full text of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as follows from the amendments made by Act No. 151 / 2002 Coll., Act No. 262 / 2002 Coll., Act No. 278 / 2003 Coll., Act No. 356 / 2003 Coll. and Act No. 670 / 2004 Coll.
THE LAW
on terms and conditions of business and the exercise of state administration in the energy sector (Energy Act)
Parliament has decided on this law of the Czech Republic:
CONDITIONS OF ENTERPRISE AND PERFORMANCE OF STATE MANAGEMENT IN ENERGY SECTORS
GENERAL PART
Subject matter
This law regulates, in accordance with the law of the European Community1) the conditions of entrepreneurship, the exercise of state administration and non-discriminatory regulation in the energy sectors of electricity, gas and heating, as well as the rights and obligations of natural and legal persons associated therewith.
Definition of terms
(1) For the purposes of this Act:
(a) non-discriminatory regulation of the organisation of business in the energy sector, while maintaining the function of competition, meeting the needs of consumers and the interests of licence holders and ensuring a reliable, safe and stable supply of electricity, gas and heat at affordable prices;
(b) the state of emergency of the restriction or interruption of energy supply in the whole or part of the territory of the Czech Republic for the reasons and in the manner set out in this Act;
(c) by a responsible representative, a natural person appointed by the holder of a licence for the production, transmission and distribution of electricity, for the transport, distribution and storage of gas, for the production and distribution of heat energy and for the trade in electricity or gas (hereinafter referred to as "the licence holder") who is responsible for carrying out the licensed activity under this law.
(2) Furthermore, for the purposes of this Act:
(a) in electricity
1. distribution of electricity by the distribution system,
2. an interconnected distribution system of 110 kV lines and devices, with the exception of selected 110 kV lines and devices which are part of the transmission system, and lines and devices with a voltage of 0,4 / 0,23 kV, 3 kV, 6 kV, 10 kV, 22 kV or 35 kV to ensure the distribution of electricity in the defined territory of the Czech Republic, including systems of measurement, protection, control, signalling, information and telecommunications technology; the distribution system is established and operated in the public interest,
3. by an electrical connection to a device which starts by diverting from the switching elements or connectors in and outside the power station from the distribution system line towards the customer and is intended to connect the demand electrical equipment,
4. by an electrical station, a set of structures and installations of the electricity system which allows the transformation, compensation, conversion or transmission and distribution of electricity, including the means necessary to ensure their operation;
5. the electricity system of the Czech Republic interconnected set of equipment for the production, transmission, transformation and distribution of electricity, including electrical connections and direct lines, and systems of measuring, protection, control, signalling, information and telecommunications technology (hereinafter referred to as the "electricity system"),
6. the protected customer is a natural or legal person who has the right to be connected to the distribution system and to supply electricity of the specified quality and at regulated prices,
7. combined production of electricity and heat of the conversion of primary energy into electricity by electric and useful heat in a joint simultaneous process in a single production facility;
8. The final customer is a natural or legal person who only consumes the withdrawn electricity;
9. measuring equipment all equipment for measuring, transferring and processing the measured values;
10. low voltage between phases up to and including 1000 V;
11. electricity trader, natural or legal person holding a licence to trade in electricity and purchasing electricity for the purpose of its sale,
12. The regulatory energy balancing market managed and organised by the electricity market operator in coordination with the transmission system operator,
13. by the natural or legal person receiving electricity,
14. the sampling point of the one customer's demand facility, including measuring transformers, the collection of which is measured by one measuring device or by other means by agreement;
15. by derogation, the sum of the differences between actual and agreed supplies or electricity withdrawals over a given period of time,
16. authorised customer, natural or legal person who has the right of access to the transmission system and distribution systems for the purpose of electing an electricity supplier,
17. Support services for the activities of natural or legal persons whose installations are connected to the electricity system, which are intended to provide system services, and after the activation of which electricity is normally supplied,
18. Operation of the distribution system all activities of the distribution system operator related to ensuring a reliable distribution of electricity;
