GOVERNMENT REGULATION
of 21 August 1961
on consumer councils
The Government of the Czechoslovak Socialist Republic, led by an attempt to extend the participation of workers in the management of socialist trade, orders pursuant to § 45 of Act No. 65 / 1960 Coll., on National Committees:
Establishment of consumer councils
(1) The national committees are to ensure that the population supply sector is increasingly met by its needs and by increasing its culture and service levels. These tasks can only be performed for the greater and more effective participation of workers in the management of internal trade, in particular by the direct involvement of consumers in improving the services of shops and public catering establishments. To this end, national committees shall set up consumer councils as their assets.
(2) Consumer Councils establish local, urban and district national committees at stores, department stores and public catering establishments (hereinafter referred to as "shops"). The Consumer Council shall be established under local conditions for one or more, but not more than five stores. The national committee shall inform the head of the store and the head of the organisation of the establishment and its composition.
(3) The Regional National Committees may provide that consumer councils will also be set up for the premises of socialist organisations providing services to the population (such as repair shops of articles, maintenance facilities for the population, dry cleaners and laundries); lay down their tasks.
Appointment and withdrawal of members of consumer councils
The members of consumer councils shall be appointed and removed by the local, urban or district national committee from the customer list of the store. A member of the Consumer Council may also be appointed a member of a supply or production organisation and a representative of social or other organisations. Membership of the Consumer Council is an honorary function.
Composition of the Consumer Council
The number of members of the Consumer Council shall be determined by the size, importance and, where appropriate, the number of outlets for which the Consumer Council has been established. The Consumer Council shall consist of at least three members. The members of the Consumer Council shall elect a chairman for a period of one year.
Activities of the Consumer Council
(1) The Consumer Council makes proposals, suggestions, advice and assistance for the development of the level of retail services for which it was established.
(2) To this end, its members shall monitor the work of stores, in particular:
(a) whether the supply of goods is sufficient and smooth and alters the heads of stores and, where appropriate, suppliers to the types of goods to which the shop is not supplied, even though consumers are interested in them;
(b) how suppliers comply with sales orders and delivery plans, whether the sales orders are sufficient and delivery plans acceptable locally;
(c) how the receipt of goods and the claim of non-quality goods are carried out;
(d) how hygiene is respected both in the shop and in its workers;
(e) whether the serving staff complies with the principles of fairness and courtesy towards consumers and whether comments and complaints from the wish book and complaints are properly and in a timely manner handled;
(f) how the sales time is respected and whether the appearance of the store is satisfactory;
(g) whether the display cabinets are properly adapted and properly illuminated in the evening;
h) how the shop is secured against damage.
(3) The members of the Consumer Council help to address the shortcomings; submit their findings and proposals to the Consumer Council for consideration.
(4) The Consumer Council has expressed its views on the proposals for the authorisation of exemptions from sales time and on the proposals for the temporary closure of outlets.
(5) The Consumer Council shall carry out its tasks in close cooperation with Members of the national committees and with other workers, in particular requiring them to make suggestions for improving the work of stores and, where appropriate, to remedy deficiencies and defects, and to inform them, together with the sales managers, of the measures taken, of the work of shops and of market events.
Meeting of the Consumer Council
(1) The Consumer Council shall normally meet on a monthly basis. Before its meeting, it shall have the right to invite the head of the store, or his representative, or any other staff of the store. The consumer council of the Directorate of Trade Organisation and, where appropriate, the supplier or production organisation shall communicate its proposals and suggestions. The Directorate of Supply or Production Organisation shall communicate in particular its proposals and suggestions on the technical level or quality of products. The Directorate of Trade, Supply and Production Organisations shall deal with these proposals and suggestions and deal with them within 15 days at the latest. If the Consumer Council considers the processing of the proposal insufficient, it shall contact the National Committee which set it up.
(2) The Consumer Council proposes to the local national committee the organisation of calls with consumers or, where appropriate, the organisation of such calls itself, the organisation of trade organisations of exhibitions of goods, production organisations of goods, etc.
Rights and obligations of members of the Consumer Council
Members of the Consumer Council shall be entitled to request the necessary explanations from their staff when visiting stores. When entering the sales rooms, members of the Consumer Council are obliged to follow the basic rules for the work of stores (basic rules for the work of public catering establishments), health regulations and orders imposed on business managers.
Obligations of employees of trade, supply and production organisations
The staff of the store shall be obliged to attend the meetings of the Consumer Council at the invitation, to allow the member of the Consumer Council to monitor the work of the store and to provide the necessary explanations. The directors of trade organisations, directors of organisations supplying goods to the store and directors of production organisations shall be required to examine the proposals and suggestions of the consumer council and inform the consumer board within 15 days at the latest whether its proposals will take place or, where appropriate, the reasons for this.
Assets of members of consumer councils
National committees assist consumer councils in their activities. They shall organise training of members of consumer councils and, where necessary, shall convene the assets of their members at the place, district or county. These assets exchange consumer advice experience, evaluate the results of their work, announce the best consumer advice, etc.
Final provisions
The provisions of this Regulation shall not apply to shops and establishments of folk consumer cooperatives.
This Regulation shall enter into force on the day of its publication.
