of 3 June 1975
concerning the Convention on the Application of the Standards of the Council of Mutual Economic Assistance
On 21 June 1974, the Convention on the Application of the Standards of the Council of Mutual Economic Assistance was signed in Sofia.
The President of the Republic ratified the Convention and the instrument of ratification was deposited in the Secretariat of the Council of Mutual Economic Assistance, the depositary of the Convention, on 24 February 1975.
The Convention entered into force on 27 March 1975 on the basis of Article III thereof and for the Czechoslovak Socialist Republic on 24 May 1975.
The Czech translation of the Convention is being announced simultaneously.

CONVENTION
on the application of the Council's standards on mutual economic assistance
the Governments of the People's Republic of Bulgaria, the People's Republic of Hungary, the German Democratic Republic, the Republic of Cuba, the People's Republic of Mongolia, the Republic of Poland, the Union of Soviet Socialist Republics and the Czechoslovak Socialist Republic,
managing the principles of cooperation between the Member States of the EMFF and the tasks of the Comprehensive Programme for further deepening and improving cooperation and the development of the Socialist Economic Integration of the EMFF Member States and seeking to ensure further improvement of the effectiveness of economic and scientific and technological cooperation,
Recalls that the early determination and application of advanced technical values and requirements for the subjects of cooperation are of utmost importance,
Having regard to the fact that, within the framework of the RVHP, great experience has already been gained on the development and application of normative technical documents for standardisation,
to increase the role of such documents in the cooperation of States,
taking into account Resolution XXVIII. Council meeting on the approval of the Statute for RVHP standards, which establishes the procedure for drawing up and approving RVHP standards,
agree on the following:
1. States - Parties to the Convention shall ensure the binding and direct (immediate) application of the RVHP standards, drawn up and approved by the Council of Mutual Economic Assistance in accordance with the procedure laid down therein, in contractual legal relations in economic and scientific and technological cooperation between States in order to enhance the effectiveness of cooperation by means of standardisation, as well as the application of the RVHP standards in the national economy, with a view to further developing technical progress in each of these States.
2. The binding and direct (immediate) application of the RVHP standard in contractual legal relations in economic and scientific and technological cooperation between States - participants in the Convention referred to in point 1 of this Article shall mean the binding application of the RVHP standard to the subject matter of cooperation, by reference to the RVHP standard in documents determining contractual legal relations (agreements, contracts, contracts).
3. Contractual legal relations are those arising from the process of implementing multilateral and bilateral economic and scientific and technical cooperation between Member States - participants in the Convention and their economic organisations under agreements, contracts, contracts for specialisation and co-operation of production, supplies and trade between Member States of the FMC, scientific research and experimental work, supply, construction, assembly, transport and other relevant relations arising from the cooperation process.
4. The competent national authorities and the economic organisations of States - participants in the Convention apply the RVHP standards in the preparation, conclusion and implementation of agreements, contracts and contracts under the RVHP on specialisation, cooperation, reciprocal supply and trade between States - participants in the Convention, as well as other forms of cooperation; they comply with all RVHP standards and standards.
In the case of supplies of materials, components, knots and products manufactured under licences, reference in the contract documents to other normative technical documents shall be allowed in accordance with the requirements of the licences in question.
Where the RVHP standards are missing, technical or other documents shall be used in accordance with national laws of the States - participants in the Convention whose organisations are parties to contracts, agreements and contracts.
(5) Derogations from the values and requirements laid down in the RVHP standards to which references are made in contracts, agreements and contracts shall be permitted subject to the consent of the parties involved in the contracts, agreements and contracts concerned.
The authorisation to derogate from the standards of the RVHP in contractual relations shall be granted within the States - participants in the Convention, by the authorities (organisations) of the States empowered by the Governments, directly participating in the approval of the RVHP standards.
The content of deviations from the values and requirements of the RVHP standards shall be stated in contracts, agreements and contracts.
6. The application of the RVHP standard to the national economy of the States - participants in the Convention, as referred to in point 1 of this Article, shall mean either the immediate application of the RVHP as a national standard without modification or its introduction into national standards under conditions of ensuring full compliance of national standards indicators with the RVHP standards.
In so doing, States - participants in the Convention are entitled to set in national standards higher product quality indicators than those of RVHP standards, while maintaining the requirements of interchangeability and technical compatibility.
National standards drawn up on the basis of the RVHP standard shall have a label indicating compliance with the RVHP standard.
(7) Derogations from the RVHP standard applicable in the national economy of the States - participants in the Convention or from the RVHP standard introduced into national standards are permitted in accordance with the national laws of the States - participants in the Convention.
8. States - participants in the Convention may declare that they will not apply individual standards of the RVHP.
The Declaration on the non-application by the Member States of individual standards of the RVHP - participants in the Convention - does not concern commitments arising from contracts, agreements and contracts previously concluded, in which references to the standards are made.
This Convention shall not apply to contractual legal relations in economic and scientific and technological cooperation between States - participants in the Convention, in force at the date of entry into force of the Convention.
1. This Convention shall be subject to ratification by the States which signed it. The instruments of ratification shall be deposited in the custody of the Secretariat of the Council of Mutual Economic Assistance, which shall act as depositary of this Convention.
2. This Convention shall enter into force on the 90th day following the date of surrender of the fifth instrument of ratification to the depositary.
3. For States whose instruments of ratification are to be deposited in custody by the depositary after the entry into force of this Convention, the Convention shall take effect 90 days after the date of surrender of their instruments of ratification by the depositary.
Following the entry into force of the Convention, they may join it, with the agreement of the States - participants in the Convention, as well as other States, either in full or in part, concerning the application of the RVHP standards in contractual legal relations between those States and States - by providing the depositary with a document on such connection.
Any State participating in this Convention may withdraw from it, which shall inform the depositary in advance. The denunciation shall take effect 12 months after the date on which the depositary receives the notification. The withdrawal of the State from the Convention shall not concern contractual legal relations in economic and scientific and technological cooperation in force on the date on which the denunciation takes effect.
The depositary shall immediately inform all States that have signed or joined this Convention of the date on which each instrument of ratification or document of accession to the Convention was deposited in its custody, of the date on which the Convention entered into force, as well as of the receipt of other communications resulting from this Convention.
The depositary of this Convention shall take appropriate measures to register this Convention in the United Nations Secretariat in accordance with its Charter.
This Convention shall be submitted to the depositary for safekeeping, which shall circulate duly certified copies of the Convention to the States which have signed or joined the Convention.