19. Operation of the transmission system all activities of the transmission system operator related to ensuring reliable transmission of electricity;
20. A natural or legal person holding a electricity distribution licence,
21. The transmission system operator shall be a legal person holding a power transmission licence,
22. transmission of electricity by transmission system including transport of electricity by interstate lines,
23. transmission system interconnected set of lines and installations 400 kV, 220 kV and selected lines and equipment 110 kV, listed in the Annex to the Transmission System Operation Rules, for the purpose of providing electricity transmission for the whole territory of the Czech Republic and interconnections with the electricity systems of neighbouring States, including systems of measurement, protection, control, signalling, information and telecommunications technology; the transmission system is established and operated in the public interest,
24. direct power lines connecting the power plant not connected to the transmission system or distribution system, and a demand point not electrically connected to the transmission system or distribution system, or power lines providing the direct supply of its own plants, its controlled companies or authorised customers, and not owned by the transmission system operator or distribution system operator;
25. a regulated approach for the use of a transmission system or distribution system for the transport of electricity under the conditions laid down by this Act and at regulated prices set by the Energy Regulatory Authority;
26. system services of the activities of the transmission system operator and distribution system operators to ensure the reliable operation of the electricity system of the Czech Republic with regard to the operation of the interconnected electricity systems,
27. defined territory the area in which the holder of the electricity distribution licence is obliged to connect any customer who so requests and fulfils the conditions laid down by this law,
28. producer, natural or legal person who produces electricity and holds a licence to produce electricity;
29. electricity generation equipment for the conversion of different forms of energy into electricity, including technological equipment for the conversion of energy, the construction part and all necessary auxiliary equipment;
30. Household final customer who does not buy electricity for purposes other than his own household consumption,
31. A vertically integrated entrepreneur or group of entrepreneurs, provided that their relationship is in line with the immediately binding provisions of the European Community1a) and holds at least one of the licences for the transmission of electricity or the distribution of electricity and at least one of the licences for the production of electricity or for trade in electricity;
32. secondary energy source usable energy source, the energy potential of which arises as a by-product in the conversion and final consumption of energy, in the release from bituminous rocks or in the energy recovery or disposal of waste and substitute fuels produced on the basis of waste or in other economic activities;
33. A small customer employs fewer than 50 employees, whose net turnover over the last financial year does not exceed CZK 250 million and whose collection point is connected to a low voltage network,
34. A balancing entity (hereinafter referred to as "settlement entity") shall be a participant in the electricity market for which the electricity market operator carries out an evaluation, clearing and settlement of derogations under the settlement contract,
35. Electricity provided by the activation of support services or in the balancing market for regulatory energy,
36. electricity from cogeneration of electricity and heat produced in a common process associated with the production of useful heat;
37. Total efficiency: the sum of the annual volume of electricity produced in the cogeneration process divided by the input fuel energy used to produce useful heat, to produce electricity and to produce mechanical energy;
38. efficiency reference value for separate generation of electricity and heat (hereinafter referred to as "benchmark") the total efficiency in alternative separate production of heat and electricity that can be replaced by combined production of electricity and heat,
39. by the electric and thermal energy ratio, the figure expressing the proportion of electricity production to be used to produce useful heat in cogeneration installations over a certain period of time,
(b) gas
1. by distributing gas to the gas distribution system used primarily for the supply of final customers,
2. an interconnected distribution system of very high-pressure, high-pressure, medium-pressure and low-pressure gas pipelines and related technological objects, including a system of control and signalling technology and equipment to transfer information for the activities of computer and information systems, which is not directly linked to compression stations and on which gas distribution is provided by the gas licence holder; the distribution system is established and operated in the public interest,
3. protected customers each final customer who is not an authorised customer,
