permitted only after prior written permission of the public service. Incorrect components shall be easily identifiable and marked as false.
(3) The public service may exceptionally allow derogations from the provisions of paragraphs 1 or 2.
§ 20

For technical reasons, it is permitted to use the following solders for soldering goods of precious metals:
(a) for platinum goods - solders of white gold containing not less than 585 / 1000 gold;
(b) in the case of goods of gold - solders complying with the prescribed purity,
(c) for silver goods - solders containing at least 600 / 1000 silver.
Testing of goods
§ 21
(1) The purity of articles of precious metal is to be determined, as a general rule, by testing on a prune stone by comparison with the test needles using test acids.
(2) Each separable component (screw, riveting or otherwise attached), as well as each component connected by solder, must be tested separately.
(3) For articles of precious metal which are plated with other precious metal, the purity of the surface layer of precious metal is not detected, but the core is tested.
(4) Where purity needs to be determined more precisely, the State Service shall be entitled to melt an article or part thereof and to undergo an accurate chemical test; this must be done in particular in the case of the subjects connected.
§ 22
(1) If the result of the chemical test is favourable to the participant, the national service may provide him with compensation for the actual damage caused by the breach of the subject under examination, if he so requests within 3 days of being informed of the result of the test. The refund shall not be granted if the article is damaged or has a small price.
(2) If the participant is not satisfied with the official finding of purity, a new test shall be carried out if requested within 3 days. If, in this repeated test, the finding is unfavourable to the participant, the subject shall be sent at his request for a final test of purity; the examination shall be carried out by a three-member commission appointed by the Ministry of the Metallic Industry and the ore mines.
Labelling of goods by official mark
§ 23
(1) Goods of precious metal complying with the provisions in force are marked with official marks.
(2) If the article is too small or if the official mark is such that it cannot be placed on the main part of the article, the official seal shall be affixed to the article with the official mark stamped.
(3) Separate parts of articles of precious metal or of soldering irons may be marked with a sign of a state testing facility for precious metal in Prague or the relevant branch.
(4) The official marks of precious metals and the official marks of the State testing centre for precious metals and its branches are hereby declared in the Annex.
§ 24
(1) Goods of precious metals of lawful purity other than those provided for in Article 13 (2) for the type of goods in question shall be marked with the lowest degree.
(2) Silver goods, plated or coated with gold, must be easily identifiable as silver by simple examination on the stone: they must bear the official mark for silver.
(3) Where goods of precious metal of other precious metal are used for certain components, the goods shall be marked with the marks laid down for the metals used on the relevant parts; If this is not possible, the marks shall be partially crossed over each other and first the mark of a metal which is less.
(4) If another precious metal of less than 0,5 g has been used, the article shall only be marked with the precious metal from which it is made.
B. GOODS INTENDED FOR EXPORTS INTO FOREIGN GOODS
§ 25
(1) The purity and condition of goods of precious metal may be agreed differently from the provisions of this Order when supplied for export.
(2) Any such goods exported to a foreign country must be presented for examination to the national service before being delivered for customs procedure, whether the purity and the state of the goods agree with the order of the foreign importer.
(3) The proof of examination shall be the official form signed by the State Service which the consignor must submit during the customs procedure.
§ 26
(1) Goods of precious metal intended for export to a foreign country shall not be subject to the obligation to mark the products with a mark of production or a number indicating purity.
(2) Where the exporter so requests, goods of precious metal exported abroad may be marked with an export mark; goods marked with an export mark shall be deemed not to be marked for circulation within the country.
(3) Manufacturing or commercial undertakings shall keep the goods for export in special containers separately from the goods intended for circulation in the country.

Oddíl II

Goods imported from abroad
§ 27
(1) Goods of precious metal imported from abroad are subject to the same control as goods produced in the country; examination and verification are carried out by the state testing centre for precious metals in Prague and its branches in Brno and Bratislava.
§ 28
(1) Goods of precious metal imported from abroad must have at least the lowest prescribed purity (Paragraph 13 (2)).
(2) If such goods comply otherwise with the provisions of this Order, the testing centre shall mark their foreign origin with an official mark; otherwise it is not permitted to trade with him in the Czech Republic.

Old platinum, gold and silver goods
§ 29
(1) Officially unlabelled goods of platinum, gold or silver from the property of citizens who enter the store or are sold in public auction or otherwise disposed of for consideration shall also be subject to an examination of the purity and the prescribed condition and the designation by an official mark. If it does not comply with the provisions of this Decree, it can only be disposed of as fractions.
(2) Owners of platinum, gold or silver goods which serve their personal needs may ask the public service to verify purity and, if the goods comply with the provisions of this Order, the official mark of their designation; Paragraph 16 (4) shall not apply.

Oddíl IV

Platinum, gold and silver goods exempt from compulsory control
§ 30
(1) Exemption from compulsory examination and labelling shall be granted:
(a) all State coins and Czechoslovak commemorative money, even if they are part of and are freely associated with articles of precious metal;
(b) objects of older origin which have a scientific, artistic or cultural historical price;
(c) articles entirely coated with enamel;
(d) mere frames of stones, pearls, enamels or mosaics of which the weight of gold, silver or platinum is of inferior importance;
(e) goods of precious metal received for repair; However, if the goods have been substantially altered or if a part of them has been replaced, they shall be examined even if they have been officially marked;
(f) goods of precious metal imported from abroad, provided that they have been admitted free of import duties or put into circulation in the country; However, such articles must be presented for official examination and marking if they are to be disposed of.
(2) The State Service decides in doubt whether the goods are subject to inspection.

LIQUIDITY TESTING OF BODIES
§ 31
(1) The production organisation which manufactures dental preparations must present in a sealed envelope to the State testing laboratory a sample of the alloy from each melt for chemical testing.
(2) The State Service shall check that the purity of the alloy complies with the established standard.
(3) If the alloy does not conform to its purity, a new test shall be carried out by the State Service from the same sample. If the alloy does not comply even in this case, the undertaking may request a final test of purity (§ 22 (2)).
(4) Until the undertaking receives a report on the favourable test result, it shall not process the alloy into dental preparations.

Zlatotypic products
§ 32
(1) The Zlatotepec undertaking shall provide books of heated gold or silver with an approved label with the name and registered office of the undertaking on which it shall indicate the type of precious metal, its purity and gross weight; may apply for the official designation of goldsmiths' products.
(2) Where the undertaking submits goldsmiths' products for official designation, it shall also attach a sample of the material from which the products were manufactured. Where gold or silver is geared to the prescribed purity (§ 13 (3)), the national service shall check whether the observed purity of gold or silver is consistent with the purity indicated on the label and, if appropriate, verify the book by means of an official stamp on the label.
(3) If the golden products submitted do not have the prescribed purity, they shall be destroyed and returned to the manufacturer. Paragraph 22 (2) applies mutatis mutandis.

OTHER ARTICLES OF RAW METAL
§ 33
(1) Instruments, tools and other articles of precious metal, intended for scientific, educational, medical, laboratory or technical purposes, and articles of precious metal for dental purposes, are subject to supervision by the State testing centre; the supervisory authorities shall check in the course of the revisions whether the purity of these products complies with the standards laid down.
(2) Such articles may be put into circulation provided that they bear an officially approved mark and data containing precious metals. If these markings cannot be permanently affixed to the article, the manufacturer shall indicate them on the certificate (s) attached to the article.
(3) In agreement with the participating members of the Government, the Minister for the Metal Industry and the ore mines may extend the compulsory examination and verification to or from the items referred to in paragraph 1.
