amending Act No. 140 / 1961 Coll., Criminal Act, as amended
Parliament has decided on this law of the Czech Republic:

Poaching
(1) Those fishing for game or fish, or hiding, shall transfer or retain game or fish caught unjustly, shall be punished by deprivation of liberty for up to two years, or by penalty or prohibition of action or forfeiture.
(2) Withdrawal of liberty for six months to five years and forfeiture of the case shall be punishable by the offender if he commits the act referred to in paragraph 1.
(a) intended to confer an asset benefit on itself or on others;
(b) in a particularly reprehensible manner,
(c) in a mass-efficient manner, or
(d) as a member of an organised group.
In the same way, the offender shall be punished if he has been sentenced in the last three years for the act referred to in paragraph 1. ';
This Act shall take effect on 1 October 1998.