4. by the final customer, a natural or legal person purchasing gas for own consumption, or, where applicable, which provides part of its purchased gas to another natural or legal person and is not a business under the Commercial Code;
5. by the gas trader, the holder of the licence for the gas trade buying gas for resale to other gas market participants;
6. the point of collection where the gas sampling device is installed for one final customer to which the gas supply measured by the measuring device is carried out;
7. gas sampling devices, all devices starting with the main gas closure, including gas end-use devices; is not a measuring device;
8. Authorised customer is a natural or legal person who has the right to choose gas suppliers and has the right to access the transmission system, distribution systems, underground gas storage facilities, mining pipelines and free accumulation,
9. the gas system interconnected set of gas production, transport, distribution and storage facilities, including the control and signalling system and the information transmission equipment for computer and information systems for the operation of such facilities;
10. natural or legal person who, under a licence granted under this Act, is engaged in the production, extraction or operation of a transmission system or in the operation of a distribution system or in the operation of an underground gas storage facility,
11. gas pipelines, pipeline connections and related technological objects;
12. Gas, natural gas, lamp gas, coke oven gas, degas and generator gas, biogas, propane, butane and their mixtures, unless used for motor vehicle propulsion,
13. A gas pipeline connection to a device beginning with a divergence from the distribution system and ending before the main gas closure behind which the customer's gas demand facility continues;
14. gas equipment for gas production and treatment, underground gas storage, liquefied gas storage, gas storage, filling plants, liquefaction, evaporation, compression and control stations, low pressure, medium pressure, high pressure, very high pressure and direct gas pipelines, gas pipelines and gas pipelines,
15. Underground gas container gas equipment, including related technological objects and control and signalling equipment and equipment for the transfer of information for gas storage activities of computing and information systems; the underground gas storage tank is established and operated in the public interest,
16. Operation of the distribution system all the activities of the distribution system operator related to ensuring reliable distribution of gas and supply to protected customers;
17. the operation of an underground gas storage tank, all the activities of the gas storage operator associated with the security of underground storage;
18. By operating the transmission system, all activities of the transmission system operator related to ensuring reliable gas transport,
19. A natural or legal person operating a distribution system and holding a gas distribution licence,
20. The operator of the underground container is a natural or legal person who operates an underground container and holds a gas storage licence;
21. The transmission system operator shall be the natural or legal person operating the transmission system and holding a gas licence,
22. transmission system interconnected set of very high-pressure and high-pressure gas pipelines and compression stations and related technological objects, including a system of control and signalling equipment and equipment for the transmission of information for computer and information systems activities, linked to gas systems abroad, on which the gas licence holder operates; the transport system is established and operated in the public interest,
23. Transport of gas by transmission system,
24. direct pipeline gas pipeline which is not part of a transmission system or distribution system and which is additionally set up for the supply of gas to the eligible customer and serves only for its own use;
25. Defined territories the area provided for in the gas distribution licence in which the holder of the licence has the obligations and rights provided for by this law;
26. producer, natural or legal person producing or extracting gas and holding a gas production licence;
27. the production gas of the gas plant, including the construction part and the necessary auxiliaries, where the holder of the gas production licence operates;
28. pipeline equipment for pipeline transport of gas by transmission or distribution system and direct and mining pipelines,
29. the combined gas collection facility of the gas collection facility in the owner's property through which the gas is supplied to final customers in that property,
30. Technical rule the rule expressing the state of technical knowledge and technology in the gas sector,
31st household final customer who does not collect gas for purposes other than his own household consumption,
32. A vertically integrated gas entrepreneur, or a group of entrepreneurs, whose relations correspond to the directly binding provisions of the European Communities (1a) and who carry out at least one of the activities of transporting, distributing or storing gas and at least one of the activities of producing or trading gas;
