DECLARATION
Federal Ministry of Fuel and Energy
of 19 November 1987
implementing the State Energy Inspection Act
The Federal Ministry of Fuel and Energy, in agreement with the Federal Ministry of Communications, the Ministry of Justice of the Czech Socialist Republic and the Ministry of Justice of the Slovak Socialist Republic, provides pursuant to Section 15 of Act No. 88 / 1987 Coll., on State Energy Inspection:
§ 1
Subject matter
This decree regulates in more detail the tasks of the national energy inspection bodies, in particular the scope of cooperation with the authorities and organisations, the conditions for the creation of the assets of the professional staff and their participation in controls, the carrying out of controls on the premises and facilities of the Federal Ministry of Communications, the Ministry of Justice of the Czech Socialist Republic and the Ministry of Justice of the Slovak Socialist Republic.
Tasks of the State Energy Inspection
§ 2
(1) The regional branch of the State Energy Inspection responsible according to the site of construction (1) The zoning documents, the planning documentation and documentation of the selected buildings, which are relevant for the assessment of their energy performance, are expressed in terms of the regional branch of the State Energy Inspection (1).
(2) The selected construction is such that annual consumption in each type of fuel and energy reaches one of the following values:
a)1 000 thnědého uhlí
500 tčerného uhlí
200 tkoksu
200 ttěžkých topných olejů
10 tlehkých topných olejů
60 000 m3zemního plynu
120 000 m3svítiplynu,
(b) the quantity of heat produced by the supplier from fuels referred to in (a);
(c) if annual consumption at the sum value of all energy and fuels exceeds 15 000 GJ;
(d) if the rated heat output of the fuel in question is at least 1000 kW;
(e) 150 kW of rated power consumption of installations using electricity for heating, air conditioning and water heating;
1000 kW of rated power consumption of equipment where electricity is used for the purposes of technology.
(3) The selected construction can also be another construction with lower values for individual types of fuels and energy, if agreed upon by the relevant regional branch of the State Energy Inspection with the Regional National Committee.
§ 3
The State Energy Inspection Authorities shall express:
(a) a conceptual solution to the supply of fuel and energy in the area concerned, in terms of rational fuel and energy management, to the extent agreed with the Regional National Committee;
(b) to involve heat sources and appliances in centralised heat supply systems and to pool investments in the construction of resources and heat distribution, at the initiative of the Regional National Committee or the investor;
(c) the organisation and management of the energy economy in controlled buildings;
(d) to correct the results of national fuel and energy saving competitions and cooperate with their promoters.
§ 4
National Energy Inspection Authorities
(a) with the competent departments of the Federal Ministry of the Interior, the Ministry of the Interior of the Czech Socialist Republic and the Ministry of Interior of the Slovak Socialist Republic in ensuring uniform procedure and coordination of activities in the performance of the tasks of the State Energy Inspection,
(b) with fuel and energy supply organisations, national committees, project organisations and investors of buildings in order to resolve the rational way in which fuel and energy are supplied;
(c) with the competent authorities and organisations for the production of technical norem2 (3) to comply with the principles of state fuel energy policy and knowledge of science and technology for the rationalisation of the energy economy;
(d) with scientific research bases, the scientific and technical development services of the relevant manufacturers in assessing the development and manufacture of appliances, as well as mass use appliances in terms of their energy performance, the elements used to rationalise consumption and with the national testing bodies in approving or evaluating selected products, 4)
(e) with international organisations according to approved action plans;
(f) with the relevant external trade organisations and organisations authorised for foreign trade, when assessing imports of selected types of technological and mass use appliances in terms of their energy performance.
§ 5
(1) State energy inspection bodies contribute to the economical use of fuels and energy in particular in the form of:
(a) technical assistance to bodies, organisations and citizens, consisting of the submission of opinions, the implementation of measurements and other agreed forms of cooperation in the preparation of rationalisation measures (use of secondary energy sources, economic solutions for the replacement of deficit fuels and energy, etc.); professional assistance shall be provided for remuneration in accordance with specific regulations, 5)
(b) consultation of bodies, organisations and citizens which are provided free of charge, by holding regular consultation days, professional seminars and individual consultations.
(2) The State Energy Inspection for the Czech Socialist Republic and the State Energy Inspection for the Slovak Socialist Republic, after consultation with the Regional National Committees, the National Committee of the City of Prague and the National Committee of the Slovak Socialist Republic Bratislava, set up regional consultation centres.
(3) Consultation activities shall aim in particular at:
(a) the transmission of information on the possibilities for the rational use of fuels and energy;
(b) the creation of a technical information base on the possibilities for the efficient use of fuels and energy, 6)
(c) recommending model solutions for fuel and energy savings.
§ 6
The State Energy Inspection Authorities operate with a planned technical and economic propaganda on the rational use of fuels and energy in all sectors of the national economy.
To this end, the authorities of the State Energy Inspection
(a) issue non-periodic publications and promotional materials;
(b) in cooperation with manufacturers and suppliers of fuels and energy, manufacturers of fuel and energy appliances and equipment for rationalising the consumption and use of fuels and energy, universities, scientific institutes, the Czechoslovak Scientific and Technical Society and the media at all levels, contribute to increasing the professional level of promotion actions and exhibitions.
§ 7
The specialized training of workers on the section of the energy economy is provided by the educational establishment "Energy Institute of State Energy Inspection for the Czech Socialist Republic" throughout the Czechoslovak Socialist Republic. 7)
Creating professional staff assets
§ 8
(1) The Regional Inspectors shall keep a list of experts from whom they will be selected for the performance of certain tasks of the State Energy Inspection in the region concerned. The list of professionals may only include staff recommended for this activity by organisations in which they are employed.
(2) The Chief Inspector will request the release of the expert on the list in writing, not later than 15 days before the beginning of the inspection.
(3) Experts who have been released and authorised under the law shall, on the basis of instructions from the inspector concerned, participate in the task of carrying out the inspection.
§ 9
(1) The personal equipment of the professional staff shall be provided by the county inspector responsible for both the material and the documentary aspects.
(2) The national energy inspection authorities shall ensure that experts receive information on the tasks to be addressed no later than 5 days before the start of the inspection.
§ 10
The authorities of the State Energy Inspection shall, for the duration of their activities in the State Energy Inspection, provide for reimbursement of travel expenses under a special rule. 8)
§ 11
Implementation of controls in the premises and facilities of the Federal Ministry of Communications, the Department of Correctional Education of the Czech Socialist Republic and the Department of Correctional Education of the Slovak Socialist Republic
(1) In the premises of the Department of Correctional Education of the Czech Socialist Republic and the Department of Correctional Education of the Slovak Socialist Republic, and in the facilities of the Federal Ministry of Communications, the bodies of the State Energy Inspection are controlled.
(2) Only State Energy Inspectors who have special authority over the Ministry concerned may enter the premises and facilities referred to in paragraph 1, as specified by the relevant Ministers. When carrying out control activities in such premises and facilities, the inspectors of the National Energy Inspection Service shall be accompanied by a member of the Correctional Education Corps designated by the Chief of the Controlled Unit or, if it is an organisation of the Federal Ministry of Communications, by a designated staff member.
(3) Fines for deficiencies detected in the premises of the Federal Ministry of Communications are imposed by the Chief Inspector or Regional Inspector on the responsible staff.
(4) The authorities of the State Energy Inspection will notify the identified deficiencies in the energy economy caused by the responsible members of the Correctional Education Corps to the Chief of the Controlled Unit of the Correctional Education Corps for Penalties under specific regulations. 9)
§ 12
Efficacy
This Decree takes effect on 1 January 1988.
