on the abolition of orphans' coffers.
The National Assembly of the Czechoslovak Republic decided on the following Act:
Preparatory measures to abolish orphans' coffers.
(1) Hypothetical claims on the orphans' coffers with their accessories shall be transferred on 1 January 1950 for remuneration to the county savings banks and back-ups, after the case to the savings banks and back-ups (hereinafter referred to as the "monetary institutions") at the premises of the competent county courts; The Ministry of Finance may, for serious organisational reasons, in particular if the main establishment of the Money Institute is not at the seat of the court, provide by decree in the Official Gazette of the Czechoslovak Republic that the hypothetical claims of the orphans' Treasury are transferred to a monetary institution elsewhere.
(2) The amount of remuneration for the hypothetical claim and the manner in which it is repaid shall be determined by agreement between the orphanage and the monetary institution. If no agreement is reached, the President of the relevant Regional Court shall decide in agreement with the Central Council of Cooperatives.
(3) The transfer of hypothetical claims referred to in paragraph 1 shall be recorded in public books, on a proposal from the President of the Regional Court concerned, referring to this law. Library entries are exempt from fees.
From 1 January 1950, the cash of the court protectors deposited in the orphanage shall not be remunerated.
Orphanage coffers are not allowed to lend to each other next time.
The Minister of Justice may, in agreement with the Minister of Finance, merge the orphans' coffers which are located in the district of the same regional court.
The gradual abolition of orphans' coffers.
In an agreement with the Minister of Finance, the Minister of Justice shall gradually abolish the orphans' coffers as soon as this is justified by the economic circumstances of the individual orphans' coffers and their assets, but not later than 31 December 1955.
(1) The claims against the Orphanage Treasury, which will be applied after its cancellation, will be paid from the administrative surpluses (reserve funds) managed in bulk (Section 12, paragraph 2 of the Act of 16 October 1946, No. 193 Coll., on the adjustment of certain ratios of the Orphanage Treasury).
(2) The cash of the court protectors deposited with the cancelled orphanage shall be transferred to separate deposit accounts as an individual legal deposit.
After the cancellation of all the orphan's coffers, the State's administrative surpluses (§ 6 (1)) shall be due on a date to be determined by the Minister for Finance; After them, the State Treasury is transferred to the State by the liabilities of the abandoned orphans' coffers.
Final provisions.
Starting in 1950, from the net administrative surpluses of orphans' coffers each year until the date on which they accede to the State (Section 7), the amount determined for the current year by the Minister of Justice in agreement with the Minister of Finance will be transferred to the Treasury.
After the cancellation of all the orphan's treasuries, the proceeds of the resources referred to in § 7 (3) of Act No. 193 / 1946 Coll. will be paid to the Treasury.
Paragraph 1 (2) of Act No 193 / 1946 Coll. shall be deleted from the date of publication of this Act and the provisions of Section 7, paragraphs 1 and 2 thereof shall be deleted from 31 December 1949.
This law takes effect on the day of its publication and applies in the Czech regions; It shall be implemented by the Minister of Justice in agreement with the Minister of Finance.