33. free capacity the difference between the actual capacity of the transmission system or distribution system or underground gas storage or gas pipeline and the total of all capacities contracted for each customer within a given period of time, respecting the contractual pressures, the sum of all capacities provided for the fulfilment of the legal capacity-assurance obligations by the relevant licence holder and the sum of the capacities necessary for the relevant licence holder to ensure the safety and reliability of the operation of the relevant gas installation;
34. the pipeline for the pipeline connecting the gas plant to the transmission or distribution system,
35. pressure level of maximum operating pressure for gas, gas and sampling gas installations, as specified in technical standards or technical rules;
36. main gas closure cap of the sampling gas plant, which separates the sampling gas plant from the pipeline connection,
37. Free storage of gas by compression in the transport or distribution system;
38. small customer, who employs less than 50 employees in employment and whose net turnover over the last financial year does not exceed CZK 250 million,
39. planning the planning of gas production, gas supply, transport, distribution and storage capacity of the relevant systems or underground gas storage facilities on a long-term basis in order to meet the demand for gas and ensure its smooth supply to final customers;
40. third party access right of a gas market participant to conclude a contract with a transmission system operator, distribution system operator or underground gas storage or manufacturer to ensure the relevant licensed activity under this Act; the right of access to free accumulation may only be used at the same time as the right of access to the transmission system or distribution systems;
41. Gas source to the State on whose territory the gas has been extracted,
42. A decisive source of gas by a state in whose territory more than 50% of the total annual gas consumption in the Czech Republic has been extracted,
43rd difference between actual and agreed gas deliveries and withdrawals on a given trading day,
(c) heating
1. by the distributor of heat energy, the owner or charterer of the distribution heat equipment by which the heat energy is transported or transformed and supplied for further use to another natural or legal person,
2. the supplier of heat energy, the natural or legal person supplying heat to another natural or legal person; the supplier may be the manufacturer, distributor and also the owner or community of owners providing heat energy as a supply provided with the use of apartments or non-residential premises or for technological purposes;
3. by the supply of heat energy, the supply of heat or cold energy for further use by another natural or legal person; the supply of heat energy for further use is made in the public interest,
4. by the final consumer, a natural or legal person who only consumes the supplied heat energy;
5. by the thermal energy buyer the distributor, owner or community of the owners of the demand heat equipment; the consumer may also be the final consumer; the supply of heat energy directly to the final consumer is subject to direct sampling for all final consumers in a centrally heated building,
6. by taking the heat energy supply from the manufacturer or distributor for final consumption or further use,
7. the point of collection, instead of the place of supply provided for in the heat energy supply contract, in which the heat energy passes from the supplier's ownership to the customer,
8. heat sampling equipment of equipment connected to the source or distribution of heat energy intended for internal distribution and consumption of heat energy in the building or part of it, or in the customer's set of objects,
9. heat energy distribution by transport, accumulation, transformation of parameters and supply of heat energy by heating distribution,
10. heat distribution equipment of heat energy transport equipment consisting of heat networks and transmission stations; a heat network means a system of equipment used for the transport of heat energy or for the interconnection of resources between themselves; the heating plant is set up and operated in the public interest; the heat sampling device is not part of the heat distribution device;
11. The heat or cold energy contained in the heat carrier;
12. Defined territories area of the licensed activity of the heat energy supplier;
13. producer, natural or legal person who receives heat energy from fuels or other types of energy and supplies the energy produced;
14. heat energy source of an installation where the use of fuels or other types of energy is obtained from the heat energy transmitted to the heat carrier;
15. an integrated building work, technically connected by one common heat collection device,
16. useful heat heat produced, for supply to a centralised heat supply system or for direct supply to natural or legal persons for further use and for technological purposes, with the exception of self-consumption of resources,
17th system of centralized heat supply system consisting of heat energy sources and heating distribution equipment and heat sampling devices.
