Replacing the judges of the people.
The Government of the Czechoslovak Republic orders, in an agreement with the Unified Trade Union Organisation pursuant to § 30 (3) and § 31 (3) of Act No. 66 / 1952 Coll., on the organisation of courts:
(1) To the judges of the people in employment, the employer provides compensation for the salary which they have missed in carrying out the judicial function; the compensation for the salary which the judges of the people have given to the performance of another activity with that function, hereinafter referred to as "other activity ', is provided by the State.
(2) Salary compensation is granted at the rate of the average earnings achieved in the last wage accounting period.
(1) On their request, judges from non-working people receive compensation for their anticipated lost earnings (increased extradition).
(2) The refund is 15 Cds for each starting hour, but not more than 120 Cds for the whole day.
(1) People's judges (§ 1) who have been granted leave of absence to perform a judicial function or other activities shall, without interruption, remain under compulsory insurance as employees and may not be suspended from insurance.
(2) Compensation for the loss of wages is attributable to the assessment basis for national sickness insurance benefits and pension benefits.
Compensation for wages lost is paid to judges from the people by their employer. The amount paid by the employer in respect of compensation for wages lost by the performance of another activity as well as the corresponding part of the insurance premiums shall be paid by the administration to the employer.
The right to compensation which the State is obliged to grant shall be exercised within 15 days of the end of the judicial function or other activity; that entitlement is decided by the judicial authority which has been responsible; there is no appeal against his decision.
Government Decree No. 25 / 1949 Coll., on Refunds to Judges of the People, is hereby repealed.
This Regulation shall enter into force on 1 January 1953; they shall be carried out by the Minister of Justice in agreement with the Minister of Finance.
