DECLARATION

amending Decree No. 446 / 2005 Coll., laying down a range of foreigners who may reside in the transit area of an international airport in the Czech Republic only on the basis of an airport visa issued, as amended
The Ministry of Interior provides pursuant to § 182 (1) (b) of Act No. 326 / 1999 Coll., on the residence of foreigners in the Czech Republic and on the amendment of certain laws, as amended by Act No. 428 / 2005 Coll. and Act No. 379 / 2007 Coll.:
Decree No. 446 / 2005 Coll., establishing the circle of foreigners who may reside in the transit area of an international airport in the Czech Republic only on the basis of an airport visa issued, as amended by Decree No. 356 / 2006 Coll., Decree No. 418 / 2006 Coll., Decree No. 13 / 2007 Coll., Decree No. 246 / 2007 Coll. and Decree No. 111 / 2008 Coll., is amended as follows:
1. Paragraph 1, including footnote 1, reads as follows:
This decree, following the directly applicable legislation of the European Community1) regulates the range of foreigners who can reside in the transit area of an international airport in the Czech Republic only on the basis of an airport visa issued.
1) Regulation (EC) No 810 / 2009 of the European Parliament and of the Council of 13 July 2009 on the Community code on visas (Visa Code). '
2. Paragraph 2 (2), including footnote 2, reads:
"(2) The alien referred to in paragraph 1 may reside in the transit area of an international airport within the territory of the Czech Republic without an airport visa on the basis of the directly applicable legislation of the European Community2).
2) Article 3 (5) of Regulation (EC) No 810 / 2009 of the European Parliament and of the Council of 13 July 2009 on the Community code on visas (Visa Code). '
3. Paragraph 2 (3) is deleted.
Efficacy
This Decree shall take effect on 5 April 2010.