Entrepreneurship in the energy sector
(1) Entrepreneurship in the energy sector is the production of electricity, the transmission of electricity, the distribution of electricity and the trade in electricity, the activities of the electricity market operator, the production of gas, the transport of gas, the storage of gas and the trade in gas, and the production of heat energy and the distribution of heat energy.
(2) The transmission of electricity, the transport of gas, the distribution of electricity and the distribution of gas, the storage of gas, the production and distribution of heat energy are carried out in the public interest.
(3) Under the conditions laid down by this Act, natural or legal persons may only do business in the energy sector within the territory of the Czech Republic on the basis of the state consent granted by the Energy Regulatory Authority. Licences under this Act shall not be granted for the trade, production, distribution and storage of propane-butane and its mixtures, unless they are distribution by pipeline systems, and for the production of heat energy intended for the supply to final consumers by one of the heat collectors from a heat source located in the same building. Furthermore, a licence under this Act shall not be granted for an activity where the customer provides the collected electricity, gas or thermal energy to another natural or legal person through his own or operated demand facility, the cost of purchasing electricity, gas or heat energy to such persons merely disaggregated it in an agreed or determined manner and is not a business.
Licences
(1) Licences shall be granted for a maximum of 25 years, namely:
(a) electricity generation;
(b) gas production;
(c) electricity transmission;
(d) the transport of gas;
(e) electricity distribution;
(f) gas distribution;
(g) gas storage;
(h) heat energy generation;
(i) heat distribution.
(2) Licences for trade in electricity or gas are granted for a period of 5 years. The licence for the activities of the electricity market operator shall be granted for a period of 25 years.
(3) For the whole territory of the Czech Republic they are issued as exclusive
(a) electricity licences;
(b) gas licences; and
(c) licences for the activities of the electricity market operator.
(4) Where an applicant for a licence referred to in paragraph 1 provides evidence of ownership or other right of use for an energy installation intended to carry out the licensed activity for a period of less than 25 years, the licence shall be granted for a maximum of that period.
Conditions for granting licences
(1) The condition for granting a licence to a natural person is:
(a) reaching the age of 21;
(b) full legal capacity;
(c) integrity,
(d) the competence or provisions of the representative responsible pursuant to Article 6.
(2) Where a legal person applies for a licence, the conditions laid down in paragraph 1 (a) to (c) must be met by the members of the statutory authority. Furthermore, the provision of an agent responsible is a condition for granting a licence to a legal person.
(3) A natural or legal person applying for a licence must demonstrate that he has the financial and technical capacity to carry out the licensed activity and that this activity does not endanger the lives and health of persons, property or interests of environmental protection. The natural or legal person applying for a licence shall be required to demonstrate the right of ownership or use to an energy facility to perform the licensed activity. Where an applicant for a licence is not the owner of an energy installation, he shall also demonstrate the consent of the owner of the energy installation to use it for the purposes defined by this Act, at least for the period for which the licence is to be granted. Energy equipment shall have a technical level corresponding to the legislation and technical standards. The financial assumptions referred to in paragraph 7 shall not be required to demonstrate the applicant for a licence for the production of electricity from renewable sources or the applicant for a licence for the production of heat energy from renewable sources if the installed electrical power of the installation is less than 200 kW or the installed heat output is less than 1 MWt.
(4) For the purposes of this law, a person who has been convicted of a final sentence shall not be deemed to be righteous.
(a) for an offence committed intentionally for an unconditional prison sentence of at least 1 year;
(b) for an offence committed intentionally, the nature of which is linked to an enterprise and which is not covered by point (a); or
(c) for a criminal offence committed out of negligence, the nature of which relates to the business, unless it is regarded as not being convicted.
(5) The professional qualification for the licensing provided for in Article 4 (1) shall be understood as completed technical university education and 3 years of professional experience in the field or full secondary technical training with graduation and 6 years of experience in the field. In the case of the generation of electricity or heat energy to an installed power output of 1 MW including and of a separate distribution facility or thermal power distribution facility with an installed power output of up to and including 1 MW, training in the field and 3 years of professional experience or retraining to operate small energy sources or equivalent certificates issued in another State is sufficient. For the production of electricity from renewable sources to the installed output of the 20 kWe production, there is no obligation to demonstrate competence. The professional competence for granting the licence referred to in Article 4 (2) shall be understood to mean completed higher education and 3 years of experience or full secondary vocational training with graduation and 6 years of experience.
(6) The financial assumptions shall mean the applicant's ability to financially secure the operation of the activity for which a licence is required and the ability to secure current and future commitments for at least 5 years. The financial assumptions of the applicant shall not be met if, over the past 3 years, the court has annulled the bankruptcy against the applicant's assets because the timetable order has been complied with, or the court has annulled the bankruptcy because the bankruptcy's assets are not sufficient to cover the costs of the bankruptcy, or the court has rejected the application for bankruptcy for lack of assets. The applicant for a licence shall not be financially eligible if he has registered arrears in taxes, duties and charges, social security contributions, contributions to state employment policy or general health insurance and fines.
(7) Financial assumptions are demonstrated on the basis of evidence
(a) commercial property;
(b) net commercial assets;
(c) the volume of funds available, including the status of bank accounts and loans;
(d) the most recent accounts audited by the auditor where they have an obligation to carry out the audit, including an annex thereto, to the full extent in the case of the applicant's business activity during the previous financial year;
(e) the business plan for the first 5 years of business in the energy sector.
(8) The business plan shall, as a general rule, contain the following information certifying:
(a) the characteristics of the applicant;
(b) the long-term ability to finance the business plan;
(c) estimated costs and revenues;
(d) property-law relations with the licensed establishment;
(e) basic technical and material conditions for the required activity, in particular plant performance, raw material consumption, supply of products;
(f) the financial balance of the applicant.
(9) The details of the financial and technical assumptions and the method of proving them are laid down in implementing legislation for each type of licence.
(10) The approval of the State Nuclear Safety Authority is necessary to grant a licence for the production of electricity or heat in nuclear installations.
Responsible representative
(1) The responsible representative, if established, is responsible for carrying out the licensed activity under this Act.
(2) The representative responsible shall comply with the conditions for granting the licence referred to in Article 5 (1).
(3) The office of the responsible representative may always be performed for one licence holder.
(4) Where the licence holder is a legal person, he shall always appoint a responsible representative. Where the licence holder is a natural person, he shall designate a responsible representative unless he himself fulfils the requirement of professional competence.
(5) The responsible representative of a legal person may not be a member of the Supervisory Board or any other supervisory body of that legal person.
(6) The provisions of the responsible representative of the licence holder shall be approved by the Energy Regulatory Authority.
(7) If, in the course of the performance of the licensed activity, the responsible representative ceases to perform his or her duties or ceases to fulfil the conditions for the performance of the duties of responsible agent, the holder of the licence shall be obliged to propose a new representative within 15 days. Pending the approval of the new responsible representative, the holder of the licence shall be responsible for carrying out the licensed activity.
Licence application
(1) Licences shall be granted upon written request.
(2) The application for a licence shall contain:
(a) the name and surname, permanent residence, birth number, if any, or date of birth; where the responsible representative is appointed, the following information concerning the responsible representative,
(b) subject matter, place and scope of business, list of establishments, for licences for distribution and distribution also defined territory;
(c) the business firm, if the applicant is registered, and the identification number, if assigned;
(d) the required period for which the licence is to be granted and the proposed date for the start of the licensed activity;
(e) in the case of a foreign natural person resident outside the Czech Republic, the place of residence in the Czech Republic, if any, the location of the organisational component in the Czech Republic and the information referred to in point (a) concerning the leading organisational component; If the responsible representative or manager is a person residing outside the Czech Republic, his place of residence in the Czech Republic if he resides in the Czech Republic.
(3) The application for a licence shall contain:
